September 13, 2018, at 6:35 P.M. in the Council Chamber of the Baytown City Hall, 2401

Mayor DonCarlos convened the September 13, 2018, City Council Regular Meeting with a
quorum present at 6:35 P.M., all members were present.
Pledge of Allegiance, Texas Pledge, and Invocation was led by Council Member Himsel.
1. MINUTES
a. Consider approving the minutes of the City Council Work Session and Regular
Meeting held on August 09, 2018.
A motion was made by Mayor Pro Tem Charles Johnson and seconded by Council Member
Heather Betancourth approving the August 09, 2018, City Council Work Session and Regular

2. RECOGNITIONS AND CITIZEN COMMUNICATIONS
a. Present the City Council with a plaque commemorating the Baytown Fire
Department's Insurance Service Office (ISO) I classification.
Fire Chief, Kenneth Dobson presented the City Council with a plaque commemorating the
Baytown Fire Department's Insurance Service Office (ISO) I classification. He noted that other
departments hard work inclusive to the fire department was instrumental in achieving such status
and further noted that there are over 300 ISO 1 departments in the country, which includes
Baytown. Additionally, he introduced Phillip Bradley from the Insurance Services Office (ISO),
who provided information on what ISO is.
Mr. Bradley stated that ISO is not a state agency nor a regulatory authority, but a data analytics
company that services the entire insurance industry. He stated that they gather information based
on the fire protection provided to the community, using a fire suppression rating schedule to
correlate to the classification on a scale from 1 to 10 (1=best fire protection, 10=no recognized
fire protection). He stated that the insurance industry sees this information as being valuable, as
they take the fire protection provided to the community and correlate that into insurance
premiums that they use; therefore, if there's better fire protection, a lower insurance rate
is expected for commercial and home owners' premiums.
Mr. Bradley stated that part of their evaluation include evaluating the fire, water, and
communications departments as well as fire prevention activities. He noted that they have
classifications on approximately 48,000 community's country wide with sixty-four Class 1
classifications in Texas, which puts Baytown in the top 1% of all of the communications that
they have classifications on. He stated that they submit their information to insurance companies

and the insurance companies adjust the policy premiums accordingly, in which the effective date
for this classification is September 1 st. Additionally, Mr. Bradley noted that the support of the
administration and council is important to this achievement.
Mr. Jesse Williams from the Texas Department of Insurance stated that the City of Baytown
achieved the highest ISO classification award and the Texas Department of Insurance approved.
He stated that Baytown constituents should see lower insurance rates and policies renewed on or
after September 1 st should get the new classification. He stated that they want to notify the
insurance companies that do business in Baytown that there's a new classification so that they're
aware when policies are renewed. He noted that ISO notifies the companies 75 days before the
effective date. Additionally, Mr. Williams stated that they give presentations to give recognition
to the community for the things that the community leaders are doing to reduce insurance rates as
well as make the community a safer place to live and work.
Both ISO and the Texas Department of Insurance presented the City of Baytown with plaques
for the achievement of the ISO 1 rating status.
b. Receive the Certificate of Achievement in recognition of the Comprehensive Annual
Financial Report for the Fiscal Year ending September 30, 2017.
Director of Strategic Initiatives, Nick Woolery presented to the City of Baytown Finance
Department the Certificate of Achievement for Excellence in Financial Reporting for the fiscal
year ending September 30, 2017, which is the highest form of recognition in the area of
governmental accounting and financial reporting and its attainment represents a significant
accomplishment from the Government Finance Officers Association (GFOA).
3. CITY OF BAYTOWN TAX RATE
a. Receive the 2018 Appraisal Rolls certified by the Harris County Appraisal District
and the Chambers County Appraisal District.
Finance Director, Wade Nickerson presented the agenda item and stated that the 2018 Harris
County Appraisal Roll was certified on August 21, 2018, with a tax roll of $3,412,000,000. He
stated that the 2018 Chambers County Appraisal Roll was certified on July 20, 2018, with a tax
roll of $185,000,000. Additionally, he noted that with the districts combined there was an
increase of approximately $3 million.
b. Receive the effective and rollback tax rate calculation for the 2018 tax year (Fiscal
Year 2019).
Mr. Nickerson presented the agenda item and stated that the effective tax rate and the rollback
rates were calculated at $0.835253 and $0.819215 per $100 valuation, respectively.
C. Consider an ordinance adopting the tax rate for General Fund Maintenance and
Operations at $0.457643 per $100 valuation and adopting the tax rate for Debt Service at
$0.354387 per $100 valuation for the fiscal year ending September 30, 2019.

