Ordinance No. 2300 ORDINANCE NO_. 230 AN ORDINANCE DISCONTINUING, ABANDONING FOR PUBLIC USE AND CLOSING A DESCRIBED STREET AND DESCRIBED PORTIONS OF STREETS IN BUSCH TERRACE SUBDIVISION IN THE CITY OF BAYTOWN AND ABANDONING AND QUITCLAIMING ALL INTEREST OF THE CITY OF BAYTOWN AND THE PUBLIC IN AND TO SAID STREET AND PORTIONS OF STREETS, AND DIRECTING THAT THE COUNTY CLERK OF HARRIS COUNTY, TEXAS, SO-INDICATE ON THE RECORDED PLAT OF SAID SUBDIVISION. WHEREAS, the following street and portions of streets lying within Busch Terrace Subdivision, Baytown, Harris County, Texas ac- cording to the map and plat thereof recorded in Vol. 9, pages lb and 11, of the Deed Records of Harris County, Texas, are not now used by the public: 1. Alice Street (also known as Avenue A), from Wooster - Cedar Bayou County Road in the northerly line of said subdivision to Long Street (also known as 6th Street) at the southerly line of said subdivision, being all of Alice Street in said subdivision; 2. 'Busch Street (also known as Avenue B) from Wooster - Cedar Bayou County Road in the northerly line of said subdivision to Dorris Street (also known as Goose Creek Avenue) in said subdivision, being all that portion of Busch Street lying between Blocks 2 and 3 between Blocks 12 and 13, and between Blocks 22 and 23 In said subdivision; 3. Busch Street (also known as Avenue B), from Meek Street (also known as.4th Street) to Long Street (also known as 6th Street) in the southerly line of said subdivision, being all that portion of Busch Street lyi between Blocks,40 and 41 and between Blocks 45 and T6 in said subdivision; 4. Crawford Street (also known as Avenu Cedar Bayou County Road in the northerly division to Hunter Street (also known as said subdivision, being all that portion lying between Blocks 3 and 4 and between said subdivision; C), from Wooster - line of said sub - 3rd Street) in of Crawford Street Blocks 13 and 14 in 5. Myers Street (also known as 6th Street), from the dead end of such street in the westerly line of said subdivision to Damon Street (also known as Avenue D) in said subdivision, being all that portion of Myers Street lying between Blocks 1 and 11, between Blocks 2 and 12, between Blocks 3 and 13, and between Blocks 4 and 14 in said subdivision; 6. Hunter Street (also known as 3rd Street), from the dead end of such street in the westerly line of said sub- division to Crawford Street (also known as Avenue C) in said subdivision, being all that portion of Hunter Street lying between Blocks 11 and 21, between Blocks 12 and 22, and between Blocks 13 and 23 in said subdivision; %. Powell Street (also known as 5th Street) from the dead end of such street in the westerly line of said subdi- vision to Crawford'Street (also known as Avenue C) in said subdivision, being all that portion of Powell Street lying between Blocks 9 and 44, between Blocks 40 and 45, and between Blocks 1 and 46 in said subdivision; 10. Long Street (also known as 6th Street) from the dead end of such street in the westerly line of said subdivision to Crawford Street (also known as Avenue C) in said sub - division, being all that portion of Long Street lying between Blocks 44, 45 and 46 and the southerly line of said subdivision; and WHEREAS, no interest of the public requires that said street and portions of streets be improved or kept open, but the needs of the public will be adequately served by the use of the remaining dedicated streets and portions of streets designated on said plat of Busch Terrace Subdivision; and WHEREAS, the interest of the public will be benefited by the termination of any obligation on the part of the City of Baytown to repair improve and maintain said street and portions of streets as public ways; and WHEREAS, a part or substantially all of the utilities facilities, if any, provided for property abutting upon the above described street and portions of streets have heretofore been removed; and WHEREAS, the only owner of property abutting or adjoining the above described street and portions of streets-in said subdivision has made application that same be discontinued, closed and abandoned as streets, and that the dedications made in connection with said map or plat of Busch Terrace Subdivision, of record as aforesaid, be cancelled and held for naught insofar as the same apply to and affect the above described street and portions of streets; and WHEREAS, it appears to be to the best interest of the City of Baytown, Harris County, Texas, that the above described street and portions of streets be discontinued, closed and abandoned as streets and that the corresponding portions of said map or plat be vacated, and it further appears that the interest of no other owners of property in said Busch Terrace Subdivision will be prejudiced or impaired thereby: NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Baytown, Texas, that the above described street and portions of streets in Busch Terrace Subdivision, City of Baytown, Harris County, Texas, according to the map or plat of said subdivision of record in Vol. 9, pages 10 and 11 of the Deed Records of Harris County, Texas, be and the same are hereby discontinued and abandoned for public use and closed and the City of Baytown does for itself and for the public abandon anA quitclaim all interest in and to the above described street and portions of streets and does hereby approve the application of said owner of the property abutting said street and portions of streets, and the County Clerk of Harris County, Texas is directed to write in plain, legible letters across the corresponding portions of said plat the word "closed" and also to make reference on the same to the volume and page in which this ordinance is recorded.
