Ordinance No. 30ORDINANCE NO. 30 AN ORDINANCE REGULATING THE KEEPING OF LIVE STOCK AND DOMESTIC FOVIL IN THE CITY OF BAYTOWN; PROVIDING PENALTIES; CONTAINING A SEVERABILITY CIAUSF,; RE- PEALING ORDINANCES IN CONFLICT; PROVIDING FOR THE EFFECTIVE DATE HEREOF. BE IT ORDAINED BY THE CITY COUNCIL OF TIE CITY OF BAYTOWN:: Section 1: The running at large of horses,;, mules, jacks, jennets, cattle, sheep goats or hogs, within the City of Baytown, is hereby declared a nuisance, and it is hereby made unlawful for the owner or keeper of any such animals to suffer, permit or alloyr the same to run at large within the corporate limits of the City of Baytown. Section 2: It shall be required of every person owning or having control of any chickens, ducks, turkeys, guineas or any other domestic fowls, to keep the same confined vrithin his own premises, and it shall be unlawful for any }person within the city limits ® to suffer, permit or allow any chicken, duck, turkey, guinea or other domestic fowl which they may own or have the charge of to go or be found upon any street or alley of the city or upon the premises of another without the consent of the owner or the person in charge of the premises, upon which such chickens, ducks, turkeys, guineas or other domestic fowl may be found. Section 3: The City Manager shall select and establish, with the approval of the City Council, a place for impounding such of said animals mentioned in Section One hereof as are found running at large. Section 4 :- The Chief of Police, or any policeman, or other person designated by the Chief of Police, shall take up and impound any animal found running at large in the city limits. • Section 5: The Chief of Police shall sell impounded animals at public auction for cash after giving five (5) days' public notice of the time, terms and place of sale in the official newspaper of the -city, describing the animal impounded and stating that the same will be sold to defray costs if not reclaimed and costs paid before the day of sale. If not reclaimed by said day, he shall, between the hours of 10 :00 o'clock a.m. and 4:00 o'clock p.m. on said day, sell said animal at public auction to the highest bidder, and after deducting all the expenses of sale and taking up and keeping such animal, shall re- turn the balance of the proceeds, if any, to the owner of the animal. If no owner shall call for the animal within thirty days from day of sale, said balance shall be paid into ,., - the city treasury. If any animal cannot be sold, it shall be forthwith destroyed. • Section 6: The owner of said animals impounded may redeem the same as follows: (1) Before Salet By paying the expense of taking up and keeping, together with the cost of advertising, if any. (2) After sale :: By paying to the purchaser double the amount bid by him for such animal or animals and his reasonable expenses for keeping the same, provided the owner so _1_ redeems said animal vrithin thirty days after the date of sale; othervrise said animal shall become the absolute property of the purchaser. Section 7: The chief of Police shall keep a book giving the description of all � ® impounded b him the date of impounding, the date of sale, the amount rea]ized f� animals impound y , . such animal and the name and the address of the purchaser. Section 8s The following shall be the fees charged as poundager For taking care of animals, per head, per day. 2950 For taking up and impounding, per head. 1 2.50 For selling animals. 1.00 For preparing advertisement of sale. 1100 'For newspaper advertisement, the actual cost as determined from time to time. section 9: If arty of the animals named in the ordinance are found upon the premises ® of anyone, the owner or occupant of said premises shall have the right to confine such animal until he can notify the Chief of,-'Police or pound keeper to come and impound such animal; provided that same is done in an. reasonable time. When so notified, it shall be the duty of said officers to at once cause such animal to be impounded as herein provided. Section 10: Any person violating the provisions of Sections One oraTwo hereof shall be guilty_of a misdemeanor and fined not more than one hundred dollars. Section 11: All ordinances and parts of ordinances inconsistent with the terms of this-ordinance are hereby repealed; it being the intent hereof to specifically repeal Ordinance No. 26 passed by the City Commission of the City of Pelly on October 9,; 1947. Section 123 If any section or provisions, or parts thereof in this ordinance shall be adjudged invalid or unconstitutional, such invalidity or unconstitutionality shall not ® affect the validity of the ordinance as a whole or of any section or provision or part thereof, Section 13: This ordinance shall take effect from and after ten days from its passage by the City Council. The City Clerk is hereby directed to give notice hereof by causing the caption of this ordinance to be published in the official newspaper of the City of Baytown at least twice prior to the effective date hereof.
