Ordinance No. 177ORDINANCE NO. 177 AN ORDINANCE AMENDING "AN ORDINANCE TO PROMOTE THE HEALTH ® CONDITIONS OF THE CITY OF BAYTOWN BY PROVIDING A CODE OF SANITARY REGULATIONS AND REQUIRaIENTS FOR ALL PLACES, BUSINESS AND PERSONS WHEREIN OR BY WHOM FOODSTUFF OR DRINKS FOR HUMAN BEINGS IS PRODUCED, HANDLED, PREPARED, CARED FOR OR SCOLD, AND ALL VEHICLES USED IN CONNECTION WITH ANY SUCH BUSINESS, AND FOR THE CONDUCT OF HOTELS AND LODGING HOUSES; AND PRESCRIBING THE PUNISHMENT FOR THE VIOLATION OF THE SEVERAL PROVISIONS HEREIN CONTAINED; AND CONTAINING A SAVINGS CLAUSE ", BEING ORDINANCE NO. 36, PASSED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN ON THE 20th DAY OF JANUARY, 1949, BY ADDING THERETO SECTION 3a TO ARTICLE V, AND PROVIDING FOR THE PUBLICATION AND EFFECTIVE DATE OF THIS ORDINANCE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN: SECTION l: THAT said Ordinance No. 36 is hereby amended by adding thereto Section 3a to Article V thereof, as follows: Section 3a: It shall be unlawful to sell or offer for sale within the corporate limits of the City of Baytown any oyster, clams, scallops or other shellfish which, if taken from the waters under the jurisdiction of the State of Texas, have not been approved by the Texas State Department of Health and under the regulations and permit of said Department, both as to preparation and packing for shipment, and shipment, or if said marine products be taken from Waters under the jurisdiction of any other state, it shall be unlawful to sell or offer for sale within the limits of Baytown any oysters, clams, scallops or other shellfish which have not beentaken from the waters under the jurisdiction of said state and approved by the proper authorities of said state, and under the regulations and permit of said State authorities, and of the United States Public Health Service, both as to preparation and packing for shipment, and shipment, and in so selling and offering for sale such marine products, it must be indicated either by certificate or otherwise, from such state authorities, that said marine product was taken from the waters packed and shipped as approved and required by said regulation. SECTION 2: THAT all the terms and provisions of the said Ordinance No. 36, passed by the City Council of the City of Baytown on the 20th day of January, 1949, are hereby continudd in full force and effect and any person violating any of the ® terms of the ordinance shall be subject to the penalties provided therein. SECTION 3: Effective Date. This ordinance shall take effect from and after ten days from its passage by the City Council. The City Clerk is hereby directed to give notice hereof by causing the caption of this ordinance to be published in the official newspaper of the City of Baytown at least twice prior to the effective date hereof.
