Mayor Pro Tern Johnson convened the November 08, 2018, City Council Regular Meeting with
a quorum present at 6:35 P.M., all members were present with the exception of Mayor
DonCarlos and Council Member Betancourth who were both absent.
Pledge of Allegiance, Texas Pledge, and Invocation was led by Mayor Pro Tern Johnson.
MINUTES
a. Consider approving the minutes of the City Council Work Session and Regular
Meeting held on September 13, 2018.
A motion was made by Council Member Robert C. Hoskins and seconded by Council Member
Chris Presley approving to suspend such meeting minutes until December 31, 2018. The vote

2. RECOGNITIONS AND CITIZEN COMMUNICATIONS
a. Receive a report from the Baytown Professional Firefighters Association IAFF
Local 1173 on its 2018 Muscular Dystrophy Association (MDA) Fill -the -Boot Campaign.
Came Dalton, a representative of the MDA stated that for the year 2018 the citizens of Baytown
through the Baytown Professional Firefighters raised over $30,000 for MDA and extended
appreciation for the City's support for such campaign.
Daniel Calhoun noted that the funds raised would assist the MDA children with going to camps
and for further research to help stop the progression of the disease. Additionally, he noted that
they look forward to raising funds again in the year 2019.
3. 74.25 ACRES OF LAND LOCATED IN THE JOHN STEELE SURVEY
The Industrial District Agreements (IDA's) for agenda items 3.a. and 3.b. were signed
and therefore were no longer necessary.
a. Conduct the first public hearing regarding the involuntary annexation of the
property described in the Greentransport Facility Minor Plat, a subdivision of 74.25-acres
located in the John Steele Survey, Abstract 227, Chambers County, Texas, save and except
the property that was annexed by City of Baytown pursuant to Ordinance No. 10,752.
b. Conduct the second public hearing regarding the involuntary annexation of the

4. 31.3 ACRES OF LAND LOCATED AT 2015 MASSEY TOMPKINS ROAD
a. Consider an ordinance authorizing a Services Agreement with Soria Construction,
Inc., concerning the annexation of 31.3 acres located at 2015 Massey Tompkins Road,
Baytown, Harris County, Texas.
Principle Planning Manager, Chris Chavis presented an overview of the agenda item and stated
that the property regarding this agenda item is approximately 28 acres a remnant of the
annexation that the City undertook in the year 2017. He stated that the property owner received a
development agreement which allowed agricultural property to remain outside of the city for
agricultural use, as well as, for it to remain as it exists for seven (7) years. Additionally, he stated
that currently the property owner wants to pursue a subdivision of the property which requires
the property to be annexed into the city.

ORDINANCE NO. 13,934
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN,
TEXAS, AUTHORIZING AND DIRECTING THE CITY MANAGER TO
EXECUTE AND THE CITY CLERK TO ATTEST TO A SERVICES
AGREEMENT WITH SORIA CONSTRUCTION, INC.; AND PROVIDING
FOR THE EFFECTIVE DATE THEREOF.
b. Conduct the first public hearing regarding the proposed voluntary annexation of
approximately 31.3 acres, save and except, approximately 3.5 acres previously annexed by
Ordinance Number 627-A, located on the north side of Massey Tompkins Road and
addressed as 2015 Massey Tompkins Road, legally described as part of Tract 3, C Smith
Survey, Abstract 69, Harris County, Texas.
At 6:44 P.M., Mayor Pro Tern Johnson opened the first public hearing regarding the proposed
voluntary annexation of approximately 31.3 acres, save and except, approximately 3.5 acres
previously annexed by Ordinance Number 627-A, located on the north side of Massey Tompkins
Road and addressed as 2015 Massey Tompkins Road, legally described as part of Tract 3, C
Smith Survey, Abstract 69, Harris County, Texas.
Mr. Chavis stated that the summary of this first public hearing was the same as described in
agenda item 4.a.
With there being no one registered to speak regarding agenda item 4.b., Mayor Pro Tem Johnson
closed the first public hearing at 6:45 P.M.

