Ordinance No. 13,669ORDINANCE NO. 13669 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, AUTHORIZING PAYMENT BY THE CITY OF BAYTOWN IN AN AMOUNT NOT TO EXCEED ONE HUNDRED FORTY-SEVEN THOUSAND FOUR HUNDRED SEVENTY-NINE AND NO/100 DOLLARS ($147,479.00) TO ALFA LAVAL, INC., FOR THE SOLE SOURCE PURCHASE AND INSTALLATION OF DEWATERING EQUIPMENT NECESSARY FOR REPAIRS TO THE BELT FILTER PRESS AT THE EAST DISTRICT WATER PLANT, WHICH WAS DAMAGED BY HURRICANE HARVEY; MAKING OTHER PROVISIONS RELATED THERETO; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. ****************************************************************************** WHEREAS, Texas Local Government Code Annotated §252.022 provides that when the functional requirements of the City can only be satisfied by one source, the requirement for competitive bids is not applicable; and WHEREAS, the City currently uses the Klampresses Type 85 2.0 meter belt filter press at its East District Wastewater Treatment Plant, of which Alfa Laval, Inc., is the sole source authorized provider of parts and services; and WHEREAS, the purchase parts and installation services necessary to repair the City's de- watering equipment at the East District Wastewater Treatment Plant may only be purchased from a single source — Alfa Laval, Inc.; NOW THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section 1: That the City Council of the City of Baytown, Texas, hereby declares that only one source can satisfy the needs of the City to repair its de -watering equipment at the East District Wastewater Treatment Plant. Section 2: That the City Council of the City of Baytown authorizes payment to Alfa Laval, Inc., for the sole source purchase of the parts and installation of dewatering equipment necessary for repairs to the Klampresses Type 85 2.0 meter belt filter press at the east District Wastewater Plant, which was damaged by Hurricane Harvey in an amount not to exceed ONE HUNDRED FORTY-SEVEN THOUSAND FOUR HUNDRED SEVENTY-NINE AND N0/100 DOLLARS ($147,479.00). Section 3: That the City Manager is hereby granted general authority to approve a decrease or an increase in costs by FIFTY THOUSAND AND NO/100 DOLLARS ($50,000.00) or less, provided that the amount authorized in Section 3 hereof may not be increased by more than twenty-five percent (25%). Section 4: This ordinance shall take effect immediately from and after its passage by the City Council of the City of Baytown.
