Ordinance No. 18500 ORDINANCE No. 185 AN ORDINANCE PROHIBITING THE CITY OF BAYTOWN, ITS AGENTS AND EMPLOYEES, FROM PURCHASING, ON BEHALF OF THE CITY, ANY MATERIALS, SUPPLIES, SERVICES, LABOR OR MERCHANDISE WHATSOEVER FROM ANY PERSON, ASSOCIATION OF PERSONS, FIRM OR CORPORATION THAT IS DELINQUENT IN ANY PAYMENT OF ANY KIND OF TAXES, DEBTS OR OTHER OBLIGATION NHATSOEVER TO THE CITY OF BAYTOWN; PROVIDING THAT THE GENERAL ENFORCEMENT OF THIS ORDINANCE SHALL BE THE DUTY OF THE CITY MANAGER OF THE CITY OF BAYTOWN; PROVIDING THAT THE CITY MANAGER SHALL CAUSE THE DIRECTOR OF FINANCE AND THE TAX OFFICE TO KEEP ALL EMPLOYEES ARID AGENTS OF THE CITY INFORMED AS TO THE PERSONS, ASSOCIATION OF PERSONS, FIRMS AND CORPORATIONS IN ARREARS TO THE CITY OF BAYTOWN; PROVIDING THAT THE CITY SHALL NOT ACCEPT NOR CONSIDER ANY BID FROM ANY PERSON, ASSOCIATION OF PERSONS, FIRM OR CORPORATION THAT IS DELINQUENT TO THE CITY OF BAYTOWN IN ANY PAYMENT OF TAXES OR OTHER DEBT OR OBLIGATION WHATSOEVER OWING TO THE CITY; REPEALING ORDINANCES INCONSISTENT HEREWITH; CONTAINING A SAVINGS CLAUSE; AND PROVIDING FOR THE PUBLICATION AND EFFECTIVE DATE HEREOF. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN: ® SECTION 1: THAT, henceforth, the City of Baytown, its agents and employees, are hereby prohibited from purchasing, on behalf of the City, any materials, supplies, services, labor or merchandise whatsoever from any person, association of persons, firm or corporation that is delinquent in any payment of any kind of taxes, debts or other obligation whatsoever to the City of Baytown. SECTION 2: THAT the City Manager of the City of Baytown is hereby charged with the duty of enforcing the provisions of this ordinance and to this end he shall apprise all department heads, officers, employees, and agents of the City of Baytown of the terms of this ordinance and see to it that said terms of this ordinance are obeyed by all such department heads, officers, employees and agents of the City. •' SECTION 3': It is expressly provided and shall be the duty of the City Manager to direct the Director of Finance and the tax office of the City to keep all employees and agents of the City informed as to the persons, association of persons, firms and corporations which are delinquent in any payment of any kind of taxes, debts or other obligation to the City of Baytown. SECTION 4: THAT, henceforth, the City of Baytown shall not accept nor consider any bid from any person, association of persons, firm or corporation that is delinquent to the City in any payment of taxes or other debt or obligation whatsoever owing to the City. SECTION 5: Repealing Clause. All ordinances or parts of ordinances inconsistent with the terms of this ordinance are hereby repealed; provided, however, that such • repeal shall be only to the extent of such inconsistency, and in all other respects this ordinance shall be cumulative of other ordinances regulating and governing the subject matter covered by this ordinance. 0 U • 00 •a SECTION 6: Savings Clause. If any provision, exception, section, subsection, paragraph, sentence, clause or phrase of this ordinance or the application of same to any person or set of circumstances shall for any reason be held uncons titutioaal, void or invalid, such invalidity shall not affect the validity of the remaining provisions of this ordinance or their application to other persons or set of circumstances and, to this end, all provisions of this ordinance are declared to be severable. SECTION 7: Effective Date. This ordinance shall take effect immediately after its passage by the City Council of the City of Baytown. The City Clerk is hereby directed to give notice hereof by causing the caption of this ordinance to be published in the official newspaper of the City of Baytown at least twice within ten (10) days after the passage of this ordinance.
