AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN,
TEXAS, AUTHORIZING THE PAYMENT OF THE SUM OF EIGHTY-SIX
THOUSAND ONE HUNDRED FOURTEEN AND 55/100 DOLLARS ($86,114.55)
TO MILLENNIUM PROJECT SOLUTIONS, INC., FOR THE PURCHASE AND
INSTALLATION OF A 150 KVA GENERATOR AND TWO (2) TRANSFER
SWITCHES AT THE BAYTOWN FIRE DEPARTMENT SOUTH COMMAND
STATION LOCATION AT 109 S. MAIN ST., BAYTOWN, TEXAS; MAKING
OTHER PROVISIONS RELATED THERETO; AND PROVIDING FOR THE
EFFECTIVE DATE THEREOF.

WHEREAS, Texas Local Government Code Annotated §252.022 provides that when there is
unforeseen damage to public machinery, the requirement for competitive bids is not applicable; and
WHEREAS, the 150 kVA generator and two (2) transfer switches at the Baytown Fire
Department South Command Station located at 109 S. Main St., Baytown, Texas, were damaged
during Hurricane Harvey; and
WHEREAS, the City desires to replace the 150 kVA generator and two (2) transfer switches
due to such unforeseen damage before the upcoming hurricane season; and
WHEREAS, the City obtained three (3) informal bids for such equipment and services, which
resulted in a bid submitted by Millennium Project Solutions, Inc., which was determined to be both
the lowest bidder and the bidder that will provide the goods and services at the best value to the City
of Baytown; NOW THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS:
Section 1: That the City Council of the City of Baytown, Texas, hereby declares that the
replacement of the 150 kVA generator and transfer switches at the Baytown Fire Department South
Command Station located at 109 S. Main St., Baytown, Texas, is necessary due to the unforeseen
damage caused by Hurricane Harvey.
Section 2: That the City Council of the City of Baytown, Texas, authorizes payment of
the sum of EIGHTY-SIX THOUSAND ONE HUNDRED FOURTEEN AND 55/100 DOLLARS
($86,114.55) to Millennium Project Solutions, Inc., for the purchase and installation of a 150 kVA
generator and two (2) transfer switches at the Baytown Fire Department South Command Station
located at 109 S. Main St., Baytown, Texas.
Section 3: That pursuant to the provisions of Texas Local Government Code Annotated §
252.048, the City Manager is hereby granted general authority to approve any change order involving
a decrease or an increase in costs of FIFTY THOUSAND AND NO/100 DOLLARS ($50,000.00) or
less, subject to the provision that the original contract price may not be increased by more than
twenty-five percent (25%) or decreased by more than twenty-five percent (25%) without the consent
of the contractor to such decrease.
Section 4: This ordinance shall take effect immediately from and after its passage by the
City Council of the City of Baytown.
