Ordinance No. 99�4 ORDINANCE NO. AN ORDINANCE ENLARGING AND EXTENDING THE BOUNDARY LIMITS OF THE CITY OF BAYTOWN, TEXAS, AND ANNEXING ADDITIONAL ADJACENT TERRITORY TO SAID CITY, ALL OF WHICH IS DESCRIBED IN THE ORDINANCE; CONTAINING SAVINGS CLAUSE,, AND PROVIDING FOR THE PUBLICATION AND PASSAGE OF THIS ORDINANCE IN THE MANNER PRO - VIDED IN ARTICLE I, SECTION 9 OF THE CHARTER OF THE CITY OF BAYTOWN. BE IT ORDAINED BY THE CITY COUNCIL OF THE C ITY OF BAYT071N: SECTION 1. - Intent and Purpose of the Ordinance. The City Council of the City of Baytown, acting pursuant to Section 9 of Article I of. the Charter of said city, hereby declares that it is necessary that the hereinafter described territory lying adjacent to the city be annexed and the existing boundary limits of-the city be ex- tended to include such territory. The purpose and intent of this extension of the boundary limits of the City of Baytown is to take care of said city's present needs. for additional territory and the reasonably anticipated future growth and expansion of the city. SECTION 2. That the boundary limits of the City of Baytown, Texas be enlarged and extended as hereinafter set out so as to include within, the boundary limits of said city all that territory lying adjacent to said city within the following de- scribed lines, to -wit: Area Number One (1) Beginning at the .point of intersection of the south right of way of Baker Road; and the West shore line of Goose Creek Stream; in the Harvey Whiting League; Harris County,- Texas;'and said point being a point described in Ordinance No 69 of the City of Baytown, Harris County, Texas: Thence with the south line Baker Road; westerly to a point in the south line of Baker Road; , said point being the point of curvature in the south line Baker Road: Thence southwesterly with the southeasterly line of Baker Road to a point being the point of curvature of a curve to the right described by the south and southeasterly line of said Baker Road: Thence westerly with the south line of Baker Road; over and across Houston North Shore Railroad right of way; past the west line of Harvey Whiting Survey and along the north line of Steinman Addition to the east line of Market Street Road: Thence continuing on a line over and across Market Street road; said line being the projection of the south line Baker Road; projected over and across Market Street road to the west line of Market Street Road: Thence North 00 degrees 15' west; with the west line of Market Street road to the point of intersection of the west line of Market Street road and the south line of 50' right of way in easement to the Humble Oil and Refining Co; and Humble Pipe Line Co., ThenceT54 degrees 29' west; along the south line of Humble Oil Co. pipe line easement a distance of 105.1' to point in the south line of said easement. Thence continuing on south line of said easement bearing north 54 degrees 27' west; past the point of intersection of the south line L P Garrett 32.09 acre tract; and continuing along said south line of said pipe line easement across Garrett 70.93 acre tract to the point of intersection of said south line of Pipe Line Easement and the south line of 30' county drainage ditch. Thence south 75 degrees 31' west; with the south line 30' county drainage ditch to the southwest corner of 30' county drainage ditch right of way. r c c: Thence with the south line of drainage ditch with its meanders to the point of con- fluence of said south line drainage ditch and the east shore line at high tide of Burnett Bay. Thence to the right; in a northerly direction with the meander line of Burnett Bay shore line at high tide; to point of intersection with the center line of Spring Gully. Thence Westerly and southerly; with the north and north westerly shore line meander line of Burnett Bay; at high tide; to the point of intersection of said meander line of Burnett Bay shore line at high tide with the north easterly line of 2500' Port Houston reserve measured at right ang4s to the centerline of Houston Ship Channel and sometimes - referred to as Buffalo Bayou or San Jacinto River. Thence continuing along said northerly line of 2500' Port Commission Right of Way measured at right ang4is to the centerline of Houston Ship Channel; northerly and westerly to the point of intersection of said 2500' Port Commission Right of Way and the east bank of San Jacinto River. Thence to the right; upstream with the east bank of San Jacinto River; passing a county road known as Market Street Road; continuing northerly upstream with the east bank of said San Jacinto River to the point of intersection of said east bank San Jacinto River and the North line of George White Survey; Abstract No 82 Harris County, Texas. Thence easterly; with the north line Barbers Hill Road passing over aid across Garth Road; to the point of intersection of the north line Barbers Hill Road and the South westerly line of Crosby Cedar Bayou Road. Thence North 80 degrees 30' east; along said north line Barbers Hill Road; passing Sjolander Homestead; passing Crosby Cedar Bayou Road and continuing along said north line Barbers Hill Road to the point of intersection of said north line Barbers Hill Road and the west bank of a stream known as Cedar Bayou. Thence to the right; and down stream with the west bank of said Cedar Bayou stream passing Morgan's Bend; passing the southeast-corner Donnelly 82 acre tract; passing the Northwest and south right of ways of Dayton Goose Creek Railroad; now a subsidiary of the Southern Pacific Railroad; passing Needle Point; passing the north and south lines of McGee Gully; passing Milam Bend; to the northwesterly line of State Highway 146 in Harris County, Texas.. D. 1940; which said ordinance is of record in the