Ordinance No. 145ORDINANCE NO. 145 ANT ORDINANCE PROVIDING THAT ALL EMPLOYEES OF ALL DEPARTMENTS, EXCEPT THE DEPARTMENT OF LAW, INCLUDING THE CITY MANAGER, OF THE CITY OF BAYTOWN SHALL HEREBY AND HEREAFTER PARTICIPATE IN THE TEXAS MUNICIPAL RETIREMENT SYSTEM; PROVIDING FOR THE EFFECTIVE DATE HEREOF. WHEREAS, the Constitution of the State of Texas was amended on November 7, 1944, by the addition of Section 51 -f, Article III, which authorized the Leg- islature to establish a State -wide retirement and disability pension system for City employees; and WHEREAS, the 50th Legislature of the State of Texas enacted House Bill 29 by Parkhouse, known as The Texas Municipal Retirement System and being Article 6243h of Vernon's Annotated Civil Statutes, which authorizes the governing body • of each city or town to elect, at its option, to have one or more of the city departments participate in such system; and 1•1HEREAS, the City Council of the City of Baytown finds that it will be in the public interest for the City to have its employees participate in The Texas Municipal Retirement System; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN: Section 1: THAT the City Council of the City of Baytowndhereby elects to have all City employees of all departments, except the Department of Law, in- eluding the City Manager, to participate in the Texas Municipal Retirement System as provided for in Article 6243h of Vernon's Annotated Civil Statutes, and all the benefits and obligations of such system are hereby accepted. • Section 2: THAT the City Manager is hereby directed to notify the Board of Trustees of The Texas Municipal Retirement System that the City of Baytown, Texas, has elected to participate and have the employees of the following departments and offices participate in such System: City Manager, City Clerk, City Recorder, Fire Marshal, Technical Inspection, Finance, Police, Fire, Public Works, Health, Recreation, and Water. Section 3: THAT each person who becomes an employee of any participating depwt- meat on or after the effective date of participation of such department shall be included within and subject to the provisions of The Texas Municipal Retirement System beginning upon the date such person becomes an "employee" as defined in 0 subsection 14, Section 2 of such System. is Section 4: THAT the City of Baytown, Texas, may in the future refuse to add new departments or new employees to such System, but it shall never discontinue as to any participants. Section 5: THAT the City Clerk is hereby directed to remit to the Board of Trustees of The Texas lianicipal Retirement System, at its office in Austin, Texas, the City's proper contributions to the System and the amounts which shall be deducted from the compensation or payroll of employees, all as required by said Act creating said Retirement System. Section 6: THAT this ordinance shall take effect immediately upon its adoption by a majority of the City Council of the City of Baytown.
