Ordinance No. 234ORDI NAME NO. 234 AN ORDINAWE ENLARGING AMID EXTENDING THE BOUNDARY • LIMITS OF THE CITY OF BAYTOWN, TEXAS, AND ANNEXING ADDITIONAL ADJACENT TERRITORY TO SAID CITY, ALL OF WHICH IS DESCRIBED HEREIN; CONTAINING A SAVINGS CLAUSE, AND PROVIDING FOR THE PUBLICATION AND PASSAGE OF THIS ORDINANCE IN THE MANNER PRO- VIDED IN ARTICLE I, SECTION 9, OF THE CHARTER OF THE CITY OF BAYTOWN. BE IT QRDAINED BY THE CITY COU%IL OF THE CITY OF BAYTOWN: SECTION 1: Intent and Purpose of the Ordinance. The City Council of the City of Baytown, acting pursuant to Section 9 of Article I of the Charter of said City, hereby declares that it is necessary that the hereinafter described territory lying adjacent to the city be annexed and the existing boundary limits of the city be extended to include Guch territory. The purpose and intent of this extension of the boundary • limits of the City ofBaytown is to take care of said city's present needs for additional territory and the reasonably anticipated future growth and expansion of the city. SECTION 2: THAT the boundary limits of the City of Baytown, Texas, be enlarged and extended as hereinafter set out so as to include within the boundary limits of said city all that territory lying adjacent to said city within the following described lines, to -wit: AREA NUMBER IA Beginning at a point which is the intersection of the North easement of a county drainage ditch with the Eestt.right -of -way line of Tri -City Beach Road, said point being the same as described as Point No. 9 in Ordinance No. 1, Section 3, of the Consolidated City of Pelly, now City of Baytown; • Thence in a Northerly direction along said East right -of -way line of Tri -City Beach Road to the point of intersection of said line with the South right -of -way line of East Texas Avenue, for corner, and being Point No. 10 in said Ordinance; Thence in an easterly direction along said South right -of -way line of East Texas Avenue Extension, to the point of intersection of said line with the West boundary line of Roseland Park, out of the Mrs. Rosa Kilgore tract of land, for corner, and being Point No. 11 in said ordinance: Thence in a southerly direction along the westerly boundary line of Roseland Park and along the arc of a curve to the left for a distance of 954.55 feet, more or less, to the point of ending of said curve, for corner, and being Point No. 12 in said ordinance; Thence in.a southerly direction, continuing along the, westerly boundary line of Roseland Park and along the arc of a curve to the right for a distance of 210.1 feet, more or less, to the point of ending of said ` curve, for corner, and being Point No. 13 in said ordinance; • Thence South 19 degrees West along the said westerly boundary line of Roseland Park a distance of 198.25 feet, more or less, to the point of intersection of said line with the South boundary line of the said Mrs. Rosa Kilgore tract of land, for corner, and being Point No. 14 in said ordinance; LI Thence in a northwesterly direction on a straight line to Point No. 9 said point being the point of beginning. • AREA NUMBER 1B Beginning at the intersection of the East boundary''line oft the Webb Greer tract of land and the Southeasterly right -of -way line of State Highway 146; Thence over and across State Highway 146-on an extension of the East boundary line of the Webb Greer tract of land .in the same direction and continuing along the West boundary.line of the Casey tract of land to the point of intersection_ of said line with the South right -of -way line of the Goose Creek -Cedar Bayou Road, for corner, and being Point, 22 as described in Ordinance No. 1, Section 3; Thence in a Westerly direction, along the said South right -of -way line of the Goose Creek -Cedar Bayou Road to the'Northwest corner of Block No. One (1) of the H. G. Rotan subdivision, the same also being known as Stewart Heights, for corner, and being Point 23; Thence in a Westerly direction a distance of Sixty (60) feet, more or less, to a stake at the northwest corner of Block 19 of Morrell Park Subdivision for corner,- being Point 24; • Thence in a-Northerly direction, along the West right -of -way line of the Cedar Bayou- Lynchburg Road to the point of intersection of said line with a line which is 100,feet north of and parallel to the north right - of -way line of Bob Smith Road; Thence Easterly along said line parallel to and 100 feet North of Bob Smith Road to a point opposite the intersection of the centerline of Highway 146 with said Bob Smith Road; Thence South to the Southeasterly right -of -way line of Highway 146; Thence along said Southeasterly right -of -way line to the point of beginning. AREA NUMBER 1C Beginning at the point of intersection of the north line of Woodruff Street, known as Cedar Bayou - Wooster Road, and also being a continuation of Park Street from Morrell Park Addition; and the Southwesterly line of Decker Drive, in the City of Baytown, William Scott Upper League, Harris County, Texas; Thence Westerly with the North line of Woodruff Street knman a_s Cedar_._ Bayou - Wooster Road, passing over and across. Airhart Drive, and c'ontinui.ng to the point of intersection of said North line of Cedar Bayou - Wooster .Road and the East line of the