Ordinance No. 69C� ORDINANCE No. 69 AN ORDINANCE ENLARGING AND EXTENDING THE BOUNDARY LIMITS OF THE CITY OF BAYT90, TEXAS, AND ANNEXING ADDITIONAL ADJACENT TERRITORY TO SAID CITY, ALL OF WHICH IS DESCRIBED IN THE ORDINANCE;. CONTAINING SAVINGS CIAUSE, AND PROVIDING FOR THE PUBLICATION AMID PASSAGE OF THIS ORDINANCE IN THE MANNER PRO- VIDED IN ARTICLE I, SECTION 9 OF THE CHARTER OF THE CITY . OF BAYT OWN. BE IT GAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN: SECTION 1. Intent and Purpose of the Ordinance. The City Council of the City of Baytovrn; acting pursuant to Section 9 of Article I of the Charter of said city, hereby declares that it is necessary that the hereinafter described territory lying adjacent to the city be annexed and the existing boundary limits of the city be ex- tended to include such territory. The purpose and intent of this extension of the boundary limits of the City of Baytown is to take care of said cityls.present needs for additional territory and the reasonably anticipated future growth and expansion of the city. SECTION 2. That the boundary limits of the City of Baytown, Texas be enlarged and extended as hereinafter set out so as to include -within the boundary limits of said city all that territory lying adjacent to said city within the following de- scribed lines, to-Wit BEGINNING at the point of intersection of the easterly line of Bay Villa Sub- division in the Wm. Scott Upper League, and the north easterly shore of Scott Ts Bay, said point of intersection being situated south 31 degrees 461 460.9 feet west from the northeast corner of Bay Villa Addition, being situated in the south- westerly right of Sway of Market Street Road; THENCE north 31 degrees 461 east along east line Bay Villa Subdivision 460.9 feet to the southwesterly line Market Street Road; THENCE with the southerly line of Market Street Road along the northeasterly line Bay Villa north 13 degrees 101 west 100.1 feet, north 17 degrees 081 west 100 feet, north 21 degrees 281 west 100.2'feet, north 26 degrees 201 west 99.7 feet, north 29 degrees 381 west 641.9 -feet, north 29 degrees 431 west 342.9 -feet, north 3� degrees 041 viest 156.9 feet, north 3'4 degrees 471.west 100 feet, north 36 degrees 061 west 100f ,t. north 38 degrees 04, west 111.6 feet to point being the point of intersection of Wept line Humble Oil &- Refining Company projected and the southwesterly line of Market Street Road; THENCE north 20 degrees 441 east; over and across Market Street Road; 114.4 feet to the northeasterly line Market Street Road; THENCE north 21 degrees 031 east along the west line Humble Oil & Refining Co. over and across Cedar Bayou- Yfooster County Road to a distance of 536.9 feet to the north line -said Cedar Bayou - Wooster Road and being the southeast corner Sweeney Addition; THENCE north 21 degrees 071 east along the east line &- teeny Addition a distance of 2660 feet to corner, being the southwesterly corner of Steinman Tract, also known as C. A. Fortner 38 acres; ® THENCE south 88 degrees 59' east along the south line Steinman Tract a distance of 201.43 feet to corner, being the southeasterly corner Steinman Tract; THENCE with the east line Steinman Tract north 21 degrees 101 east 1080.1 feet, north 00 degrees 40, west 1583.92 feet to the northeast corner Steinman Tract, being the north line M. Scott Upper League over and across Decker Drive to a total distance of 4148 feet to the southwesterly bank of Goose Creek Stream; THENCE northerly and being upstream with the meanders of the west bank of Goose Creek Stream to the point of intersection of the west bank of Goose Creek Stream and the south line of Baiter Road, in the Harvey Whiting Survey, Harris County, Texas; THENCE vrith the south line of Baker Road westerly to a point in the south line of Baker Road, said point being the point of curvature in the south line of Baker Road,, said curve bearing to the left;, THENCE southwesterly with the southeasterly line of Baker Road to a point being the point of curvature of a curve to the right described by the south and south- easterly line of said Baker Road; THENCE westerly with the south line of Baker Road over and across Houston North Shore Railroad right -of -ray, past the west line of Harvey 1Nhiting Survey and along the north line of ":Steinman Addition" to the east line of Market Street Road; THENCE continuing on a line over and across-Market Street road said line being. the projection of the south line of Baker Road projected over and across Market Street Road to the west line of Market Street Road; THENCE north 00 degrees 15' west with the west line of Market Street Road to the point of intersection of the west line of P�hrket Street Road and the south line of 50 feet right -of- =ray in easement to the Humble Oil and Refining Co. and Humble Pipe Line Co.; THENCE north 54 degrees 291 west along the south line of Humble Oil Co. pipe line easement a distance of 105.1 feet to point in south line of said easement; THENCE continuing on south line of said easement bearing north 54 degrees 271 west past the point of intersection of the south line of L. P. Garrett 32.09 acres, past the north line of L. P. Garrett 32.09 acres and continuing along said south line of said pipe line easement across L. P. Garrett 70.93 acres7to the point of intersection of said south line of Pipe. Line Easement and the south line of 3.0'ft . Harris County drainage ditch; ® THENCE south 75 degrees 211 west with