5. PROPOSED ORDINANCES
a. Consider an ordinance removing certain parking restrictions in the Downtown Arts
District.
Traffic Engineer, Matt Johnson presented the agenda item and stated that the Downtown Arts
District had sixteen different overlapping parking restrictions and no parking zones, in which
most were active in 1977. He stated that back then the area was targeted more to keep the
commercial traffic flowing at that pace, but since and moving forward the area is being migrated
to a more mixed use livable center downtown arts district; whereas the nature of the
commercial traffic in the area is more service oriented. He stated that a minimal to no time
limit on parking would inhibit owners to promote their businesses, in which Ordinance No.
13,935 would cleanup and remove the sixteen unnecessary parking restrictions.
Council Member Presley inquired if there was a plan for complaints with regards to parking
indefinitely, an example being that the limited parking space taken up by non -consumers. Mr.
Matt Johnson stated that if an issue of such arises there are measures that can be taken.

b. Consider an ordinance authorizing the renewal of the Agreement for Emergency
Protection Services with Chambers County Improvement District No. 3 for a term of one
year.
Fire Chief, Kenneth Dobson presented the agenda item and stated that Ordinance No. 13,936,
authorizes an Agreement for Emergency Protection Services with Chambers County
Improvement District No. 3 (CCID#3) to provide fire protection services within the boundaries
of the Chambers County Improvement District No. 3. He stated that the agreement was originally
for six (6) years and in the agreement it stated that it would renew for four (4) years, but the
recommendation is to renew it for one (1) year in order to evaluate the services provided in that
area. He noted that the City provides services to three (3) industrial areas with the current
resources available and want to be certain that adequate service can continue to be provided for
all.
For clarity purposes, Chief Dobson stated that there were no changes in the agreement with
regards to the costs of what's paid, but it's similar to the other two agreements, whereas they have
higher values. Additionally, Chief Dobson stated that they're evaluating to see how the fees
change as the value increases and how it affects fire service in general.

7. DISCUSSIONS
a. Present the Imagine Baytown Strategic Plan Year 1 Progress Report
Director of Strategic Initiatives, Nick Woolery presented the Imagine Baytown Strategic Plan
Year 1 Progress Report. He stated that in the year 2016 the process for Imagine Baytown started
and in the year 2017, the Strategic plan was finalized and the implementation phase began. Mr.
Woolery stated that Year 1 was complete and Year 2 was in the middle of its implementation
phase. He stated that also in Year 1, Council goals were outlined in which some were complete;
some were nearly complete, some were unable to be complete within Year 1, and there were nine
(9) still in progress.
Mr. Woolery stated that one of the directives worked on, but not reflective in the survey results
was community reputation and image. He stated that some of the key successes included the
completion of Phase I of the GCCISD marketing campaign, 14 bridges cleaned and painted,
street signage replaced city-wide, the completion of the San Jacinto Boulevard aesthetics with
buried utilities, the addition of a community service team, the enhancement of holiday d6cor on
Texas Avenue, and the accomplishment of receiving the Governor's Community Achievement
Award. Mr. Woolery noted that the crime rate decreased from year the 2015 to 2018, and noted
that although Hurricane Harvey had an impact on the crime rate during the years 2017 and 2018,
the overall crime rate had a positive decreasing trend. He further noted that the City invested
approximately $1.3 million towards reducing litter in the community.

