Ordinance No. 13,612ORDINANCE NO. 13,612 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, TERMINATING THE DECLARATION OF LOCAL DISASTER; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. ************************************************************************************* WHEREAS, on the 27`x' day of August, 2017, the Mayor issued an order and proclamation declaring a state of disaster for the City of Baytown, Texas, resulting from Hurricane Harvey, which presented within the City of Baytown an imminent threat of widespread or severe damage, injury, or loss of life or property and severe economic and social disruption due to flooding, high winds and tidal surges and other public calamity resulting therefrom; and WHEREAS, §418.108(b) of the Texas Government Code provides that a local state of disaster may not be continued for a period in excess of seven days without the consent of the governing body of the political subdivision; and WHEREAS, such disaster declaration was extended by the City Council of the City of Baytown via Ordinance No. 13,571 on August 31, 2017; and WHEREAS, the conditions necessitating the proclamation of a local state of disaster have been largely mitigated and the City and its citizens are in the recovery phase; and WHEREAS, the Texas Disaster Act provides that a local state of disaster may be terminated by the governing body of the political subdivision; NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section 1: That the declaration of a local state of disaster described in the preamble hereinabove is hereby terminated. Section 2: This ordinance shall be filed promptly with the City Clerk, and shall be given prompt and general publicity.
