Ordinance No. 136• ORDINANCE NO. _{, ® AN ORDINANCE ORDERING AN ELECTION TO BE HELD IN THE CITY OF BAYTOWN ON THE 1st DAY OF APRIL, 1952, FOR THE PURPOSE OF DETERMINING WHETHER THE CITY OF BAYTOWN SHALL ADOPT OR REJECT CIVIL SERVICE FOR FIREMEN AND POLICEMEN AS PROVIDED FOR IN ARTICLE 1269m OF VERNON'S REVISED CIVIL STATUTES, AS AMEND- ED: PROVIDING FOR ELECTION OFFICERS: DESIGNATING THE PLACES AND MANNER OF HOLDING SAID ELECTION: PRESCRIBING THE HOURS AND PROVIDING FOR THE POSTING AND PUBLICATION OF NOTICE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN: Section 1: THAT an election is hereby ordered to be held in said City of Baytown on the 1st day of April, 1952, for the purpose of determin- ing whether or not the Voters of the City of Baytown shall adopt or reject Civil Service for firemen and policemen as provided for in Article 1269m Y• of Vernon's Revised Civil Statutes, as amended. Section 2: THAT if at such election such Act of the-Texas Legislature is approved by the majority of the qualified voters voting at said election, the Council of the City of Baytown upon canvassing the returns shall so declare, and said Act of the Texas Legislature shall take effect in accordance with its terms. Section 3: THAT the aforementioned election shall be held in the City of Baytown on the above mentioned date between the hours of 7 o'clock A. M.." and 7 o'clock P. M., which is the same date as the regular municipal election of said City as provided for in Ordinance No. 134 of the City of Baytown, and that said City is hereby divided into election precincts and their • pblling places will be and election officials shall be, for the purpose of r1 U this election, as follows: Precinot No. Polling Place No. 99 Franta's Automobile Agency No. 100 Wilkenfeld's Frn. Hinton Assistant Judge Section 4: THAT this election shall be held in accordance with.and shall be governed by the election laws of the State of Texas. In all city elections the Mayor, City Clerk, or the governing body shall do and perform each act in other elections required to be done and performed respectively by the county judge, the county clerk, or the commissioner's court. The notice or proclamation of this and all other city elections shall be issued and posted at the polling places not later than 30 days before the date of said election. Section 5: THAT the form of the ballot for said election shall be substantially as follows: "OFFICIAL BALLOT" is SHALL ARTICLE 1269m, VERNON'S REVISED CIVIL STATUTES, AS AMENDED, PROVIDING FOR CIVIL SERVICE FOR FIREMEN AND POLICEMEN BE ADOPTED? FOR THE ADOPTION OF CIVIL SERVICE AGAINST THE ADOPTION OF CIVIL SERVICE THOSE desiring to vote for the adoption of Civil Service shall strike out the words 'Against the adoption of Civil Service', and those desiring to vote against the adoption of Civil Service shall strike out the words 'For the adoption of Civil Service'." Section 6: THAT a copy of this Ordinance signed by the Mayor of the City of Baytown, Texas, and attested by the City Clerk of the City shall serve as a proper Notice of the Election to be held as herein ordered on the 1st day of April, 1952,E The Mayor is authorized and directed to have said Notice of Election published in some newspaper of general circulation in said City, the date of such publication being not less than thirty (30) -2- full days prior to the date of said election. The Chief of Police shall be directed to post a properly executed copy of such notice at each polling ® place within the City. Said notice shall be posted not less than thirty (30) days before the said election.
