Ordinance No. 13,953ORDINANCE NO. 13,953 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, AUTHORIZING THE PAYMENT IN THE AMOUNT OF ONE HUNDRED SEVENTY-TWO THOUSAND THREE HUNDRED FIFTY-ONE AND 30/100 DOLLARS ($172,351.30) TO THE TEXAS COMMISSION ON ENVIRONMENTAL QUALITY FOR THE ANNUAL CONSOLIDATED WATER QUALITY FEES FOR THE CITY'S FOUR (4) WASTEWATER TREATMENT PLANTS; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. ************************************************************************************* WHEREAS, the Texas Commission on Environmental Quality ("TCEQ") in response to the Clean Water Act has established a program to assess the quality of the river basins of the State; and WHEREAS, Senate Bill 818 requires the TCEQ to recover the reasonable cost of the assessment program from wastewater treatment permit holders and water rights holders; and WHEREAS, the Consolidated Water Quality Fees are assessed annually each October 31st and imposed on each person holding a permit under the V.T.C.A., Water Code, §§26.001, et seq.; NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section 1: That the City Council of the City of Baytown, Texas, hereby authorizes the payment in the amount of ONE HUNDRED SEVENTY-TWO THOUSAND THREE HUNDRED FIFTY-ONE AND 30/100 DOLLARS ($172,351.30) to the Texas Commission on Environmental Quality for the Annual Consolidated Water Quality Fees for the City's four (4) Wastewater Treatment Plants. Section 2: That the City Manager is hereby granted general authority to approve any change involving a decrease or an increase in an amount authorized in Section 1 hereinabove of FIFTY THOUSAND AND N0/100 DOLLARS ($50,000.00) or less; however, the original contract price may not be increased by more than twenty-five percent (25%) or decreased by more than twenty-five percent (25%) without the consent of the Texas Commission on Environmental Quality to such decrease.
