AN ORDINANCE CONTAINING ORDINANCE NO. 627, INTRODUCED
THE 8TH DAY OF JUNE, 1961, AND BEING: "AN ORDINANCE
ENLARGING AND EXTENDING THE BOUNDARY LIMITS OF THE CITY
OF BAYTOWN, TEXAS, AND ANNEXING ADDITIONAL ADJACENT TER-
RITORY TO SAID CITY, ALL OF WHICH IS DESCRIBED HEREIN;
CONTAINING A SAVINGS CLAUSE, AND PROVIDING FOR THE PUB-
LICATION OF THIS ORDINANCE IN THE MANNER PROVIDED IN
ARTICLE I, SECTION 9, OF THE CHARTER OF THE CITY OF
BAYTOWN"; PROVIDING FOR THE AMENDMENT OF SAID ORDINANCE
NO. 627 WITH RESPECT TO THE TERRITORY TO BE ANNEXED AND
FOR THE FINAL PASSAGE OF SAID ORDINANCE IN ANIENDED FORM
PURSUANT TO SECTION 9, ARTICLE 1, OF THE CHARTER OF THE
CITY OF BAYTOWN.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN:
Section 1: That pursuant to Section 9, Article 1, of the City Charter, said
Ordinance No. 627, introduced to the City Council of the City of Baytown, on the 8th
day of June, 1961, shall be amended and so amended shall read as follows:

AN ORDINANCE ENLARGING AND EXTENDINGTHE BOUNDARY LIMITS
OF THE CITY OF-BAYTOWN, TEXAS, AND ANNEXING ADDITIONAL
ADJACENT TERRITORY -TO SAID CITY, ALL OF WHICH IS DESCRIBED
HEREIN; CONTAINING A SAVINGS CLAUSE, AND PROVIDING FOR THE
PUBLICATION AND PASSAGE OF THIS ORDINANCE IN THE MANNER
PROVIDED IN ARTICLE 1, SECTION 9, OF THE CHARTER OF THE
CITY OF BAYTOWN.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS:
Section 1: Intent & Purpose of this Ordinance: The City Council of the City
of Baytown, acting pursuant to Section 9, Article 1, of the Charter of said City
hereby declares that it is necessary that the existing boundary limits of the City
be extended to include the hereinafter described territory lying adjacent to the
City and that the existing boundary limits of the City be extended to include such
territory. The purpose and intent of this extension of the boundary limits of the
City of Baytown is to take care of said City's present needs for additional terri-
tory and the reasonably anticipated future growth and expansion of the City.
Section 2: That the boundary limits of the City of Baytown, Texas, be en-
larged and extended as hereinafter set out so as to include within the boundary lim-
its of said City, all that territory adjacent to said City within the following
described lines, to -wit:

BEGINSVING at the point of intersection of the Easterly line of Bay
Villa Subdivision in the William Scott Upper League, and the Northeasterly
shore of Scott's Bay, said point of intersection being situated South 31
degrees 46 minutes West 460.9 feet from the Northwest corner of Bay Villa
Addition, said corner being located in the Southwesterly right of way line
of Market Street Road;
THENCE, in a Westerly direction along the shore line of Scott's Bay at
mean high tide to the Southwest corner of Lot 10, in Block K in the town
of Wooster;
THENCE, Northwesterly along the West line of Lot 10. Block K in the towm
of Wooster to the Southeast corner of Lot 9, Block K of the town of Wooster;
THENCE, in a Southwesterly direction along the South line of Block K in
the town of Wooster to the Easterly shore line of Crystal Bay;
THENCE, Northerly along the Easterly shore of Crystal Bay to the West line
of Block AA of the Brownwood replat of the town of Wooster;
THENCE, North 42 d6grees 19 minutes East along the Westerly boundaries of
said Block AA, 465.8 feet to the Southwest corner of Block B of the Brown -
wood replat of the town of Wooster;
THENCE, North 30 degrees 13 minutes East, 409.0 feet to the Southerly shore
of Burnett Bay at mean high tide;
THENCE, Easterly and Northerly along the shore line of Burnett Bay to the
centerline of the mouth of.Spring Gully; `
THENCE, Northerly. following the meanders of the centerline of Spring Gully
to the South line of State Highway Spur 330 (Mar et Street) and continuing
Northerly over and across State Highway Spur 330 to the North right of way
line;
THENCE. Southeasterly along the North right of way line of State Highway
Spur 330 to the North line of the Harvey Whiting Survey;
THENCE, Easterly along the North line of the Harvey Whiting Survey to the
centerline of Goose Creek Stream;
THENCE, Southerly following the meanders of the centerline of Goose Creek
Stream to the North right of way line of Baker Road, and continuing South-
erly over and across Baker Road to the.South right of way line of Baker Rd.
