TEXAS, AUTHORIZING CHANGE ORDER NO.7 WITH CRAIN GROUP, LLC,
FOR THE BRUNSON THEATER RENOVATION PROJECT, AUTHORIZING
PAYMENT BY THE CITY OF BAYTOWN IN THE AMOUNT OF ONE
HUNDRED TWENTY-SIX THOUSAND EIGHT AND 81/100 DOLLARS
($126,008.81); AND PROVIDING FOR THE EFFECTIVE DATE THEREOF.

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS:
Section 1: That subject to funding from the Baytown Municipal Development District,
the City Council does hereby authorize Change Order No. 7 with Crain Group, LLC, for the Brunson
Theater Renovation Project. A copy of said change order is attached hereto, marked Exhibit "A" and
made a part hereof for all intents and purposes.
Section 2: That subject to funding from the Baytown Municipal Development District,
the City Council of the City of Baytown authorizes payment to Crain Group, LLC, in an amount not
to exceed ONE HUNDRED TWENTY-SIX THOUSAND EIGHT AND 81/100 DOLLARS
($126,008.81) in accordance with the change order authorized in Section 1 hereinabove.
Section 3 : This ordinance shall take effect immediately from and after its passage by the
City Council of the City of Baytown.
INTRODUCED, READ and PASSED by the affirmative vote of the City Council of the City
of Baytown this the 110' day of April, 2019.

Brief Description of Changes:
Additional cost to waterproof and seal the floor and walls as indicated on sketch provided by RPA Architects, including
required additional flashing at adjacent buildings. A total of $126,005.07 will be added to the Contract Sum. 136 day are
being added due the critical path of the project being placed on hold until a resolution and direction to proceed was
established to mitigate and waterproof discovered conditions at the adjacent buildings that were causing water
intrusion into the Brunson space. This change order includes a credit of the cost only for Change Order #6 as the time
included has expired while waiting on a direction to proceed. if this change order is approved at the 4/11/19 City
Council Meeting, the scheduled Substantial Completion date will be 6/14/19.
