• AN ORDINANCE REGULATING THE 'RATES OF THE SOUTMESTERN ASSOCI-
ATED TELEPHONE CONTANY IN THE CITY OF BAYTOWN, TEXAS; PROVIDING
A REPEALING CLAUSE; PROVIDING A SAVINGS CLAUSE; AND PROVIDING
FOR THE PUBLICATION AND EFFECTIVE DATE THEREOF.
Y iEREAS, on the 14th day of February, 1952, Southwestern, Associated Telephone
Company made formal application to the City Council of the City of Baytown for an
increase in telephone rates, and
WHEREAS, the City Council was of the opinion, and is of the opinion, that it
is its duty to'set telephone rates that are fair to both the subscriber and to the
telephone company, and
WHEREAS, the City Council, during the last six (6) months, has made a very
definitive study of this application for an increase and has had many facts and
•figures presented to it on behalf of the City by Mr. Clinton Owsley, rate consultant,
and many of the City employees, including its City Controller and City Attorney, and
WHEREAS, a formal hearing was held by the City Council on July 15, 16 and 17
of 1952, during which time the Company and the City were allowed sufficient time
to present voluminous facts, figures and related data concerning the various aspects
of this utility and its application for a rate increase, including, among other
things, the following:
Southwestern Associated Telephone Company's system wide corporate structure,
including a study of its parent company and a subsidiary company owned by it and
other independent companies; a detailed study of the Baytown exchange; a study of
• the many financial ramifications of said utility, the recent expansion of Southwestern
Associated Telephone Company and its needs for further expansion; an economic study,
past and present, particularly as it effects said utility, and many other factors
which aided the City Council in arriving at fair telephone rates.
WHEREAS,, the formal hearing and public hearing have been closed and a full
study of the application has been fully and carefully considered by the Council, and
V11]EREAS, the City Council of the City of Baytown has prepared a schedule of
rates that will permit said Company to make a fair return on its investment and
at the same time be fair to the subscribers in the City of Baytown; NOW THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN:
• SECTION 1: THAT the Southwestern Associated Telephone Company, its successors
and assigns, is hereby authorized to place into effect on the August 21, 1952,
billing date, the following schedule of rates:

the rates set out in the Schedule of Miscellaneous Rates and
Charges for Dial Telephone Service listed below is also granted.

SECTION 2: That nothing in this ordinance contained shall be construed.as
in any manner, now or hereafter, limiting or modifying the right and power of the
City Council under the law to regulate the rates charged by the Southwestern Associated
Telephone Company, its successors or assigns, for its service within the City of
Baytown, Texas.
SECTION 3: Repealing Clause. All ordinances or parts of ordinances in-
consistent with the terms of this ordinance are hereby repealed; provided, however,
• that such repeal shall be only to the extent of such inconsistency, and in all
other respects this ordinance shall be cumulative of other ordinances regulating
and governing the subject matter covered by this ordinance.

SECTION 4: Savings Clause. If any provisions, exception, section, subsection,
• paragraph, sentence, clause or phrase of this ordinance or the application of same
to any person or set of circumstances shall for any reason be held unconstitutional,
void, or invalid, such invalidity shall not affect the validity of the remaining
provisions of this ordinance or their application to other persons or sets of
circumstances and to this end, all provisions of this ordinance are declared to
be severable.
SECTION 5: Effective date. This ordinance shall take-effect immediately from
and after its passage by the City Council. The City Clerk is hereby directed to
give notice hereof by causing the caption of this ordinance to be published in
the official newspaper of the City of Baytown at least twice within ten (10) days
after the passage of this ordinance.