Humble Oil and Refining Company, an iron fence post for corner; Thence to the right, North 33 Degrees East, with the East line of the Humble Oil and Refining Company, and being the West line of the Busch Estate, to the point of intersection of said line with the Southwesterly line of Decker Drive; Thence to the right, with the So+vthwesterly_line of Decker Drive, South- easterly with said line passing.the port of entry of Airhart Drive and continuing to the point of intersection of said B..bu't•hw. eslekly li de of BeckbruDr ve and the North line of Woodruff Street and being the _point of beginning. AREA 1D Beginning at Point 5 in the description of the boundary lines of the • City of Pelly, Texas, now known as Baytown, Harris County, Texas, as set forth in an Ordinance adopted at a regular meeting of the City Council of said city held on the 2nd day of January, A. D., 1940; which said Ordinance is on record in the Book of Minutes of said City, Volume C, pages 220 et seq. the same being the Southeast corner of the -2- C. J. Jones 10 acre tract of land in the Harvey Whiting Survey, and being Station tf�r?; Thence continuing along the Southerly boundary line of the Harvey Whiting Survey, in an Easterly direction to the Southeast corner of the said Harvey Whiting Survey, for corner, and being Point No. 1; Thence in a Northerly direction along the Easterly boundary line of the said Harvey Whiting Survey to the point of intersection of said line with the Southerly line of the Mrs. A. S. Jones tract No. 8, for corner, and being Point No. 2 of present limits; Thence in an Easterly direction along the Southerly line of the Mrs. A. S. Jones tract # 8 and continuing along the Southerly line of the E. H. Jones tract # 9; the W. L. Jones tract # 10, the Mrs. I.I. S. Kilgore tract # 11; the C. J. Jones tract # 12; the Mrs. A. S. Airhart tract # 13, the Mrs. VI. E. Tabb tract # 14, and the Mrs. Annie E. Busch tract # 15; all being out of the L. W. Jones 46 acre tract in the 111'. Scott Lower League; to the southeasterly corner of the said Lairs. Annie E. Busch tract # 15, for corner, and being the present Point No. 3; Thence North 20 degrees East along the Easterly boundary line of said firs. Annie E. Busch tract 4 15, the same being the Easterly boundary line of the said L. W. Jones 46 acre tract in the Wm. Scott Lower League, to the Northeast corner of the said L. W. Jones 46 acre tract for corner and being the Point No. 4 in the present city limits; Thence North 19 degrees 11 minutes East, along the Easterly boundary line of the v. A. •Harper tract to the point of intersection of said line with the Southerly right -of. -way of Alexander Drive, for corner, and being Point No. 5 of present limits; Thence South 85 degrees 14 minutes East along the said Southerly right -of -way line of Alexander Drive, a distance of 1,020.49 feet, more.or less, to the point of beginning of a curve to the left in said line, for corner, and being Point No. 6 of the present city limits; Thence in a Northeasterly direction, continuing along the Southeasterly right -of -way line of Alexander Drive, also known as State Highway 146, and along the are of a curve to the left, having a central angle of 72 degrees 2'6 minutes and a radius of 1,970.6 feet, more or less, to the point of ending of said curve, for corner, and being Point No. 7, of the present city limits; Thence North 22 degrees 20 minuses East, and continuing along the easterly right -oft way.line of Alexander Drive, also known as State Highway 146, a distance of 83 feet, more or less, to the point of intersection of said right-of-,way line with the North easement line of a county drainage ditch; Thence in an easterly direction along said North easement line of said county drainage ditch for a distance of 200 feet; • Thence southwesterly along a line parallel to and 200 feet distant from the southeasterly right -of -way line of State Highway 146, to the intersection of said line with the easterly boundary of the aforementioned Mrs. Annie E. Busch tract; Thence South 20 degrees West along said line to the Southeast corner of said Mrs. Annie E. Busch tract; Thence along the southerly line of the aforementioned tract out of the L. W. Jones 46 acre tract to the intersection of said-line with a line which is parallel to and 200 feet distant from the Southeasterly right -of -way line of State Highway 146; Thence along said line parallel to State Highway 146, to the intersection of said line with the aforementioned East line of the Harvey Whiting League; Thence southerly along said East League line to the Southeast corner of the said Harve y Whiting League; Thence along the south line of said Harvey Whiting League to the intersection of said South line with a line which is parallel to and 200 feet South of the south right -of -way line of State Highway 146; •Thence along said line parallel to State Highway 146 to the intersection of said line with the high tide line of the East bank of Goose Creek Stream; Thence in a Northerly direction along said East bank of Goose Creek to the most Southerly corner of Goose Lake and continuing to the South line of Durain Ferry Road; -3- Thence Easterly along the Southerly line of Durain Road to point of juncture with West Main