Ordinance No. 13,813ORDINANCE NO. 13,813 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, AUTHORIZING THE PAYMENT OF ONE HUNDRED FOURTEEN THOUSAND FOUR HUNDRED NINE AND 40/100 DOLLARS ($114,409.40) TO AXON ENTERPRISE INC. F/K/A TASER INTERNATIONAL, INC., FOR THE PURCHASE OF ONE HUNDRED TEN (110) BODY -WORN CAMERAS WITH RELATED EQUIPMENT AND AN ALL-INCLUSIVE UNLIMITED DATA STORAGE PLAN FOR THE POLICE DEPARTMENT, THROUGH THE TEXAS LOCAL GOVERNMENT PURCHASING COOPERATIVE (BUY BOARD); MAKING OTHER PROVISIONS RELATED THERETO; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. ********************************************************************************* WHEREAS, the City of Baytown is a member of the cooperative purchasing program established under Sections 271.082 and 271.083 of the Texas Local Government Code; and WHEREAS, the Texas Local Government Purchasing Cooperative's Buy Board Program is such a program, allowing municipalities to purchase products and/or services in an efficient, cost effective, and competitive procurement method; and WHEREAS, the City of Baytown in making a purchase under a state contract through such cooperative purchasing program satisfies state law requiring municipalities to seek competitive bids for the purchase of the item; WHEREAS, on April 13, 2017, City Council approved Ordinance No. 13,449, which authorized the purchase of one hundred ten (110) body -worn cameras, its related equipment and an all-inclusive unlimited data storage plan for the Police Department, from Axon Enterprise Inc., f/k/a Taser International, Inc., through the Texas Local Government Purchasing Cooperative (Buy Board); and WHEREAS, the second of three payments for the replacement program is now due with the third being due in 2019; NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section 1: That the City Council of the City of Baytown hereby authorizes the payment of ONE HUNDRED FOURTEEN THOUSAND FOUR HUNDRED NINE AND 40/100 DOLLARS ($114,409.40) to Axon Enterprise Inc. f/k/a Taser International, Inc. for the one hundred ten (110) body -worn cameras with related equipment and an all-inclusive unlimited data storage plan for the Police Department. Section 2: That the City Manager is hereby granted general authority to approve any change order involving a decrease or an increase in costs of FIFTY THOUSAND AND NO/100 DOLLARS ($50,000.00) or less, provided that the original contract price may not be increased by more than twenty-five percent (25%) or decreased by more than twenty-five percent (25%) without the consent of the contractor to such decrease. Section 3: This ordinance shall take effect immediately from and aft 'r its passage by the City Council of the City of Baytown.
