Ordinance No. 13,933ORDINANCE NO. 13,933 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, ACCEPTING THE BID OF DAN WHEELER WRECKER SERVICE, INC., FOR HEAVY-DUTY TOWING AND STORAGE SERVICES; AUTHORIZING AN ADDENDUM RELATED THERETO; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. ************************************************************************************* WHEREAS, the City Council of the City of Baytown did advertise for bids for Heavy -Duty Towing and Storage Services to be received on October 8, 2018; and WHEREAS, notice to bidders as to the time and place, when and where the bids would be publicly opened and read aloud was published pursuant to provisions of Texas Local Government Code Annotated § 252.041; and WHEREAS, all bids were opened and publicly read at City Hall at 2:00 o'clock p.m., Monday, October 8, 2018, as per published notice to bidders; NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section 1: That the City Council of the City of Baytown hereby accepts the bid of Dan Wheeler Wrecker Service, Inc., for heavy-duty towing and storage services for tows authorized by the Baytown Police Department or other authorized City official, which bid included the following fees: selwice Amount Bid Towing Services $300 per hour along with payment to the City of Baytown in the amount of THREE HUNDRED SEVENTY-FIVE AND N0/100 DOLLARS ($375.00) per year. Section 2: That the City Council of the City of Baytown, Texas, hereby authorizes and directs the City Manager of the City of Baytown to execute the Addendum to Invitation to Bid #1809-10, which is attached hereto, marked Exhibit "A," and incorporated herein for all i ents and purposes. Section 3: This ordinance shall take effect immediately fro d after its passage by the City Council of the City of Baytown. (the "Towing Company") agree that the following items in the ITB will not be a part of the contract: 1.2 b. Successful bidders will be allowed four (4) passes per calendar month, except as provided in 1.2(c) below. (A pass is defined as: declining a tow when called by dispatch, not answering when called by dispatch, removing name from the rotation list, or otherwise not taking a tow when requested to do so.) 1.2 c. Each successful bidder will be allowed to remove its name from the call list for either one two-week period or two one-week periods during a calendar year. This removal will not constitute a pass. However, only one bidder may be removed for any given date. Removal dates will be first come, first served. 1.3 a. (delete "on a rotation basis") 8.5 Passing, as that term is defined in Section 1.2(b) of Exhibit A, more than four (4) times in a calendar month. The Parties also agree that if an emergency arises where the capacity of the Towing Company is exceeded, the Towing Company shall locate another towing service provider to provide services for the emergency period only under the same terms and conditions as specified in the ITB at the rates bid by the Towing Company. The Towing Company will be responsible to assure all conditions of the ITB are followed by the assisting towing service. The Towing Company will also be responsible to report tows and submit fees to the City for the tows provided by the assisting towing service. The City shall be notified immediately upon the determination of such an emergency and shall be notified of the company who will be assisting. The City's Chief of Police shall have the ability to decline the use of any particular assisting towing service, in which case the Towing Company will have to locate another assisting towing service acceptable to the City's Chief of Police.
