AE D=. qG AND COLLECTING SUCH FEE; PROVIDING FOR �.r=aM PENALTY OF $100 FOR VIOLATION AND FOR EFFECTIVE DATE HEREOF AND REPEALING ALL. PRIOR ORDINANCES AND MEND ENTS RELATING THEREOF", BEING ORDINANCE NO. 83, PASSED BY TIE CITY COUNCIL OF THE CITY OF BAYTOWN ON THE 17TH DAY OF AUGUST, 195o, BY AMENDING SECTION 4 THERDOF, AND PROVIDING FOR THE PUBLICATION AND LeFT CTIVE DATE OF THIS ORDINANCE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYT07;M: SECTION 1: THAT Section 4 of said Ordinance No. 83 shall be amended to read as follows: t'Section 4: Garbage and refuse shall be placed in metal containers of not more than 30 gallons capacity; each container shall be a water - -tight receptable and shall be provided with suitable handles on the outside and`with a tightly - fitting metal cover. In lieu of a metal cover, the following type canvas cover may be used: A canvas cover made of not less than 9 ounce canvas, properly water- proofed and mildewpproofed, and constructed with a rubber band encased in a loop of the cover so as to hold said cover tightly against the top of the container to • prevent cockroaches, flies, and other vermin from entering or leaving the garbage container. The canvas cover must have suitable fasteners or snaps for attaching to the handle of the garbage container so that it remains attached to the handle even when the cover is removed for emptying the container. The fasteners or snaps shall be of such design as to facilitate detachment from the handle for washing or cleaning. The container must not have any inside structures such as inside bands or anything within the container to prevent the free discharge of the contents.. The lids or covers of all containers shall at all timearbe kept secure and fastened so that flies and other insects may not have access to the contents thereof. SECTION 2: THAT all the terms and provisions of the said Ordinance No. 83, passed by the City Council of the City of Baytown on the 17th day of August, 1950, are hereby continued in full force and effect and any person violating any of the terms of the ordinance shall be subject to the penalties provided therein. SECTION 3: Effective Date. This ordinance shall take effect from and after ten days from its passage by the City Council. The City Clerk is hereby directed to give notice 0hereof by causing the caption of this ordinance to be published in the official newspaper of the City of Baytown at least twice prior to the effective date hereof.
