ORDINANCE NO. 92
AN ORDINANCE REGULATING THE KEEPING OF DOGS WITHIN
THE CITY OF BAYTOWN, TEXAS; REPEALING ORDINANCES
INCONSISTENT HEREWITH; CONTAINING A SAVINGS CLAUSE;
PRESCRIBING A PENALTY; AND PROVIDING FOR THE PUBLI-
CAT ION AND THE EFFECTIVE DATE HEREOF.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN:
Section 1: THAT it shall be unlawful for any person, firm, or corporation
Ll- to suffer a dog to run loose anywhere within the city limits of the City of
Baytown.
Section 2-: THAT all owners of dogs shall keep said dogs secured upon the
premises of said owner either by means of a leash, rope, or similar device, or
that a fence of a substantial nature shall be maintained for this purpose. Pro-
vided, however, that dogs may be taken on the public streets and alleys if said
• dogs are kept on a leash, rope, or similar device, and kept under the control of
the owner thereof or one acting with the consent of said owner.
Section 3 THAT the Chief of Police of the City of Baytown is hereby di-
rected and authorized to take into his custody and ippound any and all dogs found
loose within the City of Baytown.
Section 4: THAT this ordinance shall be effective for only Forty-Five (45)
Days from and after the effective date hereof.
Section 5: Repealing_ Clause. All ordinances or parts of ordinances in-
consistent with the terms of this ordinance are hereby repealed; provided how-
ever, that such repeal shall be only to the extent of such inconsistency, and
® in all other respects this ordinance shall be cumulative of other ordinances
regulating and governing the subject matter covered by this ordinance.
Section 6: Savings Clause. If any provision, exception, section, sub-
section, paragraph, sentence, clause or phrase of this ordinance or the appli-
cation of same to any person or set of circumstances shall for any reason be
held unconstitutional, void, or invalid, such invalidity shall not affect the
validity of the remaining provisions of this ordinance or their application
to other persons or sets of circumstances and to this end, all provisions of
this ordinance are declared to be severable.
Section 7: Penalty. Any person who shall violate any provision or pro-
visions of this ordinance shall be deemed guilty of a misdemeanor and upon
• conviction shall be puhished by a fine of not more than One Hundred Dollars
($100.00). Each day's violation shall constitute a separate offense.
Section 8: Effective Date. This ordinance shall take effect from and
• after ten (10) days from its passage by the City Council. The City Clerk is
hereby directed to give notice hereof by causing the caption of this ordinance
to be published in the official newspaper of the City of Baytown at least twice
within ten (10) days after the passage of this ordinance.
INTRODUCED, READ, and PASSED by the affirmative vote of a majority of
the City Council of the City of Baytown on this 26th day of September, 1950.
