BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF DAYTOU'N
TEXAS:
SECTION 1: That pursuant to Section 9, Article I of the City Charter,
said Ordinance No. 239 introduced in'the City Council of the City of Baytown
• on the 12th day of August, A.D., 1954, shall be amended and as so amended
shall read as follows:

TERRITORY TO SAID CITY, ALL OF !A1ICH IS DESCRIBED HEREIN; CON-
TAINING A SAVINGS CLAUSE, tM PROVIDING FOR THE PUBLICATION
AND PASSAGE OF THIS ORDINANCE IN THE HANNER PROVIDED IN ARTI-
CLE I SECTION 9 OF THE CHARTER OF THE CITY OF.BAYTOIIN.
BE IT"ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOI:TI,
TEXAS:
SECTION 1: Intent And Purpose Of The Ordinance. The City Council of
the City of.Baytown, acting pursuant'to Section 9 of Article I of the Charter
of said City, hereby declares that it is necessary that the existing boundary.
limits'of the City be extended to include such territory.' The purpose and in-
tent of this extension of the boundary limits of the City of Baytown is to
take care of said City's present needs for additional territory and the reason-
ably anticipated future growth and expansion of the City.
SECTION 2; That the boundary limits of the City of Baytown, Texas, be
enlarged and extended as hereinafter set out so as to include within the boun-
dary limits of said City, all that territory lying adjacent to said City tvith-
in the following described lines, to -wit:
BEGINNING at the point of intersection of the South
property line of Roseland Park with the mean high tide
line of the !'hest bank of Cedar Bayou Stream;

THENCE, from the point of beginning, in a Northwesterly
direct ion with the South line of Roseland Park to the Southeast
• corner of a 65.897 acre tract of land formerly owned by Rosa Kil-
gore, said point being the same as described as Point No. 14 in
Ordinance No. 1 of the consolidated City of Pelly, now the City
of Baytown;
THENCE, in a Northwesterly direction along the South
line of said.65.097 acre Rosa Kilgore tract to the Southwest corner
of said tract, said corner being located in the East right -of -way
line of the Tri- Cities Beach-Road; and continuing in the same di-
rection, over and across Tri- Cities Beach Road to the Southeast
corner of a 24.351 acre tract owned by Bessie J. Busch, and others;
THENCE, -, continuing Northwesterly with the South line of
the Bessie i. Busch�24.351 acre tract to a line which is parallel
to and 200 feet from the East right -of -way line of State Highway
No. 146;
THENCE., - Southerly and Westerly with aline which is paral -_
el to and a distance of 200 feet from the East and South right -of-
way line of State Highway No. 146 to the intersection of-said line
with the East property line of a 4.52 acre tract, of land out of the

THENCE, Southerly with the East line of the abovementioned
Annie. E. Busch tract to the Southeast corner of said tract, said
Southeast corner being the same point described as Point No: 3 in
Ordinance No. 1 of the consolidated City of Pelly, now the City of
Baytown;
THENCE, !'lesterly with the South line of the abovementioned
Annie E. Busch tract, and continuing with,the South line of the W.
B. Tabb 4.516 acre tract, said South line also being the North line
of the 80 acre tract owned or formerly owned by firs. Anna A. Wright,
and continuing with the North line of the said Anna A. Wright tract
to a line which is parallel to and 200 feet from the South right -of-
way line of State Highway No. 1.46;
THENCE, Westerly with a line parallel to and 200 feet from
the South right -of -way line of State Highway No. 146 to the ]'lest
line of the 19m. Scott Lower League;
TIIENCE, Southerly ivith the I'lest line of the Um. Scott
• Lower League, said line also being the East line of the Harvey !'Whit-
ing Survey, to the most Southerly Southeast corner of the Harvey
I.%iting Survey, said point being the same point as described as Point
No. 1 in Ordinance No. 1 of the consolidated City of Telly, now the
City of Baytown;
THENCE, Westerly with the South line of the Harvey !:1hiting
Survey to a line parallel to and 200 feet from the South right -of -way
line of State Highway No. 146;
THENCE, Southwesterly with a line parallel to and 200 feet
from the South right -of -way line of State Highway No. 146 to the East
right -of -way line of Causeway Road;
THENCE, Southerly with the East right -of -way line of Cause-
way Road to the North right -of -way line of Evergreen Road;
THENCE, Easterly, Southeasterly and Northwesterly with the
North right -of -way line of Evergreen Road to the West right- of -wwy
line of Tri - Cities Beach Road;

THENCE, continuing Northwesterly with an extension of the
North right- of -vay line of Evergreen Road, over and across Tri- Cities
• Beach Road, and continuing in the some direction to the mean high
tide line of the Westerly shore of Cedar Bayou Stream;
THENCE. Northerly and up- stream, following the meanders
of the mean high tide line of the I7esterly shore of Cedar Bayou
Stream to the POINT Of BEGINNING.
SECTION 3: That the foregoing described additional territory and area
so annexed shall be a part of the City of Baytown, and the property so added
to said City shall bear its pro.rata part,of the taxes levied by the City of
Baytown and the inhabitants thereof shall be entitled to all the rights and
privileges of all the citizens and shall be bound by the acts, ordinances,
resolutions, regulations and provisions of the Charter of the City of Baytown:
SECTION 4: That if any portion or portions of the above described pro-
perty is validly included within the territory limits of another city or town
then such portion or portions of the above described territory is hereby ex-
cluded and the remaining territory is hereby annexed.to the City of Baytown,
and the boundary limits of said City are hereby amended to conform to the
boundary limits of such other City or Town or such other Cities or Towns along
the area of the conflict.
SECTION S: That if any portion or portions of -the above described terri-
tory legally may becone included within the limits of another city or town,
by reason of a valid annexation ordinance heretofore introduced before the
council, concussion or other governing body of such city or town, then such
4 portion or portions of the above described territory is hereby excluded from
• the-limits of the City of Baytown and the remaining territory is hereby an-
need to the City of Caytown and the limits of said City of Baytown are here-
by amended to conforn to the boundary limits of such other city or town or
such other cities or towns along the area'of the conflict.
SECTION 6: That if any legal impediment exists preventing the valid an-
vexation of-any portion of the above described territory to the City of Bay -

town, then such portion -of the above described territory, is hereby excluded
and the remaining territory is hereby annexed to the City of Baytown and the
boundary limits of said City of Baytown are hereby amended to conform to the
territory so annexed.
• SECTION 7: If any provision, exception, section, paragraph, sentence,
clause or phrase of this ordinance or the'application of same to any person

or set of circumstances or to any particular tract or parcel of land, shall
for any reason be held unconstitutional, void or invalid, such invalidity
shall not affect.the validity of the remaining provisions of this ordinance
or their application to other persons or sets of circumstances or to other
tracts of land included in the territory hereinabove described in Section 2
of this-ordinance.
SCCTION 8:' That this ordinance upon and after its introduction shall be
published and finally acted upon in the manner provided in Article I, Section
Nine (9) of the
Charter of
the City
of Baytown.

SECTION 2: That this ordinance, being Ordinance No. 239 in amended form,
shall take effect from and after the date of its passage.
