Ordinance No. 217• • ORDINANCE NO. 217 ® AN ORDINANCE REGULATING THE KEEPING OF DOGS WITHIN THE CITY OF BAYTOWN, TEXAS; REPEALING ORDINANCES INCONSISTENT HEREWITH; CONTAINING A SAVINGS CLAUSE; PRESCRIBING A MAXIMUM PENALTY OF TWO HUNDRED ($200) DOLLARS; AND PROVIDING FOR THE PUBLICATION AND THE EFFECTIVE DATE HEREOF. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN: SECTION 1: THAT it shall be unlawful for any person, firm or corporation to suffer a dog to run loose anywhere within the city limits of the City of Baytown, except as provided in Section 2 hereof. SECTION 2: THAT all owners of dogs shall keep said dogs secured upon the premises of said owner either by means of a leash, rope or similar device, or that a fence of a substantial nature shall be maintained for this purpose. Provided, however, that dogs may be taken on the public streets and alleys if • said dogs are kept on a leash, rope or similar device, and kept under the control of the owner thereof or one acting with the consent of the owner. SECTION 3: THAT the Chief of Police of the City of Baytown is hereby directed and authorized to take into his custody and impound any and all dogs found loose within the City of Baytown. SECTION 4: THAT this ordinance shall be effective for only ninety (90) days from and after the effective date hereof. SECTION 5: Repealing Clause. All ordinances or parts of ordinances incon- sistent with the terms of this ordinance are hereby repealed; provided, however, that such repeal shall be only to the extent of such inconsistency, and in all other respects this ordinance shall be cumulative of other ordinances regulating and governing the subject matter covered by this ordinance. SECTION 6: Savings Clause. If any provision, exception, section, subsection, paragraph, sentence, clause or phrase of this ordinance or the application of same to any person or set of circumstances shall for any reason be held unconstitutional, void, or invalid, such invalidity shall not affect the validity of the remaining provisions of this ordinance or their application to other persons or sets of circumstances and to this end, all provisions of this ordinance are declared to be severable. SECTION 7: Penalty. Any person who shall violate any provision or provisions of this ordinance shall be deemed guilty of a misdemeanor and upon conviction • shall be punished by a fine of not more than Two Hundred ($200) Dollars. Each day's violation shall constitute a separate offense. SECTION 8: Effective Date. This ordinance shall take effect from and after ten (10) days from its passage by the City Council. The City Clerk is hereby directed to give notice hereof by causing the caption of this ordinance to be published in the official newspaper of the City of Baytown at least twice within ten (10) days after the passage of this ordinance.