THENCE, Easterly with the South right of way line of Baker Road to Garth
Road and continuing Easterly over and across Garth Road to the Southwest
corner of a 189.05 acre tract of land owned by Wilburn Brothers;
THENCE, continuing Easterly with the South line of the Wilburn Brothers'
189.05 acre tract of land to the Northwest corner of a 309.10 acre tract
owned by the estate of Dr. and Mrs. G. A. Lilly;
THENCE. continuing Easterly with the North line of the Lilly tract to North
Main Street, and continuing Easterly to the East right of way line of North
Main Street;
THENCE, Southerly with the East right of way line of North Main Street to
a line which is 200 feet North of and parallel to the North.right of way
line of Massey -Tompkins Road;
THENCE, Easterly with the line which is 200 feet North of and parallel to
the North right of way line of Massey -Tompkins Road to the West right of way
line of State Highway No. 146;
THENCE, Northeasterly with the West right of way line of State Highway No.
146 to the Westerly shore of Cedar Bayou Stream;
THENCE, Southerly with the meanders of the mean high tide line of the
Westerly shore of Cedar Bayou Stream to the most Easterly Northeast corner
of a 41.23 acre tract of land owned by the City of Baytown, said tract of
land described in deed recorded in Volume 1226, Page 116 of the Deed Records
of Harris County, Texas;

THENCE, with the North line of the City of Baytown's tract, South 81 degrees
04 minutes 20 seconds West a distance of 709.08 feet; South 82 degrees 20
minutes 40 seconds West a distance of 569.95 feet; North 63 degrees 15 min-
utes 42 seconds West a distance of 297.86 feet; and North 74 degrees 23
minutes 33 seconds West a distance of 484.37 feet to the Northwest corner
of the City of Baytown's tract of land;
THENCE, with a Westerly line of the City of Baytown's tract, South 11
degrees 50 minutes 9 seconds West a distance of 423.29 feet to an in-
terior corner of the City of Baytown's tract;
THENCE, continuing to follwo the boundary line of the City of Baytown's
tract, South 35 degrees 14 minutes 41 seconds Rest a distance of 108.97
feet; North 11 degrees 50 minutes 09 seconds East a distance of 96.91
feet; and South 82 degrees 54 minutes 28 seconds West a distance of
275.76 feet to the most Westerly Northwest corner of the City of Baytown's
41.23 acre tract of land, said corner located in the Easterly right of way
line of Cedar Bayou Road;
THENCE," continuing Westerly over and across Cedar Bayou Road to the West-
erly right of way line of Cedar Bayou Road;
THENCE, Southerly with the Westerly right of way line of Cedar Bayou Road
to the centerline of Pond's Gully;
THENCE, upstream in a Northwesterly direction with the meanders of the
centerline of Pond's Gully to the Month line of the J. B. Sprulock 72 acre
tract of land, said point also being the point of confluence of said Gully
with the Harris County Drainage Ditch;
THENCE, Westerly with the North line of said J. B. Sprulock 72 acre tract
to the West right of way line of McKinney Road, said West right of way
line also being the West boundary line of the Christian Smith Survey;
THENCE, Northerly with said West right of way line of McKinney road to
the intersection of the Southeasterly right of way line of State Highway
No. 146.
