The Board of Directors of the Baytown Area Water Authority(BAWA) met in a Regular
Meeting on Wednesday August 16 2017 at 9.02 A.M. in the Council Chamber of the Baytown
City Hall, 2401 Market Street Baytown Texas with the following in attendance
Brenda Bradley Smith President
Mike Wilson Vice President
Wayne Baldwin Secretary
Rick Davis General Manager
Ignacio Ramirez, Sr General Counsel
Leticia Brysch Assistant Secretary
President Bradley Smith convened the August 16 2017 Baytown Area Water Authority
(BAWA) Board Regular Meeting with a quorum present at 9.02 A.M. all members were present
with the exception of Directors Benoit and McKay who were both absent
PUBLIC HEARINGS
a Conduct a public hearing concerning the Baytown Area Water Authority Fiscal
Year 2017 18 Proposed Budget At 9 03 A.M., President Bradley Smith opened and
conducted a public hearing concerning the Baytown Area Water Authority Fiscal Year
2017 18 Proposed Budget
Finance Director Wade Nickerson presented a summary of the agenda item and stated that the
budget was unchanged from what was presented at the August 02, 2017 meeting He stated that
the revenues were budgeted at $13,415939 and the expenditures at $ll 561 928 leaving an
ending working capital balance of $5,680,637, with approximately 309 days of operation
With there being no one registered to speak regarding agenda dem I a., President Bradley Smith
closed the public hearing at 9.04 P M
PROPOSED RESOLUTIONS
a Consider a resolution adopting the Baytown Area Water Authority Fiscal Year
2017 18 Proposed Budget
A motion was made by Secretary Wayne Baldwin and seconded by Vice President Mike Wilson
approving Resolution No 2017 17 regarding agenda dem 2.a The vote was as follows

RESOLUTION NO 2017 17
A RESOLUTION OF THE BOARD OF DIRECTORS OF THE BAYTOWN
AREA WATER AUTHORITY ADOPTING A BUDGET FOR THE ENSUING
FISCAL YEAR, BEGINNING OCTOBER 1 2017 AND ENDING
SEPTEMBER 30, 2018, MAKING OTHER PROVISIONS RELATED
THERETO AND PROVIDING FOR THE EFFECTIVE DATE THEREOF
REPORTS
a Receive an update regarding the Baytown Area Water Authority (BAWA) East
Plant Project
Deputy General Manager Bottoms stated that there's discussion with NRG to extend the current
agreement of obtaining access to FM 1405 for another year, as well as work being done related
with TGS regarding getting a permanent access road into the plant
Gary Rabalars, Vice President of Jones & Carter stated that a higher level of the project was
advertised on July 11'h, and there were five (5) active general contractors at the pre-bid He
stated that the bid opening is scheduled for September 07, 2017, and that the contract time was
extended to three (3) years He stated that the bid opening was pushed back and time extended in
order to give contractors time to complete other jobs and focus on this project, as well as,
consider the contractors cost on equipment being that there is much construction going on in this
area Mr Rabalais stated that they're working on the bid form to allow for alternatives for those
who can do the job quicker to include such in their bid for evaluation Additionally, he stated that
TCEQ is still actively processing the wetlands permit and has called them for clanficattons,
which is very positive but noted that there's still no actual date on the final approval
Director Baldwin inquired if a certain amount of land was being approved to be classified as
wetlands or if credit was being purchased to offset such. Mr Rabalars stated that the proposal
being made is to mitigate by purchasing credit in an area wetlands bank
Director Baldwin Further inquired if there was an incentive provided for an earlier project
completion as the bid package is received Mr Rabalais stated that there was a discussion with
staff regarding such incentive, in which this type of incentive always helps but they did not
provide one

a Reminder that the next Baytown Area Water Authority meeting is scheduled for
Wednesday, September 20, 2017, at 9 00 A.M., in the City Council Chamber, 2401 Market
Street, Baytown, Texas 77520
General Manager Davis stated that the next Baytown Area Water Authority meeting is scheduled
for Wednesday, September 20 2017 at 900 A.M. in the City Council Chamber, 2401 Market
Street, Baytown, Texas 77520
President Bradley Smith acknowledged Director Baldwin for his nine (9) years of service on the
BAWA Board and presented him with a gift on behalf of the City of Baytown
Director Baldwin's term expires August 31. 2017 and he does not desire reappointment
