CC Resolution No. 2508RESOLUTION NO. 2508 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, GRANTING THE CONSENT TO THE ADDITION OF ROAD POWERS FOR AND THE DISANNEXATION OF TERRITORY FROM HARRIS COUNTY MUNICIPAL UTILITY DISTRICT NO. 473 WITHIN THE CORPORATE LIMITS OF THE CITY OF BAYTOWN, TEXAS; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. ************************************************************************************* WHEREAS, the City Council of the City of Baytown, Texas (the "City"), consented to the creation of Harris County Municipal Utility District No. 473 (the "District"), located in the City's corporate boundaries, by adoption of Resolution No. 1737, on August 25, 2005; and WHEREAS, the City Council approved the First Amendment to the Utility Functions and Services Allocation Agreement which reflects a revised District land plan, revised boundaries and the addition of District road facilities on December 14, 2017; and WHEREAS, the City has considered a petition for disannexation of certain territory from the district and for consent to acquisition of road powers from the District and the ability of the District to sell bonds for such road facilities in accordance with the Utility Functions and Services Allocation Agreement as amended, which petition is attached hereto as Exhibit "A" and incorporated herein for all intents and purposes; and WHEREAS, in consideration of the City's granting its consent, the District has agreed and by the acceptance of the benefits of this resolution, do hereby agree to comply with the terms and conditions contained herein as well as in Resolution No. 1737; NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section 1: That the City Council of the City of Baytown, Texas, gives its written consent to the following: (i) District's boundaries as revised per the Exhibit "A"attached hereto; and (ii) The acquisition of road powers of the District and the ability of the District to issue bonds for such road facilities in accordance with the Utility Functions and Services Allocation Agreement as amended. Section 2: This resolution shall take effect immediately from and after its passage by the City Council of the City of Baytown. HARRIS COUNTY MUNICIPAL UTILITY DISTRICT NO. 473 (the "District") was created by Order of the Texas Commission on Environmental Quality on March 1, 2006, under the terms and provisions of Article XVI, Section 59, and subsequently obtained road powers pursuant to Article III, Section 52, the of the Texas Constitution by special act of the Texas Legislature, and is operating under Chapter 8250, Texas Special District Local Laws Code and Chapters 49 and 54, Texas Water Code, together with all amendments and additions thereto. 2. The development of the District is contingent upon the construction of certain road facilities. The primary function of the road facilities is to provide access to the District. The major thoroughfare and arterial road facilities will benefit and serve all of the land within the District. 3. By Resolution No. 1737, effective August 25, 2005, attached hereto as Exhibit A, the CITY OF BAYTOWN, TEXAS (the "City"), consented to and granted a petition for the creation of the District. 4. The petition describes the work to be done by the District as providing for the design, construction, acquisition, maintenance and operation of a waterworks and sanitary sewer system, and a drainage and storm sewer system in the District. 5. The District now requests that the City consent to the addition of road powers to the District's powers and ability to issue bonds for such facilities in accordance with the Utility Functions and Services Allocation Agreement as amended. 6. The District agrees that if the requested consent to road powers is given, the Petitioner and the District will adopt and abide by the conditions set forth by the City in accordance with the Utility Functions and Services Allocation Agreement as amended. 7. The District has not yet issued bonds and has properly excluded land in accordance with Chapter 49, Texas Water Code. The District requests that the City consent to the exclusion of District land and the District boundaries as revised 694849 consisting of 139.3785 acres, the metes and bounds of which are on Exhibit B attached hereto. WHEREFORE, the undersigned respectfully prays that this petition be heard and granted in all respects and that the City give its written consent to (1) the addition of road powers and ability to issue bonds for such purposes to the District, and (2) the District boundaries as revised as shown by the metes and bounds on the attached Exhibit B. Further, the City Council finds that all of the conditions imposed herein and by Article VII of Chapter 98 of the Code of Ordinances, Baytown, Texas, have been agreed to by the developer and landowner of the territory within the District. Section 2: That upon the terms and conditions specified in (i) Article VII of Chapter 98 of the Code of Ordinances, Baytown, Texas, which is incorporated herein by this reference for all intents and purposes, (ii) the Utilities Functions and Services Allocation Agreement and (iii) this resolution, the City hereby grants its consent to the creation of the District pursuant to the provisions of Section 42.042 of the Texas Local Government Code and Section 54.016 of the Texas Water Code. The land embraced within the limits of the District is more particularly described in Exhibit "A," which is attached hereto and made a part hereof for all intents and purposes. The name of the proposed District shall be HARRIS COUNTY MUNICIPAL UTILITY DISTRICT NO. 473 (the "District"). II. The District shall be created and organized under the terms and provisions of Article XVI, Section 59 of the Constitution of Texas and Chapters 49 and 54, Texas Water Code, together with all amendments and additions thereto. The District shall contain an area of 403.9469 acres of land, more or less, situated in Harris County, Texas, and described by metes and bounds in Exhibit A, which is attached hereto and incorporated herein for all purposes (the "Land"). The Land is within the extraterritorial jurisdiction of the City of Baytown, Texas (the "City"). All of the Land may properly be included in the District. IV. The Petitioner holds fee simple title to the Land. The Petitioner hereby represents that it owns a majority in value of the Land, as indicated by the certificate of ownership provided by the Harris County Appraisal District. V. The Petitioner represents that there are no lienholders on the Land except Capital Farm Credit, FLCA, and II C.B., L.P., and that there are no residents on the Land. r= MIT A VII. The general nature of the work to be done by the District at the present time is the design, construction, acquisition, maintenance and operation of a waterworks and sanitary sewer system for domestic and commercial purposes, and the construction, acquisition, improvement, extension, maintenance and operation of works, improvements, facilities, plants, equipment and appliances helpful or necessary to provide more adequate drainage for the District, and to control, abate and amend local storm waters or other harmful excesses of waters, and such other construction, acquisition, improvement, maintenance and operation of such additional facilities, systems, plants and enterprises, as shall be consonant with all of the purposes for which the District is created (the "Project"). The Project will not (a) adversely affect City water and sewer functions, (b) increase City utility rates or (c) impact the City bond rating. VIII. There is, for the following reasons, a necessity for the above-described work. The area proposed to be within the District is urban in nature, is within the growing environs of the City, and is in close proximity to populous and developed sections of Harris County, Texas. There is not now available within the area, which will be developed for single family residential and commercial uses, an adequate waterworks system, sanitary sewer system, drainage and storm sewer system, parks or recreational facilities, or fire fighting facilities. The health and welfare of the present and future inhabitants of the area and of the territories adjacent thereto require the purchase, design, construction, acquisition, ownership, operation, repair, improvement and extension of an adequate waterworks system, sanitary sewer system, and drainage and storm sewer system. A public necessity, therefore, exists for the creation of the District, to provide for the purchase, design, construction, acquisition, ownership, operation, repair, improvement and extension of such waterworks system, sanitary sewer system, and drainage and storm sewer system, to promote the purity and sanitary condition of the State's waters and the public health and welfare of the community. IX. A preliminary investigation has been made to determine the cost of the Project and it is now estimated by the Petitioner, from such information as it has at this time, that the cost of the Project will be approximately $27,800,000.
