A RESOLUTION OF THE BOARD OF DIRECTORS OF THE BAYTOWN
AREA WATER AUTHORITY AUTHORIZING CHANGE ORDER NO. 4
WITH PEPPER LAWSON WATERWORKS, LLC, FOR THE BAWA 6 MGD
SURFACE WATER TREATMENT PLANT PROJECT IN THE AMOUNT OF
TWO HUNDRED TWENTY-ONE THOUSAND SIX HUNDRED THIRTY-
ONE AND 301100 DOLLARS ($221,631.30); AND PROVIDING FOR THE
EFFECTIVE DATE THEREOF.

BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE BAYTOWN AREA
WATER AUTHORITY:
Section 1: That the Board of Directors of the Baytown Area Water Authority does
hereby authorize Change Order No. 4 with Pepper Lawson Waterworks, LLC, for the BAWA 6
MGD Surface Water Treatment Plant Project. A copy of said change order is attached hereto,
marked Exhibit "A" and made a part hereof for all intents and purposes.
Section 2: That the Board of Directors of the Baytown Area Water Authority hereby
authorizes the payment of an amount not to exceed TWO HUNDRED TWENTY-ONE
THOUSAND SIX HUNDRED THIRTY-ONE AND 301100 DOLLARS ($221,631.30) to
Pepper Lawson Waterworks, LLC, consistent with the change order authorized in Section 1.
Section 3: This resolution shall take effect immediately from and after its passage by
the Board of Directors of the Baytown Area Water Authority.
INTRODUCED, READ and PASSED by the affirmative vote of the Board of Directors
of the Baytown Area Water Authority this the 20th day of March, 2019.

CO 4.1 is requested for the additional value engineering options selected by the City staff to facilitate the future
expansion of the BAVVA 6 MGD Surface WaterTreatment Plant CO 4.2 is requested to provide for safety of the
electrical pull boxes, maintenance and future expansion of the BAWA 6 MGD Surface Water Treatment Plant as
recommended by the Engineer and the Electrical Subcontractor. C04.3 is requested per the request of the City staff for
the change on the mechanical joint restraint fittings. C04 4 is requested due to a change in the anticipated existing site
conditions, 3" seal slabs were installed under the structures due to unsuitable soil conditions per the Geotechnical
Report and the recommendation of the Engineer. Please see the attached back-up documentation.
