Ordinance No. 236ORDINANCE NO. 236 i AN ORDINANCE ENIARGING AND EXTENDING THE BOUNDARY LIMITS OF THE CITY OF BAYTOWN, TEXAS, AND ANNEXING ADDITIONAL ADJACENT TERRITORY TO SAID CITY, ALL OF WHICH IS DESCRIBED HEREIN; CONTAINING A SAVINGS CLAUSE, AND PROVIDING FOR THE PUBLICATION AND PASSAGE OF THIS ORDINANCE IN THE MANNER PROVIDED IN ARTICLE I, SECTION 9, OF THE CHARTER OF THE CITY OF BAYTOWN. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN: SECTION 1: Intent and Purpose of the Ordinance. The City Council of the City of Baytown, acting pursuant to Section 9 of Article I of the Charter of said City, hereby declares that it is necessary that the hereinafter described territory lying adjacent to the city be annexed and the existing boundary limits of the city be extended to include such territory. The purpose and intent of this extension of the boundary limits of the City of Baytown is to take care of said city's present needs for • additional territory and the reasonably anticipated future growth and expansion of the City. SECTION 2: That the boundary limits of the City of Baytown, Texas, be enlarged and extended as hereinafter set out so as to include within the boundary limits of said city all that territory lying adjacent to said city within the following described lines, to -wit: BEGINNING at the point of intersection of the easterly line of Bay Villa Subdivision in the Venn. Scott Upper League, and the northeasterly shore of Scott's Bay said point of intersection being situated South 31 degrees 46 minutes 460.9 feet West from the Northeast corner of Bay Villa Addition, being situated in the southwesterly right -of- way of Market Street Road; Thence North 31 degrees 46 minutes East along the East line of the Bay Villa Subdivision 460.9 feet to the southwesterly line of Market Street Road; Thence with the southerly line of Market Street Road along the northeasterly line of •Bay Villa Subdivision North 13 degrees 10 minutes West 100.1 feet, North 17 degrees 8 minutes West 100 feet, North 21 degrees 28 minutes West 100.2 feet, North 26 degrees 20 minutes West 99.7 feet, North 29 degrees 38 minutes West 641.9 feet, North 29 ddgrees 43 minutes west 312.9 feet, North 33 degrees 4 minutes West 156.9 feet, North 34 degrees 47 minutes West 100 feet, North 36 degrees 6 minutes West 100 feet, North 38 degrees 4 minutes West 111.6 feet to point, being the point of intersection of Nest line of ` Humble Oil & Refining Company projected and the southwesterly line of Market Street Road; Thence North 20 degrees 44 minutes East, over and across Market Street Road 114.4 feet to the northeasterly line of the Market Street Road; Thence North 21 degrees 3 minutes East along the West line of the Humble Oil & Refining. Company over and across Cedar Bayou- Wooster County Road to a distance of 536.9 feet to the North line of the said Cedar Bayou Wooster Road and being the Southeast corner of the Sweeney Addition; Thence North 21 degrees 7 minutes East along the East line of the Sweeney Addition a distance of 2660 feet to corner, being the Southwesterly corner of the Steinman Tract; also known as C. A. Fortner 38 acres; Thence South 8¢ degrees 59 minutes East along the South line of the Steinman Tract a distance of 200.43 feet to corner, being the southeasterlyccorner Steinman T$a &�; Thence with the East line of the Steinman `Fact North 21 degrees 10 minutes East 1080.1 feet, North 00 degrees 40 minutes West 1584.92 feet to the Northeast corner of the Steinman Tract, being the North line of the Wm. Scott Upper League; Thence West with the said North line of the Wm. Scott Upper League to the intersection of said line with the East line of the southerly projection of the William Hilbus Survey, which is also the Southwest corner of the Harvey Whiting League; Thence in a northerly direction along the common line between the William Hilbus Survey and the Harvey Whiting League to the intersection of said common line with the South right -of -way line of Baker Road; Thence in a westerly direction with the South line of Baker Road which South line of Baker Road is the North line of the former Steinman Addition, to the East line of Market Street Road; Thence continuing on a line over and across Market Street Road, said line being the projection of the South line of Baker Road projected over and across Market Street Road to the West line of Market Street Road; Thence North 0 degrees 15 minutes West with the 'Nest line of Market Street Road, to the point of intersection of the West line of the Market Street Road and the South line of Decker Drive; Thence northwesterly along the South line of Decker Drive to the intersection of said line with the center line of Spring dully; Thence with the meanders of the center line of said Spring Gully to the point of intersection of said line with the meander line of the Burnet Bay shoreline at high • tide; Thence southerly with the mean high tide line