Ordinance No. 288ORDINANCE NO. 288 AN ORDINANCE 'REGULATING THE RATES OF THE HOUSTON NATURAL ® GAS CORPORATION IN THE CITY OF RAYTOWN, TEXAS; PROVIDING A REPEALING CLAUSE; PROVIDING A SAVINGS CLAUSE; AND PROVIDING FOR THE PUBLICATION AND EFFECTIVE DATE THEREOF. WFEREAS, on the 23rd day of June, 1955, the Houston Natural Gas Corporation made a formal application to the City Council of the City of Baytown for an increase in gas rates, and WHEREAS, the City 'Council was of the opinion, and is of the opinion, that it is its duty to set gas rates that are fair to both the customer and to the gas company, and WHEREAS, the City Council has made a study of this application for an in- 1955, during which time the Company and the City were allowed sufficient time to present facts, figures and related data concerning the various aspects of this utility and its application for a rate increase; and WHEREAS, the formal hearing and public hearing have been closed and a full study of the application has been fully and carefully considered by the Council; and WHEREAS, the City Council of the City of Baytown has prepared a schedule of rates that will permit said Company to make a fair return on the fair value of its property used and useful in furnishing gas and natural gas service to its customers in the Baytown District and at the same time be fair to the customers in the City of Baytown; NOW, THEREFORE, . BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN: SECTION 1: THAT the Houston Natural Gas Corporation, its successors and assigns, is hereby authorized to charge no more than the following rates for all gas used by its residential and small commercial customers in the City of Baytown after August the 30th, 1955, to -wit: crease and has had many facts and figures presented to it; and • WHEREAS, a formal hearing was held by the City Council on July the 6th 1955, during which time the Company and the City were allowed sufficient time to present facts, figures and related data concerning the various aspects of this utility and its application for a rate increase; and WHEREAS, the formal hearing and public hearing have been closed and a full study of the application has been fully and carefully considered by the Council; and WHEREAS, the City Council of the City of Baytown has prepared a schedule of rates that will permit said Company to make a fair return on the fair value of its property used and useful in furnishing gas and natural gas service to its customers in the Baytown District and at the same time be fair to the customers in the City of Baytown; NOW, THEREFORE, . BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN: SECTION 1: THAT the Houston Natural Gas Corporation, its successors and assigns, is hereby authorized to charge no more than the following rates for all gas used by its residential and small commercial customers in the City of Baytown after August the 30th, 1955, to -wit: The above rates are net rates and will apply to all bills paid within ten • days of date of rendition. If bills are not paid within ten days, gross rates shall apply, which rates shall be the above net rates plus one cent per CCF of gas consumed per month. RESIDENTIAL 1,000 cubic feet and under $ 1.50 Next 2,000 cubic feet 7.5t per CCF " 7,000 cubic feet 7.2t per CCF 40,000 cubic feet 6.5� per CCF " 50,000 cubic feet 5.0� per CCF Excess 5.0¢ per CCF The above rates are net rates and will apply to all bills paid within ten • days of date of rendition. SECTION 2: THAT nothing in this ordinance shall be construed as in any manner, now or hereafter, limiting or modifying the right and power of the City Council under the law to regulate the rates charged by the Houston Natural Gas Corporation, its successors or assigns, for its service within the City of Baytown, Texas. SECTION 3: Repealing Clause. All ordinances or parts of ordinances inconsistent with the terms of this ordinance are hereby repealed; provided, however, that such repeal shall be only to the extent of such inconsistency, and in all other respects this ordinance shall be cumulative of other ordinances regulating and governing the subject matter - covered by this ordinance. SECTION 4: Savings Clause. If any provisions, exceptions, section, subsection, paragraph, sentence, clause or phrase of this ordinance or the application of same I to any person or set of circumstances shall for any reason be held unconstitutional, void, or invalid, such invalidity shall not affect the validity of the remaining provisions of this ordinance or their application to other persons or sets of circumstances and to this end, all provisions of this ordinance are declared to be severable. SECTION 5: Effective Date. This ordinance shall take effect immediately from and after its passage by the City Council. The City Clerk is hereby directed to give notice hereof by causing the caption of this ordinance to be published in the official newspaper of the City of Baytown at least twice within ten (10) days after the passage of this ordinance.