THENCE, Northeasterly and Easterly with the South right of way line of
State Highway No. 146 to the point of intersection of said right of way
line with a Southerly extension of the East property line of the Cedar
Bayou Baptist Church;
THENCE, North 9 degrees 30 minutes West with the southerly extension of
the East line of the Cedar Bayou Baptist Church property to the North
right of way line of State Highway No. 146, and continuing with the East
line of said property to the Northeast corner of said Cedar Bayou Baptist
Ch=h property;
THENCE, South 80 degrees 30 minutes West with the North line -of the Cedar
Bayou Baptist Church property, a distance of 359 feet to the Northwest
corner of the church property;
THENCE, South 9 degrees 30 minutes East with the West line of the Cedar
Bayou Baptist Church property approximately 72 feet to the North right of
way line of State Highway No. 146; also being the Southwest corner of the
cedar Bayou Baptist Church property;
THENCE, Westerly with the North right os way line of State Highway No.
146, to a point which is opposite, at right angles to the centerline of
State Highway No. 146. the point of intersection of the centerline of
Bob Smith Road and the centerline of State Highway No. 146;
THENCE, North to a line which is 100 feet North of and parallel to the
North right of way line of Bob Smith Road;
THENCE, Westerly, along said line which is 100 feet North of and parallel
to the North right of way line of Bob Smith Road to the point of intersec-
tion of said line with the West right of way line of North Main Street;

to the North line of the J. G. and Annie Schilling 210.6 acre tract of
land, being also the South line of Aaron Brothers' 210 acre tract of land;
THENCE, in a Westerly direction along the North line of the J. G. and
Annie Schilling 210.6 acre tract of land to the most southerly Southwest
corner of a 39.99 acre tract owned or formerly owned by the Baytown Cham-
ber of Commerce;
THENCE, North with the West line of a 5.0 acre tract known as the Armory
Tract and an East line of the said Chamber of Commerce Tract, a -distance
of 555.2 feet to a corner; said point being the Northwest coreer of said
Armory Tract;
THENCE, East 392.29 feet with the North line of Armory Tract to a point
being the Northeast corner of the Armory Tract;
THENCE, South along the East line of said Armory Tract 60 feet to a point;
THENCE, East 342.54 feet to a point located in the West right of way line
of North blain Street;
THENCE, North 1 degree 02 minutes East with the West right of way line of
said North blain Street 140.4 feet to a point, being the Northeast corner
of the said Chamber o.:Commerce Tract;
THENCE, West 3,429.09 feet to the Northwest corner of the Chamber of Com-
merce Tract;
THENCE, with the East line of a tract of land owned by Leroy B. Walker,
also a West line of a tract of land owned by Howell Brothers, North 13
degrees 11 minutes East 58.6 feet, and North 52 degrees 40 minutes West
67.70 feet to the centerline of the East fork of Goose Crrek Stream;
THENCE, Easterly and Northeasterly upstream with the meanders of the
centerline of Goose Creek Stream to the North line of the Howell Brothers
tract;
THENCE, North 89 degrees 26 minutes West with the North line of the Howell
Brothers Tract 1,483.8 feet to the East right of way line of Garth Road;
THENCE, South 0 degrees 20 minutes West with the East right of way line
of Garth Road to the North line of the 210.6 acre tract of land formerly
owned by J. G. and Annie Schilling.