of the East shore line of Burnet Bay past the point of intersection of said shore line and the North line of the Tharp 65 acre tract, continuing along said shore line to the point of intersection of said shore line and the South bank of Fresh Water Bayou; Thence with the high tide line of Burnet Bay easterly shore lihe from the mouth of the Fresh Water Bayou to the Northwest corner of Block "B" of Brownwood Subdivision in the Nathaniel Lynch Survey, Harris County, Texas; Thence in a southerly and westerly direction along the West line of Block "B" of Brownwood Subdivision in the Nathaniel Lynch Survey to the Southwest corner of Block "AA" in said Brownwood Subdivision, said Southwest corner of Block "AA" situated in the northerly shore line of Chrystal Bay, sometimes referred to as Crystal Lake; Thence in an easterly direction along the northerly shore of Crystal Bay dine at mean high tide to the Northwest corner of Block "A °1 of aforesaid Brownwood Addition; Thence continuing in a southerly direction along the easterly shore line of Crystal Bay to a line which is 2500 feet easterly at right angles from and parallel to the center line of the Houston Ship Channel; • Thence in a southeasterly direction along the line which is 2500 feet easterly at right angles from and parallel to the center line of the Houston Ship Channel to the intersection of said line with the South line or extension thereof of Block "K" of the town of Wooster; Thence in a northeasterly direction along the south line of Block "Ki' to the northeast corner of Lot 9 in said Block "K"; Thence southeasterly along the west line of Lot 10, 1131ock "K" in the town of Wooster to the southwest corner of said Lot 10 which point is located on the northerly shore of Scott Bay at mean high tide; Thence northeast along said north shore line of Scott Bay at mean high tide to the intersection of said shore line with the west line of the James Strange Survey; Thence continuing along aforesaid Scott Bay shore line at mean high tide past the southwest corner of Bay Villa Subdivision and continuing along the said shore line to the southeast corner of Bay Villa Subdivision and being the point of beginning. SECTION 3: That the above described additional territory and area so annexed shall be a part of the City of Baytown, and the property so added to said city shall bear its pro rata part of the taxes levied by the City of Baytown and the inhabitants thereof shall be entitled to all the rights "and privileges of all the citizens and shall be bound by the acts,•ordinances, resolutions, regulations and provisions of the -2- 0 • • Charter of the City of Baytown. SECTION 4: That if any portion or portions of the above described territory is validly included within the territory limits of another city or town, then such portion or portions of the above described territory is hereby excluded and the remaining territory is hereby annexed to the City of Baytown, and the boundary limits of said city are hereby amended to conform to the boundary limits of such other city or town or such other cities or towns along the area of the conflict. SECTION 5: That if any portion or portions of the above described territory legally may become included within the limits of another city or town, by reason of a valid annexation ordinance heretofore introduced before the council, commission or other governing body of such city or town, then such portion or portions of the above described territory is hereby excluded from the limits of the City of Baytown and the remaining territory is hereby annexed to the City of Baytown and the boundary limits • of said City of Baytown are hereby amended to conform to the boundary limits of such other city or town or such other cities or towns along the area of the conflict. SECTION 6: That if any' legal impediment exists preventing the valid annexation of any portion of the above described territory to the City of Baytown, then such portion of the above described territory is hereby excluded and the remaining territory is hereby annexed to the City of Baytown and the boundary limits of said City of Pay town are hereby amended to conform to the territory so annexed. SECTION 7: If any provision, exception, section, paragraph, sentence, clause, or phrase of this ordinance or the application of same to any person or set of cir- cumstances or to any particular tract or parcel of land, shall for any reason be held • unconstitutional, void, or invalid, such invalidity shall not affect the validity of the remaining provisions of this ordinance or their application to other persons or sets of circumstances or to other tracts or parcels of land included in the territory hereinabove described in Section 2 of this ordinance. SECTION 8: That this ordinance upon and after its introduction shall be published and finally acted upon in the manner provided in Article I, Section 9 of the Charter of the City of Baytown.