Street in the City of Baytown, and continuing along line of West Main Street to point of intersection with the West line of Harvey Whiting League; ® Thence South along the West line of Harvey Whiting League to the Southwest corner of Harvey Whiting League being the Northwest corner of the Wm. Scott Labor; Thence in an Easterly direction along the Southerly boundary line of the said Harvey Whiting League, the same being the Northerly boundary line of ft. Scott labor, and being likewise the Southerly boundary line of the Mrs. S. Kilgore 10 acre tract, and the C. F. Jones 10 acre tract, to the point of intersection of said line, with the East line of.said C. F. Jones 10 acre tract of land being Station 110# and the point of beginning. AREA NLIBER lE Beginning at the point of intersection of the line which is parallel to and 200 feet distant from the southerly right -of -way line of State Highway 146 and the southwesterly boundary line of the Grace Adgy 12.5 acre tract of land; Thence along said line parallel to and 200 feet distant from the southerly right-of-way line of State Highway 146 to the easterly shore of Black Duck Bay, said point being situated in the south line of the Johnelle Bryan Estate 80 acres; Thence continuing along the said bayshore line northerly and northwesterly, passing the northwest corner of the Johnelle Bryan Estate 80 acres, passing the northwest corner of the Eas tburn 20 acres and continuing to the point of intersection of said line with the southerly extension of the easterly boundary line of lot 57 of the Isenhour Bayshore subdivision for corner, and being Point No. 42 of the present city limits; Thence in a northerly direction along the said southerly extension of the easterly boundary line of Lot No. 57 of the Isenhour Bayshore Addition and continuing along the said easterly boundary line of Lot No. 57 of the Isenhour Bayshore Subdivision, to the point of intersection of said line with the southwesterly right -of -way line of Missouri Street, also known as the Old County Road, for corner, and being Point No. 43 of the present city limits; Thence South 49 degrees East along the said southwesterly right -of -way line of Missouri Street, also known as the Old County Road, to the most westerly corner of the Grace Adgy 12.5 acre tract of land, for corner, and being Point No. 44 of the present limits; Thence along the southwesterly boundary line of the said Grace'Adey 12.5 acre tract of land to the tream known a s Goose Creek to the point of beginning. SECTION 3: THAT the above described additional territory and area so annexed shall be a part of the City of Baytown, and the property so added to said city shall bear its pro rata part of the taxes levied by the City of Baytown and the inhabitants thereof shall be entitled to all the rights and privileges of all the citizens and shall be bound by the acts, ordinances, resolutions, regulations and provisions of the Charter of the City of Baytown. SECTION 4: THAT if any portion or portions of the above described territory is validly included within the territory limits of another city or town, then such portion or portions of the above described territory is hereby excluded and the remaining territory is hereby annexed to the City of Baytown, and the boundary limits of said city are hereby amended to conform to the boundary limits of such other city or town or such other cities or towns aleng the area of the conflict. • SECTION 5: THAT if any portion or porti6nesof -the a Bove described territory legally may become included within the limits of another city or town, by reason of a valid annexation ordinance heretofore introduced before the council, commission or other EEO governing body of such city or town, then such portion or portions of the above described territory is hereby excluded from the limits of the City of Baytown and the remaining territory is hereby annexed to the City of Baytown and the boundary limits of said City of Baytown are hereby amended to conform to the boundary limits of such other city or town or such other cities or towns along the area of the conflict. SECTION 6: THAT if any legal impediment exists preventing the valid annexation of any portion of the above described territory to the City of Baytown, then such portion of the above described territory is hereby excluded and the remaining territory is hereby annexed to the City of Baytown and the boundary limits of said City of Baytown are hereby amended to conform to the territory so annexed. SECTION 7: If any provision, exception, section, paragraph, sentence, clause, or phrase of this ordinance or the application of same to any person or set of circumstances • or to any particular tract or parcel of land, shall for any reason be held unconstitutional, void, or invalid, such invalidity shall not affect the validity of the remaining pro- visions of this ordinance or their application to other persons or sets of circumstances or to other tracts or parcels of land included in the territory hereinabove described in Section 2 of this ordinance. SECTION $: THAT this ordinance upon and after its introduction shall be published and finally acted upon in the manner provided in Article I, Section 9 of the Charter of the City of Baytown.
