Ordinance No. 18ORDINANCE NO. 18 AN ORDINANCE ESTABLISHING A GARBAGE AND REFUSE DISPOSAL SYSTEM ® FROM BUSINESS AND COMMERCIAL PREMISES WITHIN THE CITY OF BAYTOWN; PROVIDING FOR ISSUANCE OF PERMIT AND LICENSE FOR EACH CONVEYANCE ENGAGED IN REMOVING GARBAGE AND REFUSE; PROVIDING FOR MAXIMUM PENALTY OF $100 FOR VIOLATION AND FOR EFFECTIVE DATE HEREOF AND REPEALING ALL PRIOR ORDINANCES AND AMENDMENTS RELATING TO THE COLLECTION OF GARBAGE AND REFUSE FROM BUSINESS AND COMMER. -EI AL PREMISES, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN: Section 1. There is hereby established and shall hereafter continue in opera- tion, within the corporate limits of the city, a garbage and refuse disposal system for the purpose of collecting and disposing of all garbage, rubbish, waste and refuse accumi&ting upon any premises used for mercantile, commercial, manufacturing, cafe, grocery or other business enterprises. Said system shall consist of the granting ® of permit or permits to one or more applicants for the purpose of operating trucks referred to as "sanitary, conveyances" for the collection of said garbage and refuse from commercial premises and the issuance of a license card for each such conveyance. The owner or otivners of said sanitary conveyances shall charge the owner of each commercial or business enterprise a fee as hereinafter provided for the collection service rendered under this ordinance and the collection and disposal system hereby established shall be operated without expense to the city except for the supervision 6 provided for herein. Section 2. Garbage as used herein is defined as rubbish, trash, waste paper, boxes of wood or paper, merchandise containers, tin cans, kitchen and cafe waste, food and refuse. ® Section 3. It shall hereafter be unlawful for the owner or occupant of any mercantile, commercial, manufacturing, cafe, grocery or other business enterprise to place or thrown any garbage or refuse of any kind or character on the streets or in the alloys of the City of Baytown at any time, but all such garbage and refuse shall be placed in receptacles as hereinafter provided. Section fit. Garbage and refuse from any mercantile, commercial, manufacturing,. cafe, grocery or other business enterprise shall be placed in metal containers with suitable metal covers or other satisfactory containers, such receptacles and covers to be approved and meet specifications set up by the Director of Public Works. Section 5• The owner of any truck or trucks desiring to operate same as "sani- tary conveyances" under this ordinance shall make written application iflor a permit so to do with the City Clerk, which application shall set forth..-.the followings (a) Name and address of applicant -1- (b) Approximate location of premises from which garbage is to be removed, and tentative route and schedule to be maintained. ® (c) Number and description of trucks to be placed in operation. (d) last of names of firms or business enterprises which applicant proposes to serve. Section 6. Upon the filing of such application the City Clerk shall requEst the Director of Public Works to make due investigation and inspection of the trucks to be placed in operation by applicant, to review the tgntative route and schedule to be maintained and,to make due report to the City. Clerk of approval or disapproval of the application, and if approved the City Clerk shall issue the permit applied for and at the same time shall also issue to the applicant a license card carrying the legend "sanitary conveyance" for each truck to be placed in operation, said card to des;ribe the truck for which said card is issued. ® Section 7. All "sanitary conveyances" must be equipped with sides and tailboards so that the bed thereof, when tailboard is up, shall be completely inclosed and also shall be equipped with permanent, solid cover or an adjustable cover of substantial, durable material which must be of dimensions as to completely cover the bed or body of the conveyance and extend dorm the sides in such manner as to prevent any of the refuse being blown out or otherwise falling out and being distributed along the city streets. Each conveyance shall carry necessary containers for the handling of cafe and kitchen waste. Each conveyance shall be manned with not less than two men in order to insure adequate handling of garbage and refuse to be collected hereunder. The Director of Public Works shall determine that such trucks meet the requirements specified before approving the heretofore mentioned application. • Section 8. It is specifically provided that all permits shall be issued for annual periods only, expiring on December 31st of each and every year, except that any permit or permits issued during the remainder of the year 1948 shall be issued for a period to include the remainder of said year and the year 1949, and accordingly, the expiration date of any such permit issued during the remainder of the year 1948 shall be December 31st, 1949. Section 9.. Fees for permits, including the conveyance card and inspection charges, for all trucks or other conveyances operated for the purpose of collecting garbage and refuse under this ordinance shall be $5.00 per year for each permit and $5.00 for each license card for each truck to be operated hereunder. Section 10. The owner of any truck or trucks operated as "sanitary Conveyances" • under this ordinance shall charge the owner or occupant of each commercial or business enterprise for the service or services rendered and in.no event shall the city pay or be obligated to pay the operator for services rendered by him in collecting garbage or refuse under this ordinance. -2- section 11. Nothing herein contained shall affect the right of the owner of any commercial or business enterprise covered by this ordinance to remove his or ® its own garbage and refuse to the city dump under the supervision of the Director of Public Works, Section 12. If any section, paragraph or clause of this ordinance should, for any reason, be held invalid, such invalidity shall in nowise affect the re- maining portions of this ordinance, and to such end the various sections and para- graphs hereof are declared to be severable. Section 13. Any person violating any provision of this ordinance shall be deemed guilty of a misdemeanor and subject to a fine of not less than $5.00 nor more than $100. Section 14. This ordinance shall take effect from and after ten days from ® its passage by the City Council. The City Clerk is hereby directed to give notice hereof by causing the caption:_ of this ordinance to be published in the official newspaper of the City of Baytown at least twice prior to the effective date hereof.
