WHEREAS, on: the 18th day., of October; A -. D., 1949, the City Council of the City of Baytown, passed on third and final reading an ordinance captioned as follows: DEFINING TERMS: GRANTING TO C. Q. ALEXANDER A FRANCHISE TO ESTABLISH MAINTAIN AND OPERATE OVER THE STREETS OF THE CITY OF BAYTOWN, TEXAS, A BUS SYSTEM FOR LOCAL TRANSPORTATION OF PASSENGERS FOR-HIRE: GRANTING SAID FRANCHISE FOR T14ENTY FIVE .(25) YEARS: .PROVIDING FOR EXTENSION OF SAID FRANCHISE TO ANY TERRITORY ANNEXED IN THE FUTURE: ESTABLISHING PROCEDURE FOR DETERMINATION OF DEFINITE ROUTES OVER AND UPON WHICH BUSSES SHALL TRAVEL AND PROVIDING FOR CHANQ,ING AND ALTERATION OF ROUTES AND ESTABLISHING DIFFERENT ROUTES OR ADDITIONAL ROUTES: PROVIDING TRIPPER SERVICE AND DEFINING SAID TERM AND ESTABLISH- ING RATES THEREFOR: PROVIDING REGULAR BUS STOPS ON J CITY STREETS: ESTABLISHING RIGHT FOR RATES AND PROVIDING _METHODS AND :TANS OF DETERMINING WHETHER - -` C RATES OF FARE SHALL BE INCREASED: PROVIDING FOR COMPENSATION TO BE PAID CITY UPON GROSS RECEIPTS AND METHOD OF INCREASE OR DECREASE OF SAID COMPENSATION, AND TIME OF PAYMENT: REQUIRING GRANTEE TO KEEP BOOKS AND RECORDS AND CARRY PUBLIC LIABILITY AND PROPERTY DAMAGE INSURANCE: PROVIDING PROTECTION TO BUSINESS OF GRANTEE: PROVIDING THE RIGHT OF PURCHASE BY THE CITY OF THE PROPERTIES'OF SAID GRANTEE AT EXPIRATION'OF FRANCHISE, AND METHOD OF SAID PURCHASE ® AND MANNER OF DETERMINING PRICE: PROVIDING CONDITIONS OF.PURCHASE AND RIGHT OF GRANTEE TO APPLY FOR EXTENSION OR NEW FRANCHISE: PROVIDING FOR TRANSFER AND SALE OF FRANCHISE: PROVIDING FOR .FORFEITURE OF FRANCHISE: PROVIDING A SAVINGS CLAUSE: PROVIDING TIME FOR TAKING EFFECT OF,FRANCHISE, AND CONDITIONS THEREUNDER; and, %iHEREAS, it is provided in Section 13 of said ordinance that "This grant shall not be sold, transferred or assigned by'the Grantee exc.ept with the consent of the City Council such consent and approval to be evidenced by ordinance_adopted by said City Council" and WHEREAS, the system franchise gr the said Grantee is of'the City Council said C. Q. Alexander" is Grantee of the bus anted by the above- referred to ordinance, and desirous of securing the consent-and approval of the City of Baytown to sell, transfer and a'ssign'the said franchise.to Tunnel-Transit Co., Inc., a corporation, and said Grantee has requested the •City Council of the City.of Baytown. to give its consent and approval of such sale, .transfer and assignment.. Grantee in 'the4 Above referred to ordinance is hereby authorized to sell, transfer and assign the bus system franchise granted to said Grantee by the. above referred to ordinance to Tunnel .Transit.Co., Inc.,'-a-private. corpor- ation, incorporated under the lays of the State of Texas, and the ". ® City Council of the -City of Baytown does hereby consent to such sale, transfer and assignment'and such sale, transfer and assign- ment is hereby approved by the City Council of the City of Baytown. ALEXANDER FOR A BUS LINE FRANCHISE AND ANY AND ALL NECESSARY AUTHORITY FROM THE CITY OF BAYTOWN TO OPERATE BUSES FOR COMPENSATION IN LOCAL TRANSPORTATION SERVICE OVER STREETS WITHIN THE CITY OF BAYTOWN, TEXAS The Honorable Mayor, and City_ Councilmen City of Baytown Baytown, Texas Sirs; Comes now C. Q. Alexander, and files and submits his application to the City of Baytown, Texas for a bug line franchise, and any and all necessary authority • from the city_ of Baytown, Texas, to operate buses trans- C porting passengers for compensation in local transporta- tion service over streets within the city of Baytown, subject to any and all applicable provisions of the city charter, and in support thereof says; C. Q. Alexander is in the process of organizing a Corpora- tion under the laws of the State of Texas, with its principal place of business to be in Baytown, Harris County, Texas. C. Q. Alexander to be the majority stockholder, President and General Manager of said cor- poration; and propose to complete organization during the procedure of issuing this requested Franchise. Applicant.: seeks a franchise for a period of twenty - five (25) years, authorizing the conduct of bus line operations in local transportation service of passengers for compensation over such reasonable routes as shall be approved by the City Council, C. Q. Alexander proposes to accord expeditious, con- -3- u venient, regular, adequate, economical and dependable local bus transportation service. C. Q..Alexander is willing and able to conduct the proposed local trans- -. - poetation service. The applicant has adequate.- finan- cial resources and adequate new equipment available to conduct the proposed operation and service. Personnel experienced in conducting - transportation of the kind and character proposed will assist.in conduct- ing operations and service under the franchise requested in this application, Lunder the supervision of C. Q. Alexander. The transportation to be conducted by C. Q. Alexander. under and by virture of the franchise here sought from the City of Baytown will be conducted in accordance with the will of the City Council as provided in the City Charter. For your convenience and consideration I am including as a part hereof form of franchise hereby requested. WHEREFORE, Applicant C. Q. Alexander, prays that the City of Baytown issue to C. Q. Alexander such franchise • for a term of twenty -five (25) years, and applicant also requests such other and - additional authority as may be necessary covering and authorizing the-operation of local 'bus transportation service in the City of Baytown.