THENCE, in a Westerly direction over and across Garth Road, and continu-
ing Westerly with the North line of the J. G. and.Annie Schilling tract
to the East bank of Goose Creek Stream;
THENCE, continuing over and across Goose Creek Stream to the West bank
of Goose Creek Stream also being the Easterly line of the Busch Estate;
THENCE, northwesterly with the meanders of the West bank of Goose Creek
Stream to the North line of the William Scott Upper League;
THENCE, Westerly along the north line of the William Scott Upper League
to the intersection of said line with the Northeasterly ritht of way
line of Decker Drive; thence, continuing along the said North line of the
William Scott Upper League over and across the aforesaid Decker Drive to
a point on the Southwesterly right of way line of said Decker Drive; said
point also being the Southeast corner of the Humble Oil & Refining Com-
pany's tract (24.6370 Acre);
THENCE, North 40 degrees 02 minutes West along the aforesaid Southwesterly
right of way line of Decker Drive a distance of approximately 360.72 feet
to a point; said point being the point of curvature and the point of be-
ginning of proposed Southwesterly right of way line of Decker Drive;
THENCE, Northwesterly along dhe above mentioned curve proposed South -
Westerly right of way line of Decker Drive a distance of approximately
93.85 feet through a point, said point being a point on the Northerly
property line of the Humble Oil 6 Refining Company's 24.6370 acre tract
and the Southerly property line of the Texas Eastern Transmission Cor-
poration's 60.0924 acre tract and being situated South 89 degrees 34
minutes West a distance of approximately 1.04 feet from the Easterly
property corner between the two above mentioned tracts;
THENCE, continuing Northwesterly along the aforesaid curve, having a
radius of 11,459.16 feet of the proposed Southwesterly right of way line
of Decker Drive a distance of approximately 360.61 feet to a point, said
point being the end of the curve of the proposed Southwesterly right of
way line of Decker Drive;
THENCE, North 42 degrees 18 minutes West along the aforementioned South-
westerly right of way line of Decker Drive a distance of approximately
35.92 feet to a point;
THENCE, South 89 degrees 34 minutes West into, over and across the private
property of the above mentioned Texas Eastern Transmission Corporation's
60.0924 acre tract with a line parallel to and 300 feet Northerly from
the Southerly boundary line of the above mentioned Texas Eastern Trans-
mission Corporation's 60.0924 acre tract a distance of approximately
2531.85 feet to a point on the Westerly boundary line of the aforesaid
Texas Eastern Transmission Corporation's 60.0924 acre tract; said boundary
line being the Easterly boundary line of the San Jacinto River Project,
East Canal.
THENCE, South -14 degrees 54 minutes West along the boundary line between
the aforementioned Texas Eastern Transmission Corporation's 60.0924 acre
tract and the San Jacinto River Project East Can9l a distance of approxi-
mately 311.07 feet to a point, said point being the Southwest corner of
the Texas Eastern Transmission Corporation's 60.0924 acre tract and the
northwest corner of the Humble Oil & Refining Company's 24.6370 acre
tract; ,

THENCE, continuing South 14 degrees 54 minutes West through said point
and along the boundary line between the Humble Oil & Refining Company's
24.6370 acre tract and the San Jacinto River Project East Canal a dis-
tance of 362.93 feet to a point, said point being on the North line of
the William Scott Upper League Survey and the Easterly line of the San
Jacinto River Project East Canal
THENCE, Westerly along the North line of the William Scott Upper League w
to the intersection of said line with the East line of the Steinman tract;
being also known as the C. A. Fortner 39 acres;
THENCE. Southerly with the East line of the Steinman tract to the South-
east corner of the Steinman tract, being also the Northeast corner of
Sweeney Addition;
THENCE, South 20 degrees 7 minutes West along the East line of the Sweeney
Addition a distance of 2,669 feet to the Southeast corner of Sweeney Addi-
tion, being located in the North line of the Cedar Bayou Wooster Road;
THENCE, South 21 degrees 3 minutes West over and across the Cedar Bayou -
Wooster Road and continuing South 21 degrees 3 minutes west with the West
line of the Humble Oil & Refining Company, a distance of 536.9 feet to
the Northeast right of way line of Market Street Road.
