2017 08 15 CC Minutes, SpecialMINUTES OF THE SPECIAL MEETING OF THE CITY COUNCIL OF THE CITY OF BAYTOWN August 15 2017 The City Council of the City of Baytown, Texas, met in a Special Meeting on Tuesday August 15 2017 at 5 38 P M in the Council Chamber of the Baytown City Hall, 2401 Market Street, Baytown Texas with the following in attendance Laura Alvarado Council Member Robert Hoskins Council Member Charles Johnson Council Member David McCartney Council Member Chris Presley Mayor Pro Tem Rick Davis City Manager Ignacio Ramirez City Attorney Leticia Brysch City Clerk Keith Dougherty Sergeant at Arms Mayor Pro Tem Presley convened the August 15 2017 City Council Special Meeting with a quorum present at 5 38 P M., all members were present with the exception of Council Member Alvarado who arrived at 5:41 P M., and Mayor DonCarlos and Council Member San who were both absent a Consider an ordinance for the first reading of the proposed involuntary annexation of approximately 252 acres of land generally located east of John Martin Road and west of Garth Road on the north and south side of West Cedar Bayou Lynchburg Road, including multiple parcels, Sheppard Road, Thomas Road, Connally Road, and the Harris County Flood Control drainage ditch, east of its intersection with John Martin Road in Harris County Texas Director of Planning and Community Development Services Tiffany Foster presented a summary of the agenda item and stated that tins item is regarding the first reading of the involuntary annexation along the new San Jacinto Road right -of way Additionally, she stated that there were two (2) public hearings held regarding such annexation and a second reading will conclude the annexation. Mr Noal Stephens registered to speak regarding agenda item I a He stated that he doesn't want to be annexed for the reason of having a road installed through his neighborhood He stated that the process for this was wrong because when he was notified, via mail, he was informed of two (2) times that the residents could come address Council as to why they did or did not want to be annexed He stated that it was not mentioned that he could come and speak at the current meeting City Council Special Meeting Minutes August 15 2017 Page 2 of 3 or be in attendance at 5:25 P M He noted the Mayor's absence of twice during the time when he addressed Council with his concerns regarding this annexation. Mr Stephens stated that this annexation is not right and there would have probably been more neighbors in attendance had they been informed Additionally he noted that there's other work that could be done instead of going through Ina neighborhood A motion was made by Council Member David McCartney and seconded by Council Member Robert C Hoskins approving the Ordinance No 13,553 regarding agenda item 1 a The vote was as follows Ayes Council Member Robert C Hoskins, Council Member David McCartney, Council Member Laura Alvarado Mayor Pro Tem Chris Presley Nays None Other- Mayor Stephen DonCarlos (Absent) Council Member Charles Johnson (Abstain) Council Member Terry Sam (Absent) Approved ORDINANCE NO 13,553 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN TEXAS, MAKING CERTAIN FINDINGS, PROVIDING FOR THE EXTENSION OF CERTAIN BOUNDARY LIMITS OF THE CITY OF BAYTOWN TEXAS AND THE ANNEXATION OF 2511 ACRES GENERALLY LOCATED EAST OF JOHN MARTIN ROAD AND WEST OF GARTH ROAD ON THE NORTH AND SOUTH SIDE OF WEST CEDAR BAYOU LYNCHBURG ROAD INCLUDING MULTIPLE PARCELS, SHEPPARD ROAD THOMAS ROAD CONNALLY ROAD AND THE HARRIS COUNTY FLOOD CONTROL DRAINAGE DITCH EAST OF ITS INTERSECTION WITH JOHN MARTIN ROAD IN HARRIS COUNTY, TEXAS, WHICH SAID TERRITORY LIES ADJACENT TO AND ADJOINS THE PRESENT BOUNDARY LIMITS FOR THE CITY OF BAYTOWN, TEXAS MANAGER'S REPORT City Manager Davis stated that August 31 2017 is the date of the final reading for this annexation and those requesting to speak should register by sign in at 5:25 P M Council Member Alvarado inquired if the same means of notification is being done with regards specifically to this agenda agenda item City Clerk, Leticia Brysch stated that this agenda item is done according to the Open Meetings Act, whereas, all of the notifications are done the same as any other meeting City Council Special Meeting Minutes August 15 2017 Page 3 of 3 Mayor Pro Tem Presley noted that as the Mayor Pro Tem of the last meeting, he went against the advice of the City Attorney and allowed citizens to ask questions, as well as, go over their speaking time limit. Additionally he encouraged all interested citizens to attend the meeting and voice their concerns 3 ADJOURN A motion was made by Council Member Robert C Hoskins and seconded by Council Member David McCartney adjourning the August 15, 2017 City Council Special Meeting The vote was as follows Ayes Council Member Charles Johnson Council Member Robert C Hoskins Council Member David McCartney Council Member Laura Alvarado Mayor Pro Tem Chris Presley Nays None Other Mayor Stephen DonCarlos (Absent).
