ORDINANCE NO. 29
® AN ORDINANCE REGULATING DRAINAGE ON STREETS IN THE
CITY OF BAYTOWN; PROVIDING PENALTIES; CONTAINING A
SEVERABILITY CLAUSE; REPEALING ORDINANCES IN CON-
FLICT AND PROVIDING FOR THE EFFECTIVE DATE HEREOF.

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN:
Section 1: That it is hereby made-the duty of all persons owning
property abutting on streets in the City of Baytown where curb and gut-
ter have been installed to construct or cause to be constructed, at
their ovm cost and expense, concrete driveways leading from the curb
line to the property line on such lots, as may be necessary to enter
with any vehicle from the street, on such grade as may be furnished by
the Director of Public Works and in conformity with the ordinances of
said City. In doing such work property owners shall have the right to
cut down the curb wall, but only as may be directed by the Director of
Public Works.
Section 2: That on streets where curb and gutter have not been in-
stalled, it shall be the duty of property owners to have all crossings
over drains so constructed that they shall in no wise reduce the area of
drainage. The work of construction of such crossings shall be done un-
der the supervivion of the Director of Public Works.
Section 3: That where any crossing over a drain on a street has
been so constructed or is being maintained so as to constitute an ob-
struction to the free flow of drainage, the Director-of Public Works
shall notify the abutting property owner to remove such obstruction by
a written notice mailed to his residence address. If said owner fails
to remove the obstruction within fifteen (15) days from the date of the
mailing of said notice, then it shall be the duty of the Director of
Public Works forthwith to have said obstruction removed.
Section 4: That any person violating any provision of this or-
dinance shall be deemed guilty of a misdemeanor, and, upon conviction,
shall be fined not less than five dollars nor more than two hundred
dollars.
Section 5: If any.section or provisions, or parts there in this
® ordinance shall be adjudged invalid or unconstitutional, such invalidity
or unconstitutionality shall not affect the validity of the ordinance as
a whole.or of any other section or provision or part thereof.

Section 6: All ordinances and parts of ordinances inconsistent
with the terms of this ordinance are hereby repealed; provided, however,
that such repeal shall be only to the extent of such inconsistency and
in all other respects this ordinance shall be cumulative of other or-
dinances regulating and governing the subject matter covered by this or-
dinance.
Section 7: This ordinance shall take effect from and after ten
days from its passage by the City Council. The City Clerk is hereby di-
rected to give notice hereof by causing the caption of this ordinance to
be published in the official newspaper of the City of Baytown at least
twice prior to the effective date hereof.
