CC Resolution No. 2518RESOLUTION NO. 2518 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, ESTABLISHING A POLICY REGARDING PUBLIC IMPROVEMENT DISTRICTS AND MUNICIPAL UTILITY DISTRICTS IN THE CITY OF BAYTOWN AND/OR ITS EXTRATERRITORIAL JURISDICTION; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. ************************************************************************************ WHEREAS, the City Council of the City of Baytown offers various incentives to encourage developments within the corporate limits of the City and in the extraterritorial jurisdiction ("BTJ") ; and WHEREAS, these incentives are offered through various financings and may include the establishment of a municipal utility district ("MUD") or a public improvement district ("PID"); and WHEREAS, the City Council desires to establish certain minimum thresholds that must be satisfied before it will entertain establishing or consent to the establishment of a PID or a MUD; and WHEREAS, the City Council desires staff to develop guidelines to implement the policies herein set forth; NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section 1: That the City Council hereby finds that PIDs and MUDS are effective development financing tools that may be appropriate in certain circumstances if the thresholds described in Section 2 are satisfied and if they are located in accordance with the following chart: Corporate ETJ Llimts Section 2: That should the territory of a proposed MUD or PID meet the location requirements specified in Section 1 hereof, the following minimum thresholds must be met in order for the City Council to establish or consent to the establishment of a PID or a MUD: Threshold,1 Minimum 100 acres X X Mid- to upper-level homes valued at a minimum $300,000 X No more than 6 residential units to the acre for overall development X Negotiated development agreement for specific planning and development standards X X Themed development - signage, lighting, landscaping, fencing, and decorative amenities X X Tree -lined streets and sidewalks X X Tree survey and preservation plan X X Dedicate site/easements for regional utility improvements — if X X applicable Detention facilities to be perpetually maintained X X Limited Purpose Annexation/Strategic Partnership Agreement X X Section 3: That the City Manager is directed to develop guidelines to implement this policy.
