AN ORDINANCE CANCELLING AND VACATING PUBLIC UTILITY
EASEMENTS CREATED IN DEDICATION OF THE NORTH PART,
OF BLOCK'13 AND WEST HALF OF BLOCK 17 OF THE AMELIA
Z. AIRHART ADDITION TO BAYTOWN IN THE WILLIAM SCOTT
UPPER LEAGUE, HARRIS COUNTY, TEKAS, INSOFAR AS SAID
EASEMENTS AFFECT A PORTION OF LOM7 AND 28 IN SAT!}
BLOCK 13.
17HERFAS, on August 151 1939, by an instrument recorded in Volume 998, Page 598,
of the bged Records of Harris County, Amelia Z. Airhart did file for record a plat
of the north part of Block 13 and the viest half of Block 17 of the Amelia Z. Airhart
Addition to Baytown in the William Scott Upper League, Harris County, Texas, and in
said plat did create a four -foot public utility easement off of the west end of Lots
7 to 16 inclusive of said Block 13 and a four -foot public utility easement off of
the east end of Lots 19 to 28 inclusive of said block, reference being made to said
! plat for all necessary purposes; and
M EREAS, that portion of the said public utility easements lying and being si-
tuated in Lots 7 and 28 is not now and never has been used for public utility purposes
and an investigation of the facts reveals that there is no intention on the part of
the mvners or operators of public utilities in the city to use such portion of ease-
ments in the future; and
WEREAS, there is no longer any need for such easement on Lot 7 and 28 to exist;
that such easement is hampering the development of said lots, and cancellation and
vacation of the same will: encourage such development, tend to increase the tax valua-
tions of the city and be in the interest of the public welfare;
® NOW, THEREFORE, BE TT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOIrVN:
SECTION 1: THAT the four -foot public utility easements created in said plat
filed for record in Volume 998, Page 598 of the Deed Records of Harris County be and
the same are hereby cancelled and vacated insofar as the same pertains to and affects
the west four (4) feet of Lot 7 and east four (4) feet of Lot 28 in Block 13.
INTRODUCED, READ and PASSED by a majority of the City Council of the City of Bay-
town on this � day of March, 1950.
