Ordinance No. 428• • L r ORDINANCE NO. —2S AN ORDINANCE EM.ARGING AM EXTEMING THE BOUNDARY LICIITS OF THE CITY OF BAYTO11N. TEXAS. AM AM`IEXING ADDITIONAL ADJACENT TERRITORY TO SAID CITY, ALL OF r-THICH IS DESCRIBED HEREIN; CONTAINING A SAVINGS CLAUSE, AM PROVIDING FOR THE PUBLICATION AAD PASSAGE OF THIS ORDINANCE IN THE C.IANNER PROVIDED IN ARTICLE I, SECTION 9, OF THE CHARTER OF THE CITY OF BAYTOI2- BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOI..W: Section 1: Intent and Purpose of the Ordinance; The City Council of the City of Baytown, acting pursuant to Section 9 of Article I of the Charter of said City, hereby declares that it is necessary that the hereinafter des- cribed territory lying adjacent to the City be annexed and the existing boun- dary limits of the City be extended to include such territory. The purpose and intent of this extension of the boundary limits of the City o €Baytown is to take care of said City's present needs for additional territory and the reasonably anticipated future growth and expansion of the City. Section 2: That the boundary limits of the City of Baytown, Texas, be enlarged and extended as hereinafter set out so as to include within the boun- dary limits of said City all that territory lying adjacent to said City within the following described lines, to -wit: BEGIN14ING at the point of intersection of the mean high tide line of the Easterly shore of Black Duck Bay with a line which is parallel to and 200 feet South of the South right -of -way line of State Highway No. 146; • THENCE, Easterly following a line which is parallel to and 200 feet Southerly from the South right -of -way line of State High- way No. 146 to Causeway Road and continuing over and across said Causeway Road to the East right -of -way line of Causeway Road; THENCE, Southerly with the East right -of -way line of Causeway Road to the North right -of -way line of Evergreen Road; THENCE, Easterly, Southeasterly and Northeasterly with the North right -of -way line of Evergreen [toad to the P:'est right - of -way line of Tri- Cities Beach Road; THENCE, continuing Northeasterly with an extension of the North right -of -way line of Evergreen Road, over and across Tri - Cities Beach Road, and continuing to the mean high tide line of the Vesterly shore of Cedar Bayou Stream; THENCE, downstream following the meanders of the dean high tide line of the Vesterly shore of Cedar Bayou Stream to the point of intersection with the mean high tide line of the North shore • of Negro Head Lake; THENCE, Northerly, Westerly, Southerly, Easterly and Northerly with the mean high tide line of Negro Head Lake to the mean high, tide line of the r'esterly shore line of Cedar Bayou Streams u i 0 000 000 THENCE, downstream following the meanders of the mean high tide line of the Westerly shore of Cedar Bayou Stream to the point of intersection with the mean high tide line of the Northerly shore of Ash Lake; THENCE, Northwesterly, Southerly, Westerly and Easterly fol- lowing the mean high tide lane of the shoreline of Ash Lake and Cedar Bayou Stream to the point of intersection of said !1esterly shoreline with the-Northeasterly shoreline of Gal- veston Bay; THENCE, in a Northerly and 1..esterly direction following the mean high tide line of the shoreline of Galveston Bay and Tabbs Bay to the East.shoreline of Goose Creek Stream; THENCE, continuing Tdesterly, over and across the mouth of Goose Creek Stream to the point of intersection of the Priest shoreline of Goose Creek.Stream with the mean high tide line, of the Northerly shoreline of Black Duck Bay; THENCE, continuing with said shoreline of Black Duck Bay to the POINT OF BEGINNING. Section 3: That the above described additional territory and area so annexed shall be a part of the City of Baytown, and the property so added to said City shall bear its pro rata part of the taxes levied by the City of Bay - town and the inhabitants thereof shall be entitled to all the rights and pri- vileges of all the-citizens and shall be bound by the acts, ordinances, regu- lations and provisions of the Charter of the City of Baytown. Section 4: That if any portion or portions of the above described terri- tory is validly included within the territory limits then such portion or portions of the above described eluded and the remaining territory is hereby annexed and the boundary limits of said city are hereby-amen, dary limits of such other city or town or such other area of the conflict. of another city or town, territory is hereby ex- to the City of Baytown, ied to conform to the boun- cities or towns along the Section 5: That if any portion or portions of the above described terri- tory may become included within the limits of another city or town, by reason of a valid annexation ordinance heretofore introduced before the Council, Com- mission or other governing body of such city or town, then such portion or por- tions of the above described territory is hereby excluded from the limits of the City of Baytown and the remaining territory is hereby annexed to the City of Baytown and the boundary limits of said City of Baytown are hereby amended to conform to the boundary limits of such other city or town or such other cities or towns along the area of the conflict. Section 6: That if any legal impediment exists preventing the valid an- nexation of any portion of the above described territory to the City of Baytown, 3- ® then such portion of the above described territory is hereby excluded and the remaining territory is hereby annexed to the City of Baytown and the boundary limits of said, City of Baytown are hereby amended to conform to the territory so annexed. Section 7; If any provision, exception, section, paragraph, sentence, clause or phrase of this ordinance or the application of same to any person or set of circumstances or to any particular tract or parcel of land, shall for any reason be held unconstitutional, void or invalid, such invalidity shall not affect the validity of the remaining provisions of this ordinance or their ap-, plication to other persons or sets of circumstances or to other tracts or par- cels of land included in the territory hereinabove described in Section 2 of, • this ordinance. Section S; That this ordinance upon and after its introduction shall be published and finally acted upon in the manner provided in Article I, Section 9, of the Charter of the-City of Baytown.
