A RESOLUTION OF THE BOARD OF DIRECTORS OF THE BAYTOWN AREA
WATER AUTHORITY AUTHORIZING PAYMENT IN THE AMOUNT OF ONE
HUNDRED SIX THOUSAND FIVE HUNDRED AND N0/100 DOLLARS
($106,500.00) TO W WATERTECH SERVICES, INC., FOR THE PURCHASE OF A
CHAIN AND FLIGHT SLUDGE COLLECTION SYSTEM TO REMOVE THE
SLUDGE FROM THE BOTTOM OF A SEDIMENTATION BASIN AT THE FRITZ
LANHAM SURFACE WATER TREATMENT PLANT; MAKING OTHER
PROVISIONS RELATED THERETO; AND PROVIDING FOR THE EFFECTIVE
DATE THEREOF.

WHEREAS, state law provides that when the functional requirements of the Baytown Area Water
Authority can only be satisfied by one source, the requirement for competitive bids is not applicable; and
WHEREAS, the procurement of a chain and flight sludge collection system to remove the sludge
from the bottom of the sedimentation basin at the Fritz Lanham Surface Water Treatment Plant can be
satisfied by only one source -- W Watertech Services, Inc.; NOW THEREFORE,
BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE BAYTOWN AREA WATER
AUTHORITY:
Section 1: That the Board of Directors of the Baytown Area Water Authority hereby
declares that only one source can satisfy the needs of the Baytown Area Water Authority for a chain and
flight sludge collection system to remove the sludge from the bottom of a sedimentation basin at the Fritz
Lanham Surface Water Treatment Plant.
Section 2: That the Board of Directors of the Baytown Area Water Authority authorizes
payment of the sum of ONE HUNDRED SIX THOUSAND FIVE HUNDRED AND NO/100 DOLLARS
($106,500.00) to W Watertech Services, Inc., as the sole source, for the purchase of a chain and flight
sludge collection system to remove the sludge from the bottom of the sedimentation basin at the Fritz
Lanham Surface Water Treatment Plant.
Section 3: That the General Manager is hereby granted general authority to approve any
change order involving a decrease or an increase in costs of FIFTY THOUSAND AND NO/100
DOLLARS ($50,000.00) or less, provided that the original contract price of the product purchased
pursuant to Section 2 may not be increased by more than twenty-five percent (25%) or decreased by more
than twenty-five percent (25%) without the consent of the contractor to such decrease.
Section 4: This resolution shall take effect immediately from and after its passage by the
Board of Directors of the Baytown Area Water Authority.
INTRODUCED, READ and PASSED, by the affirmative vote of the Board of Directors of the
Baytown Area Water Authority on this the 180' day of April, 2018.