the south line 30 ft. county drainage ditch to the southwest corner of 30 ft. Harris County drainage ditch right- of-way; THENCE with the south line of drainage ditch with its meanders to the point of confluence of said south line drainage ditch and the east shore line at high tide of Burnett Bay; THENCE southerly with the mean high tide line of the east shore line of Burnett Bay past the point of intersection of said shore line and the north line of Tharp 65 acre tract continuing along said shore line to the point of intersection of said shore line and the south bank of Fresh Water Bayou; THENCE with the high tide line of Burnett Bay easterly shore line from the mouth of Fresh Water Bayou to the northwest corner of Block "Bn of Brownwood Sub- division in the Nathaniel Iynch Survey, Harris County, Texas; THENCE in a southerly and westerly direction along the west line of Block "BI' of Brownwood Subdivision in the Nathaniel Lynch Survey, Harris County, Texas to.t he southwest corner of Block MIAMI in said Brarmwood Subdivision, said southwest corner of Block I'AA" situated in the.northerly shore line of Crystal Bay, sometimes ref?rred • to as Crystal hake; THENCE in an easterly direction along the northerly shore of Crystal Bay line at mean high tide to the northwest corner of Block "All of aforesaid Brownwood Addition; THENCE continuing in a southerly direction along the easterly shore line of Crystal Bay to a line which is 2500 feet easterly at right angles from and parallel to the center line of the Houston Ship Channel; -2- THENCE in a southeasterly direction along a line which is 2500 feet easterly at right angles from and parallel to the center line of the Houston Ship Channel to the intersection of said line with the south line or extension thereof of Block "Ku. of the town of Wooster; THENCE in a northeasterlyudjr ection along the south line of Block 11K" to the southeast corner of Lot 9 in said Block I'Kfl; THENCE southeasterly along., the west line of Lot 10, Block I'M in the town of M oster to the southwest corner of said Lot 10 which point is located on the north- erly shore of Scott Bay at mean high tide; THENCE northeast along said north shore line Scott's Bay at mean high tide to the intersection of said shore line with the west line of the James Strange Survey; THENCE continuing along aforesaid Scott's Bay shore line at mean high tide past the southwest corner of Bay Villa Subdivision and Continuing along the said shore line to the southeast corner of Bay Villa Subdivision and being the point of beginning; SECTION 3• That the above described additional territory and area so annexed shall be a part-of the City of Baytown, and the property so added to said city shall bear its pro rata part of the taxes levied by the City. of Baytown and the inhabitants thereof shall be entitled to all the rights and privileges of all the citizens and shall be bound by the acts, ordinances, resolutions, regulations and provisions of the Charter of the City of Baytown. _.SECTION 4. That if any portion or portions of the above described territory is validly included within the territory limits of another city or town, then such portion or portions of the above described territory is hereby excluded and the re- maining territory is hereby annexed to the City of Baytown, and the boundary limits of said city are hereby amended to conform to the boundary limits of such other city _or town or such other cities or towns along the area of the conflict. SECTION 5. That if any portion or portions of the above described territory • legally may become included within the limits of another city or town, by reason of a valid annexation ordinance heretofore introduced before the council, commission or other governing body of such city or town, then such portion or portions of the above described territory is hereby excluded from the limits of the City of Baytown and the remaining territory is hereby annexed to the City of Baytown and the boundary limits of said City of Bayt oym are hereby amended to conform to the boundary limits of such other city or town or such other cities or towns along the area of the conflict. SECTION 6. That if any legal impediment exists preventing the valid annexation of any portion of the above described territory to the City of Baytown, then such portion of the above described territory is hereby excluded and the remaining terri- tory is hereby annexed to the City of Baytown and the boundary limits of said City • of Bayt mvn are hereby amended to conform to the territory so annexed. SECTION 7. If any provision, exception, section; paragraph, sentence, clause, or phrase of this ordinance or the application of same to any person or set of cir- cumstances or to any particular tract or parcel of land, shall for any reason be held -3- unconstitutional, void or invalid, such invalidity shall not affect the validity of the remaining provisions of this ordinance or their application to other persons or ® sets of circumstances or to other tracts or parcels of land included in the territory hereinabcve described in Section 2 of this ordinance. SECTION 8. That this ordinance upon and after its introduction shall be published and finally acted upon in the manner provided in Article I, Section 9 of the Charter of the City of Baytown. .INTRODUCED., READ, and PASSED by the affirmative vote of a majority of the City Council of the City of Baytown on this the ,10 'g day of December, A.
