AN ORDINANCE REGULATING LIVESTOCK SLAUGHTER HOUSES AND
STAUGHTERING PENS WITHIN THE CITY LIMITS OF THE CITY
OF BAYTOWN, TEXAS; REPEALING ORDINANCES INCONSISTENT-

PENALTY; AND PROVIDING FOR THE PUBLICATION AND THE
EFFECTIVE DATE HEREOF.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN:
THAT livestock slaughter houses and slaughter pens within the City of Baytown
shall hereby be regulated as follows:
Section 1: No Livestock to be kept at Night. THAT it shall be unlawful for
any person to suffer any livestock, for the purpose of slaughter, to remain on or
near any livestock slaughter house or slaughter pen or anywhere else within the
City of Baytown at night between the hours of sunset and sunrise; and, during the
® day, that livestock shall not remain loaded, or otherwise, near any slaughter house
or slaughter pen longer than is reasonably necessary to place said livestock within
such slaughter house or slaughter pen.
Section 2: Sound -proof Enclosures. THAT each slaughter house or slaughter
pen shall have a sound -proof room; all livestock shall be slaughtered in said room,
and any and all openings into said room shall be firmly closed during said slaughter;
provided further, that sound -proof enclosures shall be maintained for livestock that
is awaiting slaughter during the day.
Section 3: Loud Noises. THAT no person shall keep, care for, or handle live-
stock in or near any slaughter house or slaughter pen in such a manner as to create
unreasonably loud, disturbing and unnecessary noises.
Section 4: Sanitation. THAT all blood and refuse from any slaughtered live-
stock shall be removed from each slaughter house and slaughter pen no less often
than once each twenty -four (24) hours, and the-entire premises of each slaughter
house and slaughter pen shall be maintained in such a manner as to not endanger the
public health; and provided further that no blood or other substance arising as a
consequence of any slaughter of livestock shall be kept in the open, but the same
shall be kept in leak -proof containers, said containers being fitted with tight
lids, and said containers shall be kept in enclosures that are screened so as to
prevent the gathering of flies and other insects.
Section 5: Present Operators. THAT any person that is now operating a
slaughter house and /or slaughter pen shall have ninety (90) days in which to con. -'-
struct sound proof retaining enclosures as required in the latter part of Section 2
above, of this ordinance.

Section 6: Definitions. THAT the term "livestock" shall be held to mean and
include any cattle, sheep, goats or swine.
THAT the term "person" shall include and comprehend any person,-association
of persons, firm, corporation, or any combination of these, their agents, servants,
or employees.
Section 7: Repealing Clause. All ordinances or parts of ordinances inconsist-
ent with the terms of this ordinance are hereby repealed; - provided, however, that
such repeal shall be only to the extent of such inconsistency, and in all other
respects this ordinance shall be cumulative of other ordinances regulating and go-
verning the subject matter covered by this ordinance.
Section 8: Savings Clause. if any provision, exception, section, subsection,
paragraph, sentence, clause or phrase of this ordinance or the application of same
to any person or set of circumstances shall for any reason be held unconstitutional,
void, or invalid, such invalidity shall not affect the validity of the remaining
provisions of this ordinance or their application to other persons or sets of
circumstances and to this end, all provisions.of this ordinance are declared.to be
severable.
Section 9.. Penalty. Any person who shall violate any provision or provisions
of this ordinance shall be deemed guilty of a misdemeanor and upon conviction shall
be punished by a fine of not more than One Hundred Dollars ($100.00). Each day's
violation shall constitute a separate offense.
Section 10: Effective Date. This ordinance shall take effect from and after
ten (10) days from its passage_by the City Council. The City Clerk is hereby
directed to give notice hereof by causing the caption of this ordinance to be
published in the official newspaper' of the City of Baytown at least twice within
ten (10) days after the passage of this ordinance.
INTRODUCED, READ and PASSED by the affirmative vote of a majority of the :City
Council of the City of Baytown on this 16th day off October, 1950.