THENCE, South 20 degrees 44 minutes West, over and across Market Street
Road a distance of 114.4 feet to the Southwest right of way line of harket

BEGINNING at the most Westerly Southwest corner of the Harvey Whiting
Survey, bieng also the Northwest corner of the William Scott Upper League;
THENCE, Northerly along the West line of the Harvey Whiting Survey to the
South right of way line of Baker Road;
THENCE, Easterly along the South line of Baker Road to the Westerly right
of way line of State Highway Spur 330 (Decker Drive);
i THENCE, Southeasterly along the Westerly right of way line of State High-
way Spur 330 a distance of 2,452.33 feet to a point;
THENCE, South 89 degrees 34 minutes West, over and across the private pro-
perty of the Texas Eastern Transmission Corporation's 60.0924 acre tract
with a line parallel to and 300 feet Northerly from the Southern boundary
line of the above montioned Texas Eastern Trasmission Corporation's tract
to the Westerly boundary line of said tract;
THENCE, Southerly with the Westerly boundary line of the Texas Eastern
Transmission Corporation's tract to the North line of the William Scott
Upper League, being also a south line of the Harvey Whiting Survey;
THENCE, Westerly with the North.line of the William Scott Upper League
to the POINT OF BEGINNING.
Section 3: That the above described additional territory and area so
annexed shall be a part of the City of Baytown, and the property so added to said
City shall bear its pro rata part of the taxes levied by the City of Baytown and
the inhabitants thereof shall be entitled to all the rights and privileges of all
the citizens and shall be bound by the acts, ordinances, resolutions, regulations
• and improvisions of the Charter of the City of Baytown.
Section 4: That if any portion or portions of the above described territory
is validly included within the territorial limits of another city or town, then
such portion or portions of the above described territory is hereby excluded and
the remaining territory is hereby annexed to the City of Baytown, and the boundary
limits of said city are hereby amended to conform to the boundary limits of such
other city or town or such other cities or towns along the area of the conflict.
Section 5: That if any portion or portions of the above described territory
legally may become included within the limits of another city or town, by reason of
a valid annexation ordinance heretofore introduced before the council, commission
or other govening body of such city or town, then such portion or portions of the
above described territory is hereby excluded fromthe limits of the City of Baytown
and the remaining territory is hereby annexed to the City of Baytown and the cound-
ary limits of said City of Baytown are hereby amended to conform to the boundary
limits of such city or town or such other cities or towns along the area of the
conflict.
Section 6: That if any legal impediment exists preventing the valid annexa-
tion of any portion of the above described territory to the City of Baytown, then
such portion of the above described territory is hereby excluded and the remaining
territory is hereby annexed to tie City of Baytown and the boundary limits of said 0
City of Baytown are hereby amended to conform to the territory so annexed.
Section 7: That the above described territyory, so annexed, contains all of
Harris County Rater Control and Improvement District No. 58 andallof the proper-
ties and assest of such District are hereby taken over by the City of Baytown and
that said City hereby assumes all debts, liabilities and obligations of such Dis-
tract and shall perform all functions and services of such district. For greater
clarity the City Council of the City of Baytown hereby takes complete control of
and jurisdiction over, such District and hereby abolishes same immediately.
Section 8: That the above described territory, so annexed, contains all of
Harris County Fresh Rater Supply District No. 8 and that all of the properties and
assets of such District are hereby taken over by the City of Baytown and that said
City hereby assumes all debts, liabilities and obligations of such District and
shall perform all functions and services of such District. For greater clarity the
City Council of the City of Baytown hereby takes complete control of, and jurisdic-
tion over, such District and hereby abolishes same immediately.
Section 9: If any provision, exception, section, paragraph, sentence, clause
or phrase of this ordinance or the application of same to any person or set of cir-
cumstances or to any particular tract or parcel of land, shall for any reason be
held unconstitutional, void or invalid, such invalidity shall not effect the validity .
of the remaining provisions of this ordinance or their application to other persons
or sets of circumstances or to other tracts or parcels of land included in the
territory hereinabove described in Section 2 of this ordinance.
Section 10: That this ordinance upon and after its introduction shall be
published and finally acted upon in the manner provided in Article 1, Section 9 of
the Charter of the City of Baytown.

Council of the City of Baytown on this the 8th day of June, 1961.
