AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN,
TEXAS, AUTHORIZING PAYMENT BY THE CITY OF BAYTOWN IN AN
AMOUNT NOT TO EXCEED ONE HUNDRED TWENTY THOUSAND
FOUR HUNDRED FIFTY-THREE AND NO/100 DOLLARS ($120,453.00) TO
UTILITY TRUCK EQUIPMENT CO., LLC, FOR THE SOLE -SOURCE
PURCHASE AND INSTALLATION OF A MADVAC LS 175, SUB -COMPACT
SWEEPER WITH ALL RELATED APPURTENANCES FOR THE HEALTH
DEPARTMENT; MAKING OTHER PROVISIONS RELATED THERETO;
AND PROVIDING FOR THE EFFECTIVE DATE THEREOF.

WHEREAS, Texas Local Government Code Annotated §252.022 provides that when the
functional requirements of the City can only be satisfied by one source, the requirement for
competitive bids is not applicable; and
WHEREAS, Madvac LS 175, Sub -Compact Sweeper is the only sweeper that is compact
in size and designed with an "in -the -cab" controlled articulating arm suction boom to allow litter
to be vacuumed up in an approximate 15 -foot arc from the front of the unit without exiting the
unit; and
WHEREAS, the purchase the Madvac LS 175 Sub -Compact Sweeper may only be
purchased from a single source — Utility Truck Equipment Co., LLC; NOW THEREFORE
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN,
TEXAS:
Section 1: That the City Council of the City of Baytown, Texas, hereby declares that
only one source can satisfy the needs of the City for a Madvac LS 175 Sub -Compact Sweeper.
Section 2: That the City Council of the City of Baytown authorizes payment to
Utility Truck Equipment Co., LLC, for the sole -source purchase of a Madvac LS 175 Sub -
Compact Sweeper in an amount not to exceed ONE HUNDRED TWENTY THOUSAND FOUR
HUNDRED FIFTY-THREE AND NO/100 DOLLARS ($120,453.00).
Section 3: That the City Manager is hereby granted general authority to approve a
decrease or an increase in costs by FIFTY THOUSAND AND NO/100 DOLLARS ($50,000.00)
or less, provided that the amount authorized in Section 2 hereof may not be increased by more
than twenty-five percent (25%).
Section 4: This ordinance shall take effect immediately from and after its passage by
the City Council of the City of Baytown.