Mr. Nickerson presented the agenda item and stated that Ordinance No. 13,864, approves the
total tax rate of general operations and maintenance as well as debt service of $0.81203, which is
a $0.01 decrease from the prior year.

Chris Presley approving Ordinance No. 13,864, regarding agenda item 3.c. The vote was as

4. HOTEL/CONVENTION CENTER PROJECT
Deputy City Manager Bottoms requested that agenda items 4.a., 4.b., and 4.d. be considered

5. PROPOSED AMENDMENTS TO MAJOR THOROUGHFARE PLAN
a. Conduct a public hearing regarding amendments to the Baytown 2025
Comprehensive Plan's Major Thoroughfare Plan (MTFP) to revise and update the current
plan, Baytown, Harris County, and Chambers County, Texas.
At 6:54 P.M., Mayor DonCarlos opened and conducted a public hearing regarding amendments
to the Baytown 2025 Comprehensive Plan's Major Thoroughfare Plan (MTFP) to revise and
update the current plan, Baytown, Harris County, and Chambers County, Texas.
Chris Chavis presented the summary of the public hearing and stated that this item is a city-wide
update to the MTFP, which is the guiding document that designates different road classifications
for each major road throughout the city. He noted that the general hierarchy of the roadway
systems was major thoroughfares, minor arterial, collective roads, and local roads. He further
stated that since the last update in year 2013, the city has grown in various areas; therefore
staff currently request approximately 24 amendments to the MTFP with more amendments
expected in the future.
During further discussion, Mayor DonCarlos stated with regards to Frame 7: Item 1, whereas it
states "Emmett Hutto south to Rollingbrook - due to existing and proposed residential
development in the area, the possibility of collector road is significantly hindered", that there was
considerable extensive time spent negotiating an agreement with Exxon for a connection into the
subdivision to be built at that time, which is currently South of Rollingbrook and east of Emmett
O. Hutto. He further inquired as to why is staff now abandoning such connection. In response to
Mayor DonCarlos's inquiry, Mr. Chavis stated that according to the current development plans
there's a signalization approved at the intersection of Emmett Hutto and Rollinbrook that runs
into the subdivision, in which there's residential housing along both sides. Mr. Chavis stated that
typically they don't put arterial roads through subdivisions which are the foundation for the
removal of an arterial road in this particular area. Additionally, Mr. Chavis stated that as the
plans exist, the roadway actually terminates interior into the subdivision. Tiffany Foster, Director
of Planning and Community Development noted that there's a connection for the road in
question for more of a local road, but further stated that currently there's no plan to extend it

down to Spur 330. She stated that the local roads were not on the MTFP and noted that their goal
is to not have major arterials going through residential neighborhoods, but noted that they would
revisit this topic and come back before Council. Deputy City Manager Bottoms noted that this
road would affect the Exxon property including the associated environmental issues.
With regards to Frame 2, Mr. Chavis stated that this is the road network stemmed from the San
Jacinto Boulevard extension, in which the Archer Road connection terminates into John
Martin, does not cross San Jacinto, but stops at the end of Shepherd. He stated that this particular
segment is hindered by the Harris County Flood Drainage Ditch, the significant amounts of
wetlands, as well as a pipeline that will take place; therefore, staff recommended its removal.
Deputy City Bottoms noted that this entire area of rights-of-way is taken up with the flood
control ditch so the connection is going to be challenging.
Mayor DonCarlos inquired as to how to distinguish between the major and minor arterial. In
response to Mayor DonCarlos's inquiry, Mr. Chavis stated that distancing, rights-of-way widths,
and speed limits are some of the criteria that indicate the difference between the two arterials.
During further discussion regarding Frame 2, Mr. Chavis noted that there's also
a proposed amendment to construct Hunt Road into a four (4) lane arterial to provide for a more
straight alignment.
With there being no one registered to speak regarding agenda item 5.a., Mayor DonCarlos closed
the public hearing at 7:06 P.M.
b. Consider an ordinance amending the Baytown 2025 Comprehensive Plan's Major
Thoroughfare Plan (MTFP) to revise and update the current plan of the City of Baytown,
Harris County, and Chambers County, Texas.
Mayor DonCarlos noted that during previous discussion regarding this agenda item, Council
requested the removal of the Archer Road extension to the west and the Hutto Road extension to
the south.

