ORDINANCE NO. 106
AN ORDINANCE ACCEPTING THE AGREEMENT WITH THE COID.4UNITY
FACILITIES SERVICE, HOUSING AND HOME FINANCE AGENCY FOR
AN ADVANCE FOR PLANNING OF STORM SEWER IMPROVEMENTS, PRO-
JECT NO. TEX. 41 -P- 1016,. UNDER THE PROVISIONS OF PUBLIC
LAW 352, 81ST CONGRESS OF THE UNITED STATES, APFROVED
OCTOBER 13, 1919, AND AUTHORIZING THE MAYOR TO EXECUTE
DOCUMENTS EVIDENCING SUCH ACCEPTANCE AND REQUESTING
FUNDS; AND PROVIDING FOR THE EFFECTIVE DATE HEREOF.
WHEREAS, on the 26th day of September, 1950, there was filed -with the Commu-
nity Facilities Service, Housing and Home Finance Agency, in behalf of the City
of Baytown, Texas, (herein called the "Applicant "), an application for an advance
under the provisions of Public law 352, 81st Congress, and the UNITED STATES OF
AMERICA, acting by and through the Division Engineer, Division 6, Community Faci-
lities Service, has transmitted to the Applicant for acceptance an Agreement for
Public Works Plan Preparation, Dated January 18, 1951, in connection with the Pro-
ject referred to in said application and generally described in said Agreement;
and
W[1EREAS, said Agreement has been duly read in open meeting, fully considered
in accordance with all pertinent rules of procedure and legal requirements, and
made a part of the Applicant's public records; and
WHEREAS) it is deemed advisable and in the public interest that said Agree-
ment be accepted;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN:
That the said Agreement, a true and correct copy of which, including the Terms
and Conditions, dated December 18, 1950, is hereto attached, be and the same hereby
is accepted without reservation or qualification, and that Mr. J. A. Ward, Mayor,
be hereby authorized to execute documents evidencing such acceptance and requesting
funds.
That this ordinance is to take effect immediately upon passage by a majority
of the City Council of the City of Baytown.
INTRODUCED, READ and PASSED by the affirmative vote of a majority of the City
Council of the City of Baytown on this 22nd day of January, A. D., 1951.