With regards to infrastructure and mobility, Mr. Woolery stated that the key successes included
the completion of the San Jacinto Boulevard Phase I, the completion of Santavy from Garth to
San Jacinto, major progress on Hunt Road from San Jacinto Boulevard to N. Main, the beginning
of CenterPoint LED light conversion, the major sidewalk installation project on Garth, Baker,
and N. Main, and the installation of adaptive traffic programming at nine additional intersections.
He noted that these projects would improve traffic flow on Garth Road, in which the average
drive time on Garth Road going northbound from Highway 146 to I-10 has already been reduced
by 1 minute and 43 seconds.
Regarding community amenities, Mr. Woolery stated that the key successes included the
Brunson Theater redevelopment coming to fruition, the Market Street District study underway,
the Hotel Conference Center Project in progress, the San Jacinto Mall redevelopment also in
progress, Pirates Bay nears 200,000 in attendance, the Max Bowl Family Game Center
renovated, and multiple restaurants opened. He noted that during the FY 17-18 there were five (5)
private investment projects in the reinvestment zone during the last quarter and there were many
new restaurants and retail and entertainment establishments opened. Additionally, he noted that
there were more city co -sponsored events being hosted in Baytown.
During further discussion of the report, Mr. Woolery noted with regards to neighborhood
quality that although work has been done in this area the results lack and therefore should remain
as a priority moving forward. He noted that as more neighborhoods start to develop the results
could change. He stated that the key successes included proactive code enforcement along with
adding additional code enforcement officers, enhanced codes regarding signs, building codes,
and fences; replacement of sidewalks in older neighborhoods, the renaming of the Downtown
Arts District, and the achievement of multiple awards. Additionally, he noted that the average
sales price of residential units had a consistent increase from October 2016 to September 2018.
With regards to operational excellence, Mr. Woolery stated that the key successes included the
implementation of the Imagine Baytown Community Scorecard, the implementation of an asset
management system, major investments made to the City's geographic information system (GIS);
trained over 200 employees through the City's Process Improvement & People Empowerment
(PIPE) Academy, unveiled the Baytown Innovation room, city employees completed more than
50 innovation projects which created over $500,000 savings for customers, and the Fire
Department completed their strategic plan while the Public Works, Police, and Planning
Departments are working on their accreditation. He further noted that since October of 2016 to
September of 2018, the animal live release rate increased to 34.9%.
Mr. Woolery stated that the Strategic Planning Advisory Committee's (SPAC) overall feedback
was positive, in which they expressed appreciation for the City being transparent with its citizens
on community affairs. He stated that the SPAC made mention of some of the things to continue
working on which included continuing to enforce codes, continue looking for ways to utilize the
waterfront and ways of lowering the risk of a developer purchasing and redeveloping tax
foreclosed lots, ensuring that trails are safe and well-connected and addressing the lack of quality
daycare in Baytown.

Council Member Hoskins requested details on the hotel occupancy rate. Mr. Woolery stated that
the occupancy rate decreased significantly over the past year, due primarily to the construction
activity slowing down. He also noted that there was almost 100% occupancy for several months
after Hurricane Harvey, but overall the occupancy declined to its normal percentage.
Mayor Pro Tem Johnson inquired with regards to the travel time from I-10 to Highway 146 on
Garth as to what time of day was the study being conducted. Mr. Woolery stated that the
scorecard provides AM, Mid -day, and PM times, but further noted that the most significant
improvement was during the PM.

9. MANAGER'S REPORT
a. The Annual Veterans Day Service will be held at the Veterans Memorial Plaza
located at Bicentennial Park, 1001 Market Street, on Sunday, November 11, 2018, at 11:00
A.M.
Superintendent of Recreation, Cliff Hatch presented the agenda item and stated that the Annual
Veterans Day Service would be held at the Veterans Memorial Plaza located at Bicentennial
Park, 1001 Market Street, on Sunday, November 11, 2018, at 1 L00 A.M., and in the event of
bad weather would be moved to the Community Center, 2407 Market Street, same time and date.
Mr. Woolery noted that the Council Retreat was scheduled for Saturday, November 17, 2018, at
8:00 A.M., in the Innovation Room at the Library. He requested Council to think about the
projections for Baytown from the current until the year 2022 and what could be accomplished in
Year 3 to move towards that ultimate vision.
