Ordinance No. 14,093ORDINANCE NO. 14,093 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, AMENDING CHAPTER 2 "ADMINISTRATION," ARTICLE V "FINANCE," DIVISION 1 "GENERALLY," SECTION 2-595 "FEES FOR VARIOUS CITY SERVICES," SUBSECTION (2) "DEVELOPMENT SERVICES," PARAGRAPHS (B) 'BUILDING PERMIT: RESIDENTIAL," (C) "DEMOLITION PERMIT," (D) "ELECTRICAL PERMIT: RESIDENTIAL," (E) "ELECTRICAL PERMIT: COMMERCIAL, RESIDENTIAL REPAIRS OR UPGRADES," (F) "PLUMBING PERMIT: RESIDENTIAL," (G) PLUMBING PERMIT: COMMERCIAL, RESIDENTIAL REPAIRS OR UPGRADES," (H) "MECHANICAL PERMIT: RESIDENTIAL," (1) "MISCELLANEOUS BUILDING PERMIT," AND (J) "INSPECTION AND PLAN REVIEW (FOR BUILDING SERVICES ONLY)" AND CHAPTER 18 "BUILDINGS AND BUILDING REGULATIONS," ARTICLE IX "MINIMUM PROPERTY STANDARDS," DIVISION 2 "ONE- AND TWO-FAMILY DWELLINGS AND TOWNHOUSES," SECTION 18-652 "AMENDMENTS TO THE RESIDENTIAL CODE" OF THE CODE OF ORDINANCES, BAYTOWN, TEXAS, TO UPDATE RESIDENTIAL BUILDING AND INSPECTION FEES AND TO REMOVE THE REQUIREMENT THAT THE VALUATIONS FOR BUILDING PERMIT FEES BE OBTAINED; PROVIDING A REPEALING CLAUSE; CONTAINING A SAVINGS CLAUSE; PRESCRIBING A MAXIMUM PENALTY OF FIVE HUNDRED AND NO'100 DOLLARS ($500.00); AND PROVIDING FOR TfiE PUBLICATION AND EFFECTIVE DATE THEREOF. ****************************************************************************** BE IT ORDAINED BY TIIE CITY COLJNCIL OF THE CITY OF BAYTOWN, TEXAS: Section 1: That Chapter 2 "Administration," Article V "Finance," Division 1 "Generally," Section 2-595 "Fees for various city services," Subsection (2) "Development services," Paragraphs (b) "Building permit: Residential," (c) "Demolition permit, " (d) "Electrical permit: Residential," (e) "Electrical Permit: Commercial, residential repairs or upgrades," (f) "Plumbing permit: Residential," (g) Plumbing permit: Commercial, residential repairs or upgrades," (h) "Mechanical permit: Residential," (i) "Miscellaneous building permit," and 0) "inspection and plan review (for building services only)" of the Code of Ordinances, Baytown, Texas, is hereby amended to read as follows: CHAPTER 2. ADMINISTRATION ARTICLE V. FINANCE DIVISION 1. GENERALLY Sec. 2-595. Fees for various city services. The fees set out below are adopted for the city services outlined herein: (2) Development services. Any person applying to the city for a permit shall pay to the city, prior to the issuance of the permit, a permit fee for any improvement based upon the following schedules. If work for which a permit is required by this Code is commenced prior to obtaining the required permit, the fees specified in this subsection shall be doubled. The payment of this fee shall not relieve any person from any penalties or enforcement action arising from a person's failure to timely obtain the requisite permit. b. Building permit: Residential. Section 2: That Chapter 18 "Buildings and Building Regulations," Article IX "Minimum Property Standards," Division 2 "One- and Two -Family Dwellings and Townhouses," Section 18-652 "Amendments to the residential code" of the Code of Ordinances, Baytown, Texas, is hereby amended to read as follows: CHAPTER 18. BUILDINGS AND BUILDING REGULATIONS ARTICLE IX. MINIMUM PROPERTY STANDARDS DIVISION 2. ONE- AND TWO-FAMILY DWELLINGS AND TOWNHOUSES 6 Section 18-652. Amendments to the residential code. The residential code adopted in section 18-651 shall be amended as follows: Section R108.2 Schedule of permit fees is amended to read as follows: On buildings, structures, electrical, gas, mechanical and plumbing systems or alterations requiring a permit, a fee for each permit shall be paid as required, in accordance with the fee schedules established in Chapter 2 of the Code. Section R108.3 Building permit valuations is repealed in its entirety. Section R112 Board of Appeals is amended to read as follows: Section R112 "Board of Appeals" is repealed in its entirety and replaced by Chapter 18, Article II, Division 2. Any reference to the Board of Appeals in the code adopted in section 18-651 shall mean and refer to the Construction Board of Adjustments and Appeals established in Chapter 18, Article II, Division 2 of this code. Section 403.1.7.3 Foundation Elevation is amended to read as follows: On graded sites, not within the designated special flood hazard areas, the top of any exterior foundation shall extend above the elevation of the crown of the road a minimum of 18 inches plus 2 percent. Alternate elevations are permitted subject to the approval of the building official, provided it can be demonstrated that required drainage to the point of discharge and away from the structure is provided at all locations on the site. A registered surveyor shall certify the finished floor elevation to be in compliance with this section. A copy of such certification shall be presented to the building official prior to issuance of the certificate of occupancy. Section 403.1.7.3.a Setback survey shall be added to read as follows: A registered surveyor shall certify the building setbacks are in compliance with those established within the City of Baytown code of ordinances. A copy of such certification shall be presented to the chief building official prior to placement of foundation concrete. Part VIII Electrical is amended to add the following: Wherever differences may occur between the International Residential Code, Part VIII Electrical and (i) NFPA 70, the National Electrical Code or (iii) Chapter 18, Article III of this code, the provision of NFPA 70, the National Electrical Code and Chapter 18, Article III of the code of ordinances shall take precedence. Section 3: All ordinances or parts of ordinances inconsistent with the terms of this ordinance are hereby repealed; provided, however, that such repeal shall be only to the extent of such inconsistency, and in all other respects, this ordinance shall be cumulative of other ordinances regulating and governing the subject matter covered by this ordinance. 7 Section 4: If any provision, section, exception, subsection, paragraph, sentence, clause or phrase of this ordinance or the application of same to any person or the set of circumstances shall for any reason be held unconstitutional, void or invalid, such invalidity shall not affect the validity of the remaining provisions of this ordinance or their application to other persons or sets of circumstances; and to this end, all provisions of this ordinance are declared to be severable. Section 5: Any person who fails to comply with any provision of this ordinance shall be guilty of a misdemeanor and, upon conviction, shall be punished by a fine not exceeding FIVE HUNDRED AND NOi 100 DOLLARS ($500.00). Each act of violation and each day upon which any such violation shall occur shall constitute a separate offense. Section 6: This ordinance shall take effect from and after ten (10) days from its passage by the City Council. The City Clerk is hereby directed to give notice hereof by causing the caption of this ordinance to be published in the official newspaper of the City of Baytown at least twice within ten (10) days after passage of this ordinance.
