AN ORDINANCE AMENDING "AN ORDINANCE REGULAT-
ING THE OPERATION AND USE OF ELECTRICAL LOUD.
SPEAKERS, EITHER STATIONARY OR ATTACHED TO ,
A VEHICLE OR AUTOMOBILE, IN THE CITY OF PELLY,
TEXAS," WHICH ORDINANCE WAS ADOPTED BY THE
CITY COMMISSION OF THE CITY OF PELLY, TEXAS,
ON THE 29TH DAY OF MARCH, 1946, BY THE INCLU-
SION OF SUB - SECTION Fb "_ -UNDER SECTION 2 OF
SAID ORDINANCE, WHICH NEW SECTION.PROVIDES FOR
THE GRANTING OF SPECIAL PERMIT FOR THE USE OF
STATIONARY LOUD SPEAKERS IN THE INTEREST OF THE
PUBLIC WELFARE AND PROVIDING FOR THE PUBLICATION
AND EFFECTIVE DATE OF THIS ORDINANCE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN:
• Section 1. That the Ordinance adopted by the City Commission
of the City of Pelly on the 29th day of March, A. D., 1946, regulating the
operation and use of electrical loud speakers in the City of Pelly, Texas,
is hereby amended as follows:
Section 2 of said Ordinance shall be and is hereby amended to
read as follows;
"Section 2. (a.) The provisions of Section 1 of this Ordi-
nance shall not apply to the use of radios in homes or business estab-
lishments located within the corporate limits of the City of Pelly, nor
to the furtherance of the purposes of any charitable, benevolent, educa-
tional or religious organizations.
40 (b.) It is provided that upon written application made by the
person or persons proposing to use or operate a stationary electrical
loud speaker, the City Manager may make special exception to the provi-
sions of Section 1 of this Ordinance,.if in his opinion; the use of the
loud speaker or speakers referred to in the application at hand shall be
in the interest "of the public welfare, and thereupon the City Manager
may grant a permit to said applicant authorizing the use of a stationary
electrical loud speaker or speakers at a designated place and for such
time or times as set out in said permit. It is specifically provided that
the exception provided for in this Sub- section (b.) shall not apply to the
use of electrical loud speakers attached to a vehicle or automobile."

Section 2. That this ordinance shall take effect and be in
force from and after its passage, approval and publication in accordance
with the provisions of the Charter of the City of Baytown.
Introduced, read, and passed by the affirmative vote of a
majority of the City Council of the City of Baytown, Texas, on this the
17th day of June, 1948.
