The Board of Directors of the Baytown Area Water Authority (BAWA) met in a Regular
Meeting on Wednesday, March 20, 2019, at 9:01 A.M., in the Council Chamber of the Baytown
City Hall, 2401 Market Street, Baytown, Texas with the following in attendance:

President Bradley Smith convened the March 20, 2019, BAWA Board Regular Meeting with a
quorum present at 9:01 A.M., all members were present with the exception of Vice President
Mike Wilson and Director Brandon Benoit, who were both absent.
1. MINUTES
a. Consider approving the minutes of the Baytown Area Water Authority Regular
Meeting held on February 20, 2019.
A motion was made by Director Harland Forrest, Jr., and seconded by Secretary Frank McKay
III approving the February 20, 2019, BAWA Board Regular Meeting Minutes. The vote was as
follows:
Ayes: President Brenda Bradley Smith, Secretary Frank McKay III, Director Harland
Forrest, Jr.
Nays: None
Other: Vice President Mike Wilson (Absent), Director Brandon Benoit (Absent)

2. PROPOSED RESOLUTIONS
a. Consider a resolution authorizing Change Order No. 4 with Pepper Lawson
Waterworks, LLC, for the 6 MGD Surface Water Treatment Plant Project.
Interim Engineering Director Ajay Skakyaver presented agenda item 2.a and stated that
Resolution No. 2019-08 authorizes Change Order No. 4 with Pepper Lawson Waterworks, LLC,
for the 6 MGD Surface Water Treatment Plant Project in the amount of $221,631.30, to include
the following scope of work:

1. add three additional underground pull boxes;
2. up -size existing underground electrical pull boxes;
3. replace the mechanical joint restraints with Sigma MJ Restraints;
4. add a 3-inch seal slab required for stabilization due to ground conditions; and
5. add back in partial value engineering items originally removed from contract to help
facilitate future expansions of the plant.
A motion was made by Secretary Frank McKay III, and seconded by Director Harland Forrest,
Jr. approving Resolution No. 2019-08, regarding agenda item 2.a. The vote was as follows:

RESOLUTION NO. 2019-08
A RESOLUTION OF THE BOARD OF DIRECTORS OF THE BAYTOWN
AREA WATER AUTHORITY AUTHORIZING CHANGE ORDER NO. 4
WITH PEPPER LAWSON WATERWORKS, LLC, FOR THE BAWA 6 MGD
SURFACE WATER TREATMENT PLANT PROJECT IN THE AMOUNT OF
TWO HUNDRED TWENTY-ONE THOUSAND SIX HUNDRED THIRTY-
ONE AND 30/100 DOLLARS ($221,631.30); AND PROVIDING FOR THE
EFFECTIVE DATE THEREOF.
3. REPORTS
a. Receive an update regarding the Baytown Area Water Authority East Plant Project.
Gary Rabalais, a representative from Jones & Carter presented an update on the Baytown Area
Water Authority (BAWA) East Plant Project by showing the Board a bird's eye view of the
BAWA East Plant construction site and he provided the Board with the following updates on the
construction:
• Raw Water Intake ("RWI"), Forebay, & Low Lift Pump Station ("LLPS"):

Mr. Rabalais further stated that the Core of Engineers concluded that the area for the Stonmwater
Detention & Pump Station is not wetlands area, as such the contractor is able to start work on
this section of the project, which would save an estimated cost of 2,000,000 in delays for BAWA
as well as mitigation credits are no longer required for this project. Deputy City Manager Ron
noted that the mitigation credits previously purchased for this item could eventually be sold and
refunded to the BAWA Budget.
Additionally, Mr. Rabalais provided an update on Change Order No. 4, which was previously
presented to the Board and an upcoming change order that will be presented to provide
additional clearing along the NRG property line. As well as a change order to place the SCADA
programing under the current contractor, instead of a third party contractor.
Lastly, Mr. Rabalais presented the following challenges for the Project:

• Rain Days:
o additional rain days might need to be addressed in the future
• SCADA:
o See above notes above in regards to a future change order
• TGS Drainage Conflict:
o TGS access road and ditch to site was built in conflict with the BAWA drainage
outfall from the Stormwater Detention Pond. TGS and the City of Baytown are
currently working on a solution to have the outfall routed to their ditches and then
flow downstream.
• Sanitary Sewer Force Main:
o BAWA reached an agreement with CCID No. 1 to take the waste water from the
treatment plant and the City is going to move forward with the design of the last
section of the Force Main to complete the tie-in.
Mr. Joe Marrow, Managing Director with HilltopSecurities approached the Board and presented
the next phase of the bond process and stated that the first draft of the Preliminary Official
Statement is currently out for comment and that the final document will be presented to the
Board at their April 171h Meeting. Furthermore, Mr. Marrow stated that the BAWA Board will
need to meet for a Special Meeting on May 9`h to accept the bids, and if approved the funds
would be released on May 301h. Director Frank McKay questioned the amount of the bonds and
Mr. Marrow responded that they would be in the range of $18 million.
4. MANAGER'S REPORT
a. The next Baytown Area Water Authority meeting is scheduled for Wednesday,
April 17, 2019, at 9:00 a.m., in the Council Chamber located at City Hall, 2401 Market
Street, Baytown, Texas 77520.
Deputy City Manager Ron Bottoms stated that the next Baytown Area Water Authority meeting
is scheduled for Wednesday, April 17, 2019, at 9:00 a.m., in the Council Chamber.
5. ADJOURN
A motion was made by Director Harland Forrest, Jr., and seconded by Secretary Frank McKay
III to adjourn the March 20, 2019, BAWA Board Regular Meeting. The vote was as follows:
