ORDINANCE NO. 119
AN ORDINANCE ORDERING AN ELECTION IN THE CITY OF
BAYTCINN, TEXAS, TO BE HELD ON THE 22ND DAY OF
® SEPTEMBER, 19511, FOR THE PURPOSE OF SUBMITTING
TO THE QUALIFIED VOTERS OF THE CITY OF BAYTOWN,
FOR ADOPTION OR REJECTION, CERTAIN PROPOSED ,
AMENDMENTS TO THE EXISTING CHARTER OF THE CITY OF
BAYTCff 1, DESIGNATING THE PLACES AND MANNER OF
HOLDING SAID ELECTION, APPOINTING THE ELECTION
OFFICIALS THEREOF, PRESCRIBING THE HOURS OF SAID
ELECTION AND PROVIDING FOR THE POSTING AND PUBx
LIGATION OF NOTICE OF SAID ELECTION.
JHEREAS, on the 24th day of May, 1951, a resolution was duly passed by the
City Council giving notice of its intention to pass an ordinance providing for
the submission to the. qualified voters of the City of Baytown, Texas, of pro-
posed amendments to the existing Charter of said City; and
'WHEREAS, notice of intention to submit such charter amendments was given by
publication in the Baytown Sun, the official newspaper of said City published in
said City, and which notice was published for twenty (20) days, the date of the
first publication thereof being not less than twenty (20) days next preceding the
date of this ordinance; and
VFHEREA.S, the City Council of the City of Baytown deems it proper to submit
the proposed amendments to the present City Charter to the qualified votensoof
said City; NOW, THEREFORE,
BE IT ORDAINCED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS:
Section 1: THAT a special election be held in the City of Baytown, Texas, on
the 22nd day of September, 1951, for the purpose of submitting to the qualified
voters of said City, for adoption or rejection, the following proposed amend-
ments to the existing Charter of the City of Baytown, Texas;

Members of the City Council shall receive such compensation as may be pro-
vided for by ordinance from time to time; provided, that the Mayor shall never
receive a salary in excess of Seventy-five ($75.00) Dollars per month, and that
each Councilman shall receive Ten ($10) Dollars per meeting, but not to exceed
Fifty ($50) -Dollars per month.
AMENDMENT NO. II.
The City Council of the City of Baytown is hereby given the full authority
to appoint, select, elect, hire or discharge any employee of the City of Baytown
whenever, in the opinion of the Council, such action would be beneficial to the
City.
AMENDMENT III.
All checks, vouchers or warrants for the withdrawal of;,money from the city
depository shall be signed by'the city treasurer of his deputy, and countersigned
• by the city manager and mayor. In the absence of the city manager, checks may be
countersigned.by the city clerk, and in the absence of the mayor, checks may be
countersigned by a councilman appointed by the mayor. At the first council meet-
ing after each fiscal quarter, the council shall make an inspection of at least
one month's invoices which have been paid by the city during the precedin quarter.

ees shall be first responsible to the head of the Department in which they are,
but they shall be subject to call by the Council at any time.
AMENDMENT N0. V.
The City Council is hereby given complete control, subject to the Statutes
and Constitution of Texas, and the provisions of these Amendments, over all tax
questions; it shall have power and authority to correct, alter, change, raise or
lower any valuations set up by the Equalization Board or member, at will, and
appoint others; or it may constitute the Council as Equalization Board, sitting
three members or more at a time, and shift when need requires.

The City Attorney and City Clerk shall beappointed by the City Council.
They shall be directly responsible to.the City Council and indirectly responsible
to the City Manager;,but they shall be subject to dismissal by the City Council
only.
AMENDMENT NO. VII.
The City Council shall approve all new members of the Police Department.
Section 2s THAT said special election shall be held between the hours of
seven o'clock a.m. and seven o'clock p.m. on the 22nd day of September, 1951.
Section 3. THAT said city is herebydivided into election precincts and their
polling places shall be and election officials shall be, for the purpose of this
election, as follows:

Section 4. THAT said election shall be held under the provisions of the general
laws of the State of Texas governing general elections,. and all persons qualified
to vote in said City under the laws of this state regulating general elections
shall be allowed to vote.
Section 5. THAT a condensed statement of the seven proposed amendments
shall be set forth on the ballots to be issued in the following language:

• The Mayor may be paid a salary not to exceed $75 per month, and each council-

AMENDMENT N0. II.
The City Council shall have full power to hire or fire any employee when
such action would benefit the City.
AMENDMENT NO. III.
All checks.and other instruments for the withdrawal of money shall be counter-
signed by the Mayor, and at the first Council meeting after each fiscal quarter,
the Council shall make an inspection of at least one month's invoices which
have been paid by the City during the prededing quarter.
AMENDMENT NO. IV.
All employees shall report to the Council as so requested, but employees under
department heads shall be first responsible to their respective department heads.
AMENDMENT NO. V.
• Subject to the Constitution and Statutes of the State of Texas, the council
shall have full and complete power over all tax matters, including the Board of
equalization, and the power to change any valuation set by said Board.
ANENDbiENT NO. VI.
The City Attorney and City Clerk shall be appointed by the City Council.
They shall be directly responsible to the City Council and indirectly responsible
to the City Manager; but they shall be'subject to dismissal by the City Council..
AMENDMENT N0. VII.
The City Council shall approve allnmw members of the Police Department.
Section 6. THAT the form of the ballot to be used shall be as follows:

Section 7. THAT the City Clerk is hereby directed to mail at once, and in
• no event later than the 15th day of August, 1951, a copy of the proposed amendments
to each and every qualified voter in the City of Baytown, as appears from the
tax collector's rolls for the year ending January 312 1951..
Section 8. THAT the City Clerk is hereby directed to cause this ordinance
to be published in the Baytown Sun once each week for four weeks, the date of
first publication being not less than thirty Aull days prior to the date of the
election; and such publication thereof shall constitute notice of said election
as required by law. The Clerk is further ordered to cause a notice or proclamation
of this election to be posted at each of the polling places not later than thirty
days before the date of said election. The Mayor is hereby directed to give further
• notice of said election by publishing a copy of the election proclamation and
notice in the Baytown Sun, said publication to be made not later than thirty (30)
full days prior to the date of said election.
Section 9. THAT each qualified voter who desires to cast an absentee vote
and who expects to be absent on the day of said election shall be entitled to
an official ballot and the right to cast such ballot in accordance with the provi-
sions of Article 2956, Vernon's Texas Statutes.
INTRODUCED, READ and PASSED by the affirmative vote of a majority of the entire
membership of the City Council of the City of Bftytown onthis 28th day of June, 1951..