Book of Minutes of said city, Volume C, Pages 220 et deq. the same being the southeast corner of the C. F. Jones 10 acre tract of land in the Harvey Whiting Survey; and being Station "0 "; Thence continuing along the southerly boundary line of the Harvey Whiting Survey; in an easterly direction to the southeast corner of the said Harvey Whiting Survey; for corner, and being point No. 1. Thence in a northerly direction along the easterly boundary line of the said Harvey Whiting Survey; to the point of intersection of said line with the southerly line of the Mrs. A. S. Thence in a northerly direction along the east right of way lineof Tri -City Beach Road to the point of intersection of said line with the south right of way line of East Texas Avenue Extension, for corner, and being.point 10 of the present city limits. Thence in an easterly direction, along the south right of way line of East Texas Avenue Extension, to the point of intersection of said line with the west line of Roseland Park, out of the Rosa.Kilgore tract of land, for corner and being point 11 of the present city limits. Thence in a southerly direction, along the westerly boundary line of Roseland Park and along the arc of a curve to the left; for a distance of 954.55' more or lees, to the point of ending of said curve, for corner and being point 12 of the present city limits. Thence in a southerly direction, continuing along the. westerly boundary line of Roseland Park and along the arc of a curve, to the right for a distance of 210.1' more or less to the point of ending of said curve, for corner and being point No. 13, of the present city limits. Thence South 19 degrees Vilest, along the said westerly boundary line of Roseland Park a distance of 198.251 more or less, to the point of intersection of said line (� with the south boundary line of the said Mrs. Rose Kilgore tract of land, for cor- ner and being point 14 of the present limits. Thence to the right and northerly with the Easterly shore line of Ash Lake-:'-to a turn in said shore line to the left for corner. Thence Southerly; and westerly, with the shore line of Ash Lake, and continuing along said shore line to the point of intersection of said shore line with the north, line of Tri -City Beach Road. Thence continuing along said shore line; passing the south line Tri -City Beach Road; and continuing along said shore line to the point of confluence of said west shore line with the East shore line of San Jacinto Bay. Thence to the right; northerly with the shore line of San Jacinto Bay; to point in shore line to the left. Refining Company; and being the west line Busch Estate; to the point of intersection of said line with the eoutheesterly line of Decker Drive. Thence to the right; with the southwesterly line Decker Drive; southeasterly with said line passing the port of entry of Airhart Drive and continuing to the point of intersection of said southwesterly line Decker Drive and the north line Woodruff Ave. and being the point of beginning. SECTION 3. That the above described additional territory and area so annexed shall be a part of the City of Baytown, and the property so added to said city shall bear its pro rata part of the taxes levied by the City of Baytown and the inhabitants thereof shall be entitled to all the rights and privileges of al 1 the citizens and shall be bound by the acts, ordinances, resolutions, regulations and provisions of the Charter of the City of Baytown. SECTION 4. That if any portion or portions of the above described territory is validly included witim the territory limits of another city or town, then such portion or portions of the above described territory is hereby excluded and the re- maining territory is hereby annexed to the City of Baytown; and the boundary limits of said city are hereby amended to conform to the boundary limits of such other city or town or such other cities or towns along the area of the conflict. SECTION 5. That if any portion or portions of the above described territory �. legally may become included within the limits of mother city or town, by reason of a valid annexation ordinance heretofore introduced before the council, commission or other governing body of such city or town, -then such portion or portions of the above described territory is hereby excluded from the limits of the City of Baytown and the remaining territory is hereby annexed to the City of Bayto�u-i and the bound- ary limits of said City of Baytown are hereby amended to conform to the boundary limits of such other city or town or such other cities or towns along the area of the conflict. SECTION 6. That if a-iy legal impediment exists preventing the valid annexation of any portion of the above described territory to the City of Baytown, then such portion of the above described territory is hereby excluded and the remaining terri- tory is hereby annexed to the City of Baytown and the boundary limits of said City of Baytown are hereby amended to conform to the territory so annexed. SECTION 7. If any provision, exception, section, paragraph, sentence, clause, or phrase of this ordinance or the application of same to any person or set of cir- c cumstances or to any particular tract or parcel'of land, shall for any reason be held unconstitutional, void, or inavlid, such-invalidity shall not affect the validity of the remaining provisions of this ordinance or their application to other persons or.sets of circumstances or to other tracts ar parcels of land in- cluded in the territory hereinabove described in Section 2 of this ordinance. SECTION 8. That this ordinance upon and after its introduction shall be published and finally acted upon in the manner provided in Article I, Section 9 of the Charter of the City of Baytown.
