Ordinance No. 25ORDINANCE NO. 25 AN 011DINkfM REGULATING THE HIDING AND PARKING OF BICYCLES VVITHIN THE CITY OF BAYTOvvM; PROVIDING A PENALTY; CONTAINING A SEVE:RABILITY CLAUSE; REPEALING ALL ORDINANCES IN CONFLICT kiEuEwITH; AND PROVIDING FOR THE EFFECTIVE DATE HEREOF. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN: Section 1: Every bicycle while on the streets of the City of Baytovm, when in operation, during one -half hour after sunset to one -half hour before sunrise, and at all times when fog or other atmospheric conditions render the operation of such bicycle unusually dangerous, shall carry on its front one lighted lamp shoti,ring a white light visible under normal atmospheric conditions at least two hundred feet in the direction such bicycle is facing, and shall have at the rear one red light plainly visible from the rear. • Section 2: Any person riding upon any bicycle shall not attach the same or himself to any automobile or other moving vehicle upon any street or roadway in the City of Baytown. Section 3: The-operator of any bicycle, when in use on a street in the City of Baytown, shall not carry any other person upon the handlebars or frame of such bicycle nor shall any other person so ride on any such bicycle. Section 4: Persons riding bicycles upon the streets of the City of Baytown shall not ride more than two abreast, except on paths or places set' aside for the exclusive use of bicycles. Section 5: No person riding a bicycle shall carry any packages, bundles, or articles of any kind that would prevent the rider from having complete • control of such bicycle, and no rider nor operator of such bicycle shall carry in one hand any packages, bundles, or articles while operating such bicycle, but such packages, bundles, or articles shall be carried in a basket or a bag, attached to such bicycle so that the operator or rider of the of the bicycle will have the use of both hands for the operation and control of same, and so that the rider or operator will not be endangered, or his position made unsafe upon the streets. Section.:,b: No rider of any bicycle shall remove both hands from the handlebars, or feet from the pedals, or practice any acrobatic or stunt riding upon any streets, nor shall any person operating a bicycle upon a street • particpate in any race for speed or any endurance contest. Section 7: No person shall ride a bicycle upon any side walk in the City of Baytown except for the purpose of access to or from an abutting lot or premises. -1- r . • .(25) i Section 83 whenever any police officer find a bicycle unattended upon any sidewalk where such bicycle constitutes an obstruction or hazard to pedestrian traffic, or.constitutes a hazard to an abutting property owner, such as being parked against a plate glass window of a business or commercial building, such officer is hereby authorized to provide for the removal of such bicycle to a place of safety, which may include premises owned or pperated by the City of Baytown. Section 9: Every person, firm, or corporation viol.dting any provision of this ordinance shall be deemed guilty of a misdemeanor and, upon conviction shall be punishable by a fine not to Exceed Une hundred ($100) Dollars. Section 10: All ordinances or parts of ordinances inconsistent with the terms of this ordinance are hereby repealed; provided, hovrever, that such repeal shall be only to the extent of such inconsistency, and in all other respects this ordinance shall be cumulative of other ordinances regulating and governing the subject matter covered by this ordinance. Section 11: If any section or provisions, or parts thereof in this ordinance shall be adjudged invalid or unconstitutional, such invalidity or unconstitionality shall not affect the validity of the ordinance as a whole or of any other section or provision or part hereof. Section 12: This ordinance shall take effect from and after ten days from its passage by the City Council. The City Clerk is hereby directed to give notice hereof by causing the caption of this ordinance to be published in the official newspaper of the City of Baytovm at least twice prior to • the effective date hereof.
