PROVIDING FOR THE EFFECTIVE DATE THEREOF.

THAT GRANTOR HARRIS COUNTY, a body corporate and politic under the laws of
the State of Texas, owner of the below -described real property, for the consideration recited
herein, has GRANTED and CONVEYED, and by these presents do GRANT and CONVEY unto
to the CITY OF BAYTOWN, a municipal corporation of Harris County, (hereinafter
"GRANTEE"), a political subdivision of the State of Texas, the land more particularly described
in Exhibit "A," which is attached hereto and incorporated herein for all intents and purposes ( the
"Land"), such Land to be used for the respective public purpose of a water well for water utility
services for the people of Harris County, being a public purpose that benefits and serves the
public interest of Grantor, such conveyance and grant being made pursuant to Local Government
Code § 272.001(1).
TO HAVE AND TO HOLD the above-described Land, together with all and singular the
rights and appurtenances thereto in any wise belonging, unto the said CITY OF BAYTOWN, its
successors and assigns forever, in fee simple absolute. GRANTOR does hereby bind itself, its
successors and assigns to WARRANT and FOREVER DEFEND, the Land unto the said CITY
OF BAYTOWN, its successors and assigns, against every person whomsoever, lawfully
claiming or to claim the same or any part thereof by, through or under GRANTOR, but not
otherwise.
This conveyance is subject to all easements, restrictions and reservations of record in the
County Clerk's Official Public Records of Real Property of Harris County, which affect the
easement herein conveyed and which are otherwise enforceable against a political subdivision of the
State of Texas.
The Land herein conveyed will be vested in GRANTEE for so long and only for so long
as it is used for water utility purposes. If the property herein conveyed ceases to be used for such

purpose, the Land hereby conveyed to GRANTEE will revert to GRANTOR without any further
action on the part of GRANTOR.

respective public purpose of providing water utility services for the people of Harris County in
those instances and those instances only in which unanticipated shortage of supply or other
emergency conditions arise and for so long and only for so long as such conditions may exist,
being a public purpose that benefits and serves the public interest of Grantor, such conveyance
being made pursuant to Local Government Code § 272.001(1).
TO HAVE AND TO HOLD each of the above-described easements, together with all
and singular the rights and appurtenances thereto in any wise belonging, together with the rights
of ingress and egress to and from the separate parcels of land covered by said easements for the
purpose of constructing, inspecting, repairing, maintaining and removing utility lines, structures
and other improvements, unto GRANTEE, its successors and assigns forever.
GRANTOR does hereby bind itself, its successors and assigns to warrant and forever defend
all and singular the said easements unto the said Grantee, its successors and assigns, against every

follows with all bearings being based on the Texas Coordinate System, South Central Zone, NAD 83;
COMMENCING at a found 5/8 -inch iron rod In the easterly occupied right-of-way of Village Lane (Called
60 feet wide) and for the northwest comer of said 16.7519 acre tract.
