® AN ORDINANCE AMENDING ORDINANCE NO. 36 OF THE CITY OF
BAYTOWN WHICH 13 AN ORDINANCE TO PROMOTE THE HEALTH
CONDITIONS OF THE CITY OF BAYTOWN BY PROVIDING A CODE
OF SANITARY REGULATIONS AND REQUIREMENTS FOR ALL PLACES,
BUSINESSES AND PERSONS ti'dI-R;REIN OR BY WHOM FOODSTUFFS OR
DRINKS FOR HUMAN BEINGS ARE PRODUCED, HANDLED, PREPARED,
CARED FOR OR SOLD, AND ALL VEHICLES USED IN CONNECTION
WITH ANY SUCH BUSINESS, AND FOR THE CONDUCT OF HOTELS
AND LODGING HOUSES; SAID AMENDMENTS ADDING SECTION 13--a
TO ARTICLE III TO PROVIDE FOR PHYSICAL EXAMINATION AND
HEALTH CERTIFICATES OF EMPLOYEES AS REQUIRED BY ARTICLE 705c
OF THE PENAL CODE OF THE STATE OF TEXAS, AND BY ADDING
SECTION 13-b TO ARTICLE III TO PROVIDE MR CERTIFICATES
FOR EMPLOYEES SHOWING FREEDOM FROM TUBERCULOSIS; PROVIDING
FOR THE EFFECTIVE DATE HEREOF.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN:
Section 1: That Ordinance No. 36 heretofore duly passed by the City Council
of the City of Baytown on the 20th day of January A. D. 1949, be amended by add-
ing Section 13 -a, "Health Certificates," to Article III reading as follows:
"Section 13-a. Health Certificates. Each owner or manager of such
business shall comply with the provisions of Article 705c of the Penal
Code of the State of Texas relating to physical examination and Health
Certificates required of employees handling or dispensing food or drink."
Section 2: That said Ordinance No. 36 of the City of Baytown shall be further
amended by adding Section 13 -b, "Certificates of freedom from tuberculosis," to
Article III thereof, reading as follows:
"Section 13-b. Certificates of freedom from tuberculosis. Every employee
being employed in any such usiness at e effective ate of this act
shall within thirty (30) days thereafter, and every person hereafter
employed from the effective date of this ordinance shall within six (6)
months from the date of such employment, obtain and display for public
inspection in such place of business, a certificate from an approved
X -ray laboratory certifying that said employee is free from tuberculosis.-'
Such certificate shall be reneged annually thereafter."
rSection 3: Said Ordinance No. 36 is hereby confirmed and this ordinance shall
in no way affect, alter or change any of the provisions thereof except as herein
expressly stated.
Section 4: This ordinance shall take effect from and after ten (10) days from
its passage by the City Council. The City Clerk is hereby directed to give notice
hereof by causing the caption of this ordinance to be published in the official news-
paper of the City of Baytown at least twice prior to the effective date hereof.
INTRODUCED, READ and PASSED by the affirmative vote of a majority of the City
Council of the City of Baytown on this the 7 &ay of April, A. D., 1949•
