Ordinance No. 251ORDINANCE NO. 251 AN ORDINANCE AUTHORIZING THE CHIEF OF POLICE OF THE CITY OF BAYTOWN, ACTING WITH THE APPROVAL AND CONSENT OF THE CITY MANAGER, TO ESTABLISH NON- PARKING, LOADING AND UNLOADING ZONES ON THE PUBLIC STREETS OF SAID CITY; PROVIDING FOR A 1. %XI11UM PENALTY OF TWO HUNDRED ($200.00) DOLLARS; PROVIDING A SAVINGS CLAUSE; PROVIDING A REPEALING CLAUSE AND PROVIDING FOR THE PUBLICATION AND EFFECTIVE DATE HEREOF. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYCOWN: SECTION 1: THAT the Chief of Police of the City of Baytown, acting with the approval and consent of the City Manager, is hereby authorized to establish non- parking, loading and unloading zones within the City of Baytown. SECTION 2: THAT any individual, corporation or partnership that feels aggrieved by any creation or non - creation off non - parking, loading or unloading spaces may appeal to the City Council for relief and the Council's decision shall be final. . SECTION 3: Wherever said zones are established as herein provided, indicating said non - parking, loading and unloading spaces, it shall be unlawful for any person or persons to park or stand an automobile or other vehicle within the said space except trucks and commercial vehicles parked in a manner indicated by painted lines or signs or other appropriate notices on the pavement, curb, street or sidewalk for the purpose of loading and unloading merchandise. The time limit for trucks and commercial vehicles to park and use said non - parking, loading and unloading spaces shall be for fifteen (15) minutes or as long as it is reasonably necessary to load and unload merchandise. The provisions of this section shall not apply on Sundays and legal holidays or between the hours of 6:00 p. m. and 7:00 a. m. Provided further that any such zone so established by the Chief of Police and the City • Manager may be changed from time to time when found necessary to expedite the handling of traffic. SECTION 4: Penalty. Any person who shall violate any provision or provisions of this ordinance shall be deemed guilty of a misdemeanor and upon conviction shall be punished by a fine of not more than Two Hundred ($200.00) Dollars. Each parking violation shall constitute a separate offense. SECTION 5: S ,4vings Clause. If any provision, exception, section, subsection, paragraph, sentence, clause or phrase of this ordinance or the application of same to any person or set of circumstances shall for any reason be held unconstitutional, void or invalid, such invalidity shall not affect the validity of the remaining 0 provisions of this ordinance or their application to other persons or sets of circumstances and to this end, all provisions of this ordinance are declared to be severable. All ordinances or parts of ordinances incon- sistent with the terms of this ordinance are hereby repealed; provided, however, that such repeal shall be only to the extent of such inconsistency, and in all other respects this ordinance shall be cumulative of other ordinances regulating and governing the subject matter covered by this ordinance. SECTION 7: Effective Date. This ordinance shall take effect from and after ten (10) days from its passage by the City Council. The City Clerk is hereby directed to give notice hereof by causing the caption of this ordinance to be published in the official newspaper of the City of Baytown at least twice within ten (10) days after the passage of this ordinance.
