Ordinance No. 117ORDINANCE NO. ill AN ORDINANCE AMENDING AN ORDINANCE 'DEFINING TERMS; GRANTING TO C. Q. ALEXANDER, A FRANCHISE TO ESTABLISH, MAINTAIN AND OPERATE OVER THE STREETS OF THE CITY OF BAYTOtV1N, TEXAS, A BUS SYSTEM FOR LOCAL TRANSPORTATION OF PASSENGERS FOR HIRE; GRANTING SAID FRANCHISE FOR TWENTY FIVE (25) YEARS; PROVIDING FOR EXTENSION OF SAID FRANCHISE TO ANY TERRITORY ANNEXED IN THE FUTURE; ESTABLISHING PRO.CEDURE FOR DETERMINATION OF DEFINITE, ROUTES OVER AND UPON WHICH BUSES SHALL TRAVEL AND PROVIDING FOR CHANGING AND ALTERATION OF ROUTES AND ESTABLISHING DIFFERENT ROUTES OR ADDITIONAL ROUTES; PROVIDING TRIPPER SERVICE AND DEFINING SAID TERM AND ESTABLISHING RATE THEREFOR; PROVIDING REGULAR BUS STOPS ON CITY STREETS; ESTABLISHING RIGHT TOR RATES AND PROVIDING METHODS AND MEANS OF DETERMINING INHETHER RATES OF FARE SHALL BE INCREASED; PROVIDING FOR COMPENSATION TO BE PAID CITY UPON GROSS RECEIPTS AND METHOD OF INCREASE OR DECREASE OF SAID COMPENSATION, AND TIME OF PAYMENTS; REQUIRING GRANTEE TO KEEP BOOItS AND RECORDS AND CARRY PUBLIC LIABILITY AND PROPERTY DAMAGE INSURANCE; PROVIDING PROTECTION TO BUSINESS OF GRANTEE; PROVIDING THE RIGHT OF PURCHASE BY THE CITY OF THE PROPERTIES OF • SAIb GRANTEE AT EXPIRATION OF FRANCHISE, AND METHOD OF SAID PURCHASE AND MANNER OF DETERMINING PRICE; PROVIDING CONDITIONS OF PURCHASE AND RIGHT OF GRANTEE TO APPLY FOR EXTENSION OR NEW FRANCHISE; PROVIDII';G FOR TRANSFER AND SALE OF FRANCHISE; PROVIDING FOR FORFEITURE OF FRANCHISE; PROVIDING PROVISIONS OP CHARTER APPLICABLE TO FRANCHISE; PROVIDING A SAVINGS CLAUSE; PROVIDING TIME FOR TAKING . EFFECT OF FRANCHISE AND CONDITIONS THEREUNDER, 'BEING ORDINANCE NO. 62 PASSED BY THE CITY COUNCIL OF THE CITY OF BAYTO1.7N ON THE 18th DAY OF .00TOBER, 1949, by AMENDING THE FIRST PARAGRAPH OF SECTION EIGHT (8) THEREOF BY INCREASING THE REGULAR CASH FARE FROM TEN CENTS TO FIFTEEN CENTS, AND PROVIDING FOR THE PUBLICATION AND EFFECTIVE DINE OF THIS ORDINANCE. • • 0 V • BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN: SECTION 1: THAT the first paragraph of Section 8 of'said Ordinance No. 62 shall be amended and as- amended shall read as follows: "SECTION 8: FARES. Subject to the modification as here- inafter provided, the fares covering one (1) continuous ride between any of the points on routes herein specified or as hereafter provided, within the City Limits of Baytown, Texan, shall be as follows: KIND OF FARE RATE OF FARE Regular cash fare fifteen cents Children between the ages of five (5) and twelve (12)--other than fare of school children as hereinafter stated five cents Children under five ( 5 ) years of age when accompanied by a revenue passen- ger free Firemen and policemen, as herein- after provided free School children (subject to the con- ditions hereinafter named, and when traveling to and from school on school days) five cents free transfer" SECTION 2: THAT all the terms and provisions of the said Ordinance No. 62 passed by the City. Council of the City of Baytown on the 18th day of October, 1949, are hereby continued in full force and effect and any person violating any of the terms of the ordinance shall be subject to'the penalties provided therein. SECTION 3: Effective Date. This ordinance shall take ef - feet immediately after an affirmative vote by the majority of the City Council of the City of Baytown.