Heather Betancourth approving Ordinance No. 13,867, regarding agenda item 5.b., with the
exclusion of the extension of Archer Road to the west and Hutto Road to the south. The vote was

UPDATE THE THOROUGHFARE PLAN TO REVISE AND UPDATE THE
CURRENT PLAN OF THE CITY OF BAYTOWN, HARRIS COUNTY, AND
CHAMBERS COUNTY, TEXAS; AND PROVIDING FOR THE EFFECTIVE
DATE THEREOF.
6. PROPOSED RESOLUTIONS
a. Consider a resolution approving revised federal legislative priorities for the
remainder of the 115th United States Congress.
Mr. Woolery presented the agenda item and stated that in January 2017, Council adopted
legislative priorities for the last State Legislative session and the 115th US Congress. He
stated some unique issues developed so the priorities needed to be revised to cover the remainder
of the congressional session. He further stated that Mayor DonCarlos, City Manager Davis and
himself would be visiting Washington D.C. later in September to discuss the priorities that
include working with the EPA to make sure that they continue working on the following:
remediation of the San Jacinto Waste Pits Super Fund site, supporting the City regarding
Hurricane Harvey disaster recovery, support legislation that provides more authority for cities to
regulate group homes for health and safety welfare, support funding for major transportation
projects along with the efforts of having as much local control as possible, supporting the Army
Corps of Engineers efforts to make the necessary improvements to Cedar Bayou, and continue
work force development efforts.
Council Member Hoskins stated with regards to the disaster recovery or the priority
infrastructure that assistance is needed because with the recent flood the Highway 146 overpass
over Cedar Bayou is spanned down too much and held backwater. Mr. Woolery stated that this
concern was identified and noted that he wasn't sure if it fits under this list of priorities but it
could be considered for the January session. City Manager Davis recommended that this be
blended with the discussion of the Cedar Bayou improvements.

In. Consider an ordinance adopting the Incentive Policy for the Baytown Revitalization
Incentive Zone to exercise certain municipal powers in such neighborhood empowerment
zone.
n. Consider a resolution renewing the Baytown Revitalization Incentive Zone, a
neighborhood empowerment zone within a portion of the City of Baytown.
Council Member Presley inquired for clarity if the proposed changes to the policy would impact
organizations in this area that were trying to improve the neighborhood. In response to Council
Member Presley's inquiry, CDBG Program Manager, June Tyler stated that staff actually
streamlined the process to make is easier for tax exempt organizations to apply.
Council Member Presley further stated that there was discussion with regards to adjusting the
boundaries and inquired if the boundaries was reviewed for such adjustments. Mrs. Tyler stated
that staff reviewed the areas along Bayway Drive, but there's a pending corridor Bayway study in
which they want to get the results from first before moving forward. City Manager Davis noted
that the study is budgeted to be done in the upcoming fiscal year.

City Clerk, Leticia Brysch presented the agenda item to consider the reappointment of Mr. David
Carr, District 5 Appointment; Mr. Gilbert Santana, District 1 Appointment; Mr. Shawn
McDonald, District 3 Appointment; and Mrs. Brenda Bradley Smith, Representative of Harris
County to the Baytown Tax Increment Reinvestment Zone No. One and the Baytown
Redevelopment Authority, being that they were eligible to serve another term. Additionally, she
stated that there's a vacancy on these two (2) boards, in which they no longer have to be a
representative or appointment from Lee College, but are City Council approved appointments.
A motion was made by Council Member Laura Alvarado and seconded by Mayor Pro Tem
Charles Johnson approving the appointments of David Carr, District 5; Gilbert Santana, District
1; Shawn McDonald, District, District 3; and Brenda Bradley Smith, Representative of Harris

9. MANAGER'S REPORT
a. The Baytown Farmer's Market at Town Square will be held at Town Square on the
third Saturday of each month from 8:00 A.M. - 1:00 P.M.
Director of Parks and Recreation, Scott Johnson presented the agenda item and stated that the
Baytown Farmer's Market at Town Square was scheduled to be held at Town Square on the
third Saturday of each month from 8:00 A.M. - 1:00 P.M. Additionally, he noted that this event
would be annually and entirely inside of Town Square; therefore, no street closures would be
necessary.
b. Present information regarding the City of Baytown's 2018 Cards for Troops
Campaign.
Assistant City Manager Kevin Troller presented the agenda item and stated that the year 2018 is
the 7`h year that the City of Baytown would assist with the Cards for Troops Campaign.
10. EXECUTIVE SESSION
a. Recess into and conduct an executive session pursuant to Texas Government Code,
Section 551.071 to seek the advice of the City's attorneys regarding contemplated litigation.
At 7:23 P.M., Mayor DonCarlos recessed into and conducted an executive session pursuant to

At 8:08 P.M., Mayor DonCarlos reconvened the Open Meeting of the Regular City Council
Meeting and announced that in accordance with Section 551.102 of the Texas Government Code,
no action was taken in the Executive Session.
