ORDINANCE NO. 235
AN ORDINANCE ENLARGING AND EXTENDING THE BOUNDARY
LIMITS OF THE CITY OF BAYTOWN, TEXAS, AND ANNEXING
ADDITIONAL ADJACENT TERRITORY TO SAID CITY, ALL
OF WHICH IS DESCRIBED HEREIN; CONTAINING A
SAVINGS CLAUSE, AND PROVIDING FOR THE PUBLICATION
AND FASSAGE OF THIS ORDINANCE IN THE MANNER PRO-
VIDED IN ARTICLE I, SECTION 9, OF THE CHARTER
OF THE CITY OF.BAYTOWN.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN:
SECTION 1: Intent and Purpose of the Ordinance. The City Council of the City
of Baytown, acting pursuant to Section 9 of Article I of the Charter of said City,
hereby declares that it is necessary that the hereinafter described territory lying
adjacent to the city be annexed and the existing boundary limits of the city be
extended to include such territory. The purpose and intent of this extension of
• the boundary limits of the City of Baytown is to take care of said cityls present
needs for additional territory and the reasonably antici.P_t6dd future growth and
expansion of the city.
SECTION 2: THAT the boundary limits of the City of Baytown, Texas, be enlarged
and extended as hereinafter set out so as to include within the boundary limits of
said city all that territory lying adjacent to said city within the following
described lines, to -wit:
BEGINNING at a point, where the Southeasterly right -of -way line of State Highway 146
intersects the West right -of -way line of the McKinney County Road, said West right -
of -way line also being the West boundary line of the Christian Smith Survey and the
East boundary line of the James Singleton Survey;
Thence south with the West boundary of said McKinney Road approximately two hundred
(200) feet, more or less, to a County drainage ditch lying on and along the western
extension of the North property line of the J. B. Spurlock seventy -two (72) acre
• tract to the point of confluence with Ponds Gully;
Thence down said Gully in a Southeasterly direction with its meanders to the point
of confluence with Cedar Bayou;
Thence Southerly and down - stream direction with the meanders of the high tide water
line of the West bank of Cedar Bayou to the point of intersection of the South property
line of the J. M. Kilgore two and a half (22) acre tract, said point being identified
as Point No. 16 in tract No. 3 in that certain Annexation Ordinance No. 2 of the
City of Pelly (now known as City of Baytown, Texas) passed and approved in final form
Aiay 22, 1947, said line also being the North boundary line of William Wright Tract;
Thence in a Westerly direction with the present Baytown City limit line along said
North boundary line of the William Wright Tract passing at six hundred thirteen (613)
feet the center line of Kilgore Road, continuing five thousand six hunared ninety -
four (5,694) feet in a westerly direction along said William Wright property line
to the Southwest corner of the Henry Pruitt tract of land, said point being described
as Point No. 17 in the aforementioned Annexation Ordinance;
Thence in a Northerly direction with said City limit line and along the West boundary
line of the Henry Pruitt and William Taylor tracts of land to the point of inter-
section of said line with the South line of the Whitney- Britton Survey, said line
also being the South boundary line of the G. A. Wynne heirs tract of land, said
point being identified as Point No. 18 in the aforementioned Annexation Ordinance;

Thence in an Easterly direction with the said City limit line the same being the
South boundary line of the Whitney- Britton Survey and the South line of G. A. Wynne
heirs tract of land to the point of intersection of said line, with the East boundary
line of said Wynne tract of land, the same being also the West boundary line of the
• William Taylor, Jr., forty (40) acre tract of land, said point being identified as
Point No. 19 in the aforementioned Annexation Ordinance;
Thence in a Northerly direction along said City limit line and the said West boundary
line of the William Taylor, Jr. tract of land to the point of intersection of said
line with the North boundary line of said William Taylor tract of land, said point
being identified as Point No. 20 in the aforementioned Annexation Ordinance;
Thence in a Westerly direction along said City limit line and the said North line of
the G. A. Wynne heirs tract of land to the point of intersection of said line with
the West boundary line of said G. A. Wynne heirs tract, the same being also the East
boundary line of the Cuba Greer tract of land said point being identified as Point
No. 21 in the aforementioned Annexation Ordinance;
Thence Northerly along said City limit line and the East boundary line of Cuba Greer
tract of land to the Southeasterly boundary. line of State Highway 116;
Thence in a Northeasterly direction with said Southeasterly boundary line of State
Highway 116 to the point of beginning, containing nine hundred-sixty (960) acres of
land, more or less.
iSECTION 3: That the above described additional territory and area so annexed
shall be a part of the City of Baytown, and the property so added to said City shall
bear its pro rata part of the taxes levied by the City of Baytown and the inhabitants
thereof shall be entitled to all the rights and privileges of all the citizens and
shall be bound by the acts, ordinances, resolutions, regulations and provisions of
the Charter of the City of Baytown.
SECTION 4: That if any portion or portions of the above described territory
is validly included within the territory limits of another city or town, then such
portion or portions of the above described territory is hereby excluded and the
remaining territory is hereby annexed to the City of Baytown, and the boundary limits
of said city are hereby amended to conform to the boundary limits of such other city
• or town or such other cities or towns along the area of the conflict.
SECTION 5: That if any portion or portions of the above described territory
legally may become included within the limits of another city or town, by reason of
a valid annexation ordinance heretofore introduced before the council, commission
or other governing body of such city or town, then such portion or portions of the
above described territory is hereby excluded from the limits of the City of Baytown
and the remaining territory is hereby annexed to the City of Baytown and the boundary
limits of said City, of Baytown are hereby amended to conform to the boundary, limits
of such Singrodityr6nwtown or such other cities or towns along the area of the conflict.
SECTION 6: That if any legal impediment exists preventing the valid annexation
of any portion of the above described territory to the City of Baytown, then such
portion of the above described territory is hereby excluded and the remaining territory
is hereby annexed to the City of Baytown and the boundary limits of said City of
Baytown are hereby amended to conform to the territory so annexed.

SECTION 7: If any provision, exception, section, paragraph, sentence, clause,
or phrase of this ordinance or the application of same to any person or set of
circumstances or to any particular tract or parcel of land, shall for any reason be
held unconstitutional, void or invalid, such invalidity shall not affect the validity
of the remaining provisions of this ordinance or their application to other persons
or sets of circumstances or to other tracts or parcels of land included in the territory
hereinabove described in Section 2 of this ordinance.
SECTION 8: That this ordinance upon and after its introduction shall be
published and, finally acted upon in the manner provided in Article I, Section 9 of
the Charter of the City of Baytown.